They call my home daily beginning at 8:00 am, but when i answer the phone they hang up. There shouldn't be a loan collection company calling my home.

I have been recieving calls for 3 months now. When I return the phone call, either they hang up or I leave a message and no one returns my phone calls. I have an attorney who is also trying to get a hold of them for a address or fax number to have a cease or dismiss sent to them but he also can not get a hold of them. now a friend of mine is getting calls. what can I do?

I received phone calls from these people on a daily basis.  So, I finally decided to talk to a rep to let them know they are calling the wrong place that the person they are looking for does not live here.  He called me ignorant a few times then hung up on me.  They called again today, so I tried to be real nice and he didn't say anything to me, just hung up on me.  These people are ruthless and rude.

1) File a lawsuit for FDCPA and TCPA violations:

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

I would just like to say this company is really unprofessional and if there was a way to stop them I would like to know how. They have continued to call my home phone looking for someone that is not associated with this number and received another this morning and I once again explained to them they were calling the wrong number and the man told me I was nothing but a liar and would continue to call. If anyone has a solution as how to stop these annoying unprofessional people I would like to know. I have enough debt without getting constant calls and being called names for something I don't owe or know who they are looking for. This company really sucks!!!!!

Called to collect money that has already been paid and settled on account.  When told this, was very nasty!!!!  Left nasty message on my answering machine.  When tried to call back this number could never get through.

We keep getting calls from this number but they leave a call back number of 1-877-858-9985 which belongs to Advanced Credit Recovery located at 2423 Hyde Park Blvd.

It is a problem because when you tell them not to call they hang up and the Caller ID states Cataract Holdings aka NCO Credit Recovery aka Advanced Credit Recovery...

Repeated calls with recording from Advanced Credit Recovery.  I asked to speak with a rep. since no one by the name they are seeking lives at my address.  I told the rep. that noone lives here by that name and he repeated the persons full name.  I asked for him to remove this number from the calling list and he said "Don't get smart with me!"  and hung up.  Unprofessional!!!!!!
