I've received several calls from a man claiming to be Vincent Cooper. He has a mid-Eastern accent and is looking for an individual who does not live here. He states he has an important legal issue to discuss and leaves this number for us to call: 866-533-0609.  Although the caller ID has this number 213.784.7339. I threatened him that I would report him to authorities and he stopped for about a week. But recently he continues to call and leave messages on our answering machine. I also noticed that when I hide my caller ID number to call him back I can't get thru. This is definitely some scam. Anyone have any sound advice on how to report this?

Received a notice from Convergent, LLC on behalf of LVNV offering to settle a $700 debt for $200.  Not a bad deal, except that LVNV is claiming the debt originated from GE Credit.  I have never had a debt with GE Credit.  I'm used to dealing with bottom dwellers and will use the same tactics here.  First a letter disputing the debt and requesting validation of the debt including documentation showing my signature and the last bill.  You would be surprised at what these bottom dwellers send purporting to be proof of the debt, including acquisition agreements, etc.  After you receive the suspect "proof" that they send, send another letter refuting the proof and asking again for the validation proof.  They won't send it, because they don't have it.  If they can't provide it in 30 days, send them a final letter telling them to stop contacting you.  Keep copies of all letters and documentation received, and then after the final "no contact" letter, write to the credit bureaus (if the debt is showing on your report) and tell them that the debt is disputed, that the creditor has not validated the debt and request removal of the negative report from your credit file.  Removal takes about 30 days because the bureau has to contact the creditor requesting the same information that you just did.  Redundant, but that's the way it works.

The collection agency's equipment failure is not my problem, nor will it be a valid excuse if I receive calls outside the default hours or at times and places I have declared inconvenient. If an agency "cannot control" its own machines, it could simply opt to not use them.

Nothing in the FDCPA specifies any numeric limits on calling, apart from the one call to third parties when skip tracing. (... which most agencies ignore anyway on the pretense that everyone called is a liar, thus resetting permission to call again) FTC staff opinions have held that anything over three daily calls, even if all go unanswered, can be painted as harassing or annoying, therefore violating FDCPA.

An account claim with my name on it does not prove my liability. I am entitled to have a correct amount, correct account details, proper chain of title, and so on. Part of being an adult means avoiding stupid mistakes like paying belligerent strangers over the phone.

That is a fascinating theory I read from someone in your industry almost every week. Not one of the collection agencies which have contacted me in the past fifteen months proved this theory correct. To varying degrees, they all decided from Day One that I needed to be misled, lied to, annoyed, harassed, and frightened to make me do what they wanted. (Most of them, I would add, were skip tracing for people I've never met.)

Meanwhile I remained steadily polite and even-tempered. I asked for simple things which are my federally granted right to have and was ignored. I asked nicely for help with my problems and only got empty promises or flimsy excuses. Among dozens of other violation counts, one agency also seemed unwilling to control its autodialer, and disobeyed my written orders during the worst family crisis I've yet endured. That's why I sued that agency recently, since evidently no one there could "be an adult" and "own up" to their legal responsibilities.

If the agency discussed in this thread is keeping company with the likes of Rodney Giove, the Fred Hanna clan, or the McKinnon brothers as cited by other commentors, I as a call recipient would only have to sit still and watch the Fair Debt violations pile up like cordwood. Then I could haul that pile to a courtroom and burn them within it.

Rebecca Gallagher aka Becky Gallagher has numerous judgments against her from other debt collectors/debt buyers for defaulting on her credit cards.  Not to mention the judgments from the person she stole money from and the debt sellers her and her company didn't pay that others have posted on this thread.

Her dishonesty and scams didn't seem to help her.  She's in worse shape then the folks she harassed and tried to con money out of.  After all, she got what she deserved.  

Rebecca Werth-Gallagher is truly the "the dead beat debt collector".

what people do not think about when they receive calls from a.i. currently they are on a pretty cheap dialer, they cannot control who they call. fdcpa says they can call from 8am to 9pm and up to 7times a day if no one answers. when you call back screaming to remove your number and hang up, you dont give them enough time to pull the account that attached with your number to remove it, once it is removed it takes 48 hours for it to be cleared from the system. when they receive the accounts, they send notification letters, and fdcpa only requires one letter to be sent, but they send one every month. and if you know that the debt is yours, even if you got screwed by the original creditor, then its yours, be and adult and just own up. and yes obviously, i know this for a reason, they dont like your know it all attitude any more than you like them calling, oh and if your on your states DO NOT CALL LIST guess wht, that is for solicitation calls only. and if they dont disclose who they are to you because your not the person they are calling for, its because of the fdcpa yet again, they know the fdcpa very well, get to know it too before you start to act like you know everything. and just because they are collectors and they bother you, doesnt mean they are just as hard working as you, the debtor. thank you all and have a great day! remeber the golden rule, because generally they dont get rude untill you get rude.

"My 73 year old parents were just contacted today by a Mr. Shapiro who claimed to be an attorney trying to "find" me. I have lived at the same address and had the same published phone # for years. When I called this man back he claimed he was an attorney representing an ancient account I once had. He informed me that they were in the process of filing a lawsuit against me and would have my wages garnished. He further went on to state that if I refused to make payment in full, he would "call the sheriff's department and have a warrent issued for intent to defraud". When he finally let me say something I told him I was calling on a recorded line and that I believe he had jut broken the law, because he can't file criminal charges on a civil matter. Then I went on to tell him that the matter was resolved when I filed bankruptcy. He proceeded to tell me that I needed to provide him with all the details of the bankruptcy as well as the list of creditors included. I told him the original account holder was notified and for him to call them, that I wasn't telling them anything else.

I'm pretty sure Greg did not need a lecture from you in money management. It is well established in that story that the debt account was not his and was possibly made of thin air. I do hope he filed suit with FDCPA claims before the next October. That's a case a kid out of high school could win based on all that ridiculous abuse from the collection reps.

In NCO has chased an account after you got it discharged, it's violating a court order, making a FDCPA violation. Seems to me a $1K stat payout and any actual damages would help somewhat with your recovery process.

Jake did not raise any issue of the DNC registry, which indeed exempts non-sales calls. Cease-comm letters are a first line of defense for anyone who is not the alleged debtor or cannot be held liable for the collector's claims.

Those who ARE alleged debtors are better off sending a brief dispute letter, which invokes full FDCPA protection, including shutting up the agency until it validates its claim. The same letter can (and should) contain instructions limiting or barring all phone calls in the future.

Any letters to collectors are best sent via USPS Certified with return card. Learn how to exercise your FDCPA rights as an alleged debtor at FTC-dot-gov.

NCO Financial attempted unsuccessfully to collect money from me even after I advised them IN WRITING that we'd filed for Bankruptcy and they weren't getting a dime.  

The best way to handle collectors is to remember their truth is not your truth.  You have to be a certain type of person who can sit at a desk all day and harass people.  These are the individuals who will go to an early grave because eventually the stress of harassing people, harassment from your supervisor, guilt, and other mental health issues will be a detriment to their health.  Collection agencies need to realize that you cannot get blood out of a stone - people who cannot pay the original creditor are not going to pay NCO or any other collection entity.

Bottom line, if you can help it, is not to create a situation where you could possibly find yourself being harassed by a collector.  We live in such an enabled society that people do not believe they need to pay their bills and figure they will just go away - believe me, they don't.

Bankruptcy ruins your whole entire life.  It has drained me mentally, physically, and emotionally.  After having creditors harass me for 2.5 years 7 days a week 8 hours a day, I've had it.  It's over now, but the scars will last for a long time.  It has basically destroyed my marriage and I'm not sure we're ever going to recover.

Bottom line once again, pay your bills if you can and make sacrifices.  If you drink, even just socially, stop.  If you smoke, quit.  Imagine your cigarettes as $5 bills that you are burning with that lighter to satisfy a craving.  The tobacco companies are not your friend.  If you overeat, stop - get help.  Stop these enabling cycles of abuse and get help so that you can save money to have a safe, healthy, happy life debt free.  Believe me, I know what I'm talking about.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.
False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or
indicate that papers they send to you aren?t legal forms if they are.
Debt collectors also are prohibited from saying that:

you will be arrested if you don?t pay your debt;
they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.
Debt collectors may not:

give false credit information about you to anyone, including a credit reporting company;
send you anything that looks like an official document from a court or government agency if it isn?t; or
use a false company name.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:

try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
