I began receiving calls from this company calling themselves "Del Rey and Associates" in December 2013. I ignored them at first, because i am working to pay down my debt from college, one account at a time. I then began receiving calls that threatened legal paperwork and arrest. I know enough about the law to know that in addition to the fact that you can't be arrested for a debt you owe, a debt collection agency cannot threaten you with arrest. My curiosity was piqued by this so I returned their call.

Call #1: I spoke to a man for a bit on the phone. He explained that I can taken out a payday loan with CashNet and defaulted on payment. Immediately I knew the reason for the call. My ex-partner had taken out several payday loans in my name, without my consent, as we were separating. When I explained the situation the man on the phone began to insult me. He even went so far as to call me a "f**got" because I am gay. I explained that I had a copy of a police report that should absolve me of my responsibility to the debt. I asked him for an address that I could send it via certified mail. He told me to "just pay your bills dead beat".

I ignored their calls until recently. I had began to receive 10+ voicemails PER DAY from this company.

Call #2: I spoke to a woman on the phone. To make a long story short we got into long shouting match. She insulted me and I threatened to complain to the FTC, my state Attorney General and my local DA. I asked if they has a website and she pointed me to http://www.delraycapitalllc.com/ which is a website that looks like it was made in 1996. I told her I didn't believe they were legitimate and would be following up with an attorney. She hung up.

Call #3: I called back immediately after being hung up on and got a woman named Elizabeth Bishop in the "legal department". We discussed my story at length. I gave her my ex-partners information and she was somehow able to track down his new address, workplace, phone number, mother's phone number, mother's address, etc. It was really spooky how she was able to do this. There is no hiding from them, really. Elizabeth proceeded to call and leave voicemails on their machines (she had 3-way called so I could hear her do it). She seemed nice.

I am now receiving calls and voicemails from them again, this time under the name "Cooper Mediation Firm".

I just got this call this morning but today is not the first time they have called. I have no bank account at all! I don't use banks. Haven't taken out a loan, don't have a mortgage, there is no logical reason for this call to me. I live in a senior mobile park where I own my home. I just ignore them as I have absolutely no debts, no creditors and owe nothing that will have gone to collections. Therefore, there is no reason for me to even be getting this call.

I am sure the call itself was intimidating all indications are this is clearly a scam.  Don't worry about it, aside from the fact they are calling with harassing messages.  Just don't pick up the calls from them and they will move along

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
