listen your all a bunch of losers. first, if your being called by a debt collection agency and your Phone # address and worst of all social security # is correct with the info they have. YOU OWE A DEBT even if your  to stupid to remember, or just dont want to admit it. other wise you have had your identity stolen and someone made some money off of you, which sucks but if you want it to go away your only options are to pay it off anyway or go through a long process of dispute where your credit still sucks and your still getting harrassed. pay it off then try yo find out who stole your idenity take them to court. its not a scam you owe money. and it because of low lives like you people that take loans, use credit cards and dont pay them back that this counrt sucks

They call at all times of the day and ask for various names.  They CLAIM to be a debt collection service and they get really nasty when you don't answer their questions.  I have no credit cards and they told me that they were collecting a 23K debt on my Discover card... RED FLAG!!! big time!

Attorney General McGraw Settles with Five More Collection Agencies; $1Million in Refunds for 492 West Virginia Consumers

Attorney General Darrell McGraw's scrutiny of the sometimes unscrupulous debt collection industry demonstrates that the complaints of a few abused persons may lead to consumer justice for the many.

For example: The complaint of a Westover woman who was coerced to pay $700 on a disputed debt after a collector hounded her at work prompted an investigation of Bureau of Asset Management ("BAM"), an unlicensed debt purchaser based in Anaheim, California. BAM quickly agreed to refund all payments it had collected and cancelled almost $100,000 in questionable credit card debt allegedly owed by 45 West Virginia consumers.

Sometimes it takes longer: A few coal field residents complained years ago when door-to-door salespersons pressured them into financing expensive Kirby vacuum cleaners on high-interest credit cards without their knowledge. McGraw's office followed the money and learned that the bogus accounts were eventually purchased by Ascension Services, Inc. (?Ascension"), an unlicensed debt purchaser based in Hurst, Texas. Although Ascension was not the original wrongdoer, it agreed to refund all payments it collected, more than $28,000, and cancelled approximately $240,000 allegedly owed by 173 West Virginia consumers on the questionable accounts it had purchased.

Today Attorney General McGraw announced settlement agreements his office recently entered into with five collection agencies, four of which were debt purchasers, that brought approximately $949,000 in cancelled debts and refunds for 492 West Virginia consumers. In addition to the settlements with BAM and Ascension, McGraws's office announced agreements with three other companies: Federal Pacific Credit Company of Salt Lake City, Utah; KESSLER AND FREEDMAN, INC. OF AMHERST, NY and Phillips & Burns of Tampa, Florida.

McGraw?s office commenced investigations of these companies after receiving complaints disclosing that they were collecting debts without a license and, in some instances, were engaging in other abusive collection practices. The investigation of Ascension focused on the company's collection of 173 accounts that it purchased from the now-defunct Fidelity Federal Bank (?Fidelity?) of Los Angeles, California. These accounts originated from a controversial program in the late 1990s when Fidelity teamed up with Kirby distributors who sold expensive Kirby vacuum cleaners door-to-door and financed them on credit cards. In most instances, the consumers were not credit worthy and did not understand that their purchases were being placed on credit cards.

Attorney General Darrell McGraw stated, ?My office continues to be concerned about the increasingly widespread practice in which alleged defaulted accounts, mostly credit card debts, are sold to debt purchasers for pennies on the dollar, years after the default and when proof of the debt may no longer exist. My office will also continue to monitor this industry to ensure that such debt purchasers are licensed and do not abuse consumers. Notwithstanding our concerns about this industry, I commend these companies for agreeing to conform their practices to West Virginia law and for granting important relief to West Virginia consumers.?

Any persons wishing to file a complaint about a consumer matter or to alert Attorney General McGraw about unfair or deceptive practices may do so by calling the Consumer Protection Hot Line, 1-800-368-8808, or by obtaining a complaint form from the consumer web page at www.wvago.gov.

This "mike callahan" called on my cell phone. Since I didn't recognize the number I pretended like I wasn't me and told him "Tru will be back shortly." How he got my cell number I'll never know.  I never put it down on anything other than school forms for my kids so the school can get in touch with me in case of emergency. This "Mike" told me "Tru" is under investigation for credit card fraud!  I have one credit card in my name only and it is current and I make over the minimum payments monthly, so I don't know what this guy wants. He told me to have "Tru or her lawyer" call him and gave me some 866 number to call.  He sounded rude and scary!

I got a call from them starting 4 days a go and it's been hell.I asked about paperwork and they yell at me saying I'm yelling and they are not going to talk to me anymore unless I stop.   every time....  They said I used my card back in 2003 I cut up that card back in 97.  the numbers keep changing. they laughed at me when I asked to speak to some one who isn't going to yell at me.  They pretty much said I have no right to anything but an email of their rights and It's either pay them or go to court. I told them I'm getting a lawyer they said save your money an pay your debt. I said sure send me the paper work I'm asking for and I will she yelled and hung up on me.  I reported them to two different business agency. so who knows what will happen.  They all so said my phone had been off for months It was not.I have a gut feeling they are trying to scam me and told them that.  they got way pissed off.   I pulled my credit report said I they were not on there the said it was a different agency that also has a different amount.  I bet I'll have a message on my machine yelling at me for being so "rude" to "mike's" secretary.  I'll I said the whole time is I don't understand why you won't send me this paperwork  her response I don't have to.  well maybe the should read new york state law and federal laws before they start doing this.  and did anyone notice the fake web page?

These guys are calling you the day that they supposedly sent out that day Demanding that you pay like 3K today or 12k in court costs. It is a nothing short of a shakedown. I immediately called a high school partner who is an investigator he told me how to get them to stop the calls. You could do a Cease and Desist.

not to long ago i got a call from these so called "attorneys" and they of course demanded that i pay some ridiculous amount of money from a debt that was believed to be from 1999 or 2000!! As any smart person should do i asked for everything they told me to be in writing! I've been around the block a few times and i've learned my lesson, (hopefully this will every1 else) so i asked for a BAR # and the documentation which states what their saying, not just some letter i could make up on my computer either! Some sort of official original paperwork!! Of right away when i asked for this info i was called names such as a "DEATBEAT DEBTOR", "LOSER", and whatever elsethis highly unintelligent man could think of!! Needless to say i did keep in touch for awhile because i was curious, every time i talked to someone the amount of the debt changed, the date that it was charged off changed!! THEY ARE A SCAM BOTTOM LINE!! IF THEY CALL YOU DO UR OWN RESEARCH ON THE STATUE OF LIMITATIONS OF YOUR STATE!! MOST LIKELY YOUR OK, CHECK UR CREDIT REPORT IT WONT BITE!! IF ITS ON THERE, MORE THAN LIKELY IT WONT BE ON THERE FOR MUCH LONGER!! ASK THEM HOW MANY CASES THEY WON THUS FAR!! THEY ARE ALL PUBLIC RECORDS ASK FOR THE SITE TO SEE SOME OF THIER "VICTORIES"!!

Thanks "Super  Ticked off"

I was just told by Kessler & Freedman that my account was "taken care of" but I don't know what they meant by that so I think a dispute letter as a follow up to the phone conversation is in order. I appreciate your suggestion.

Still---- I can't help feeling that these guys are making up accounts or that the client who hired them is making  up  debts. Their attack method seems illegal. They kept giving me different facts on the origination of the debt and the company the money is owed to.

I really feel they should be responsible for checking out the validity of their clients before they go after people!!!!!!  They are being negligent when they go after someone without all the facts or they are criminals if they are making all this up, and it is criminal to harass people if the debt is not proven to be true.

Kristi,

Don't pay anthing! If collectors are calling and demanding money for a debt that may not be yours or you cannot remember if it is yours or the amount of the debt is wrong you have, according to the Fair Debt Collection Practices Act (FDCPA) the right to dispute the debt.

If you wish to dispute a debt it is in your best interest to do so in writing. For help on this check out the the link below just cut and paste into your URL.

The police will not do anything even if you are being harassed and are innocent because the below company is a collection agency. The police tell you to work it out with the collection agency. I have a feeling that they are collecting  make believe debts by creating fear and threats on the innocent people to whom they phone. People are so afraid of lawsuits they they pay these guys simply to get them off their back. It is fraud done legally thru a company.

Fraud / Harassment Scenario:
I was contacted on Friday 5/16/08 by phone and told to pay money by Monday for a delinquent account opened in 2000. They told me my social security number and my name! They said the account went thru 3 collection agencies, and then the debt was purchased by Tri Financial who hired them to file a court claim against me.
They were calling me one last time to settle the case and pay the debt otherwise I would be responsible for the lawsuit / court costs and attorney fees and my house would have a lien against it and my wages would be garnished and it would cost a lot more money  (even if it was not my debt). They said t is my responsibility to review my credit report every year and dispute things immediately and  that since I was negligent at looking at my credit report and I never disputed in writing questionable information that I was liable for the debt. On Monday I asked for documentation and got an email and fax, and they gave me a Bank # number into which I could wire them money:
The name of the company, their phone numbers, and their Bank account number is as follows:
   1.) Kessler & Freedman
4250 Ridge Lea Rd Suite 7
         Amherst, NY 14226
2.) Names in their Mediation company: Jay Kay, Peter Stenton,
    Timothy Watson
   3.)  Numbers in the company: 1-866-582-5465, 1-716-362-0070
   4.)  Company email address:
          kesslerandfreedman@yahoo.com  (Jon Schiavone)
5.)  Their Company Bank Routing Number: (Bank to Bank wire):
Kessler and Freedman, 1696 Sheridan Drive, Kenmore, NY 14223
            ***Their bank: Routing # 021313103       acct number 4006010485 *

I've got lots of notes on Mr. Kay & P. Stenton & Kessler Freedman. None of the Police departments will help because they say that Kessler & Freedman Inc. are debt collectors and that I should work it out with them. Only I have an extremely strong feeling that they are harming a lot of innocent people (myself included). They told me my soc. sec. number and set about creating fear and ultimatums for a debt that I never did on a credit card that I never had. I am very upset with them. It's like: They have the license to Kill."

Well, I got this call again today. This time I was able to stay on the line and press 9 for a "live" person. When the man came on the phone, he asked for a person that I've never heard of! I told him that I have had the same phone number for 9 years and there has never been anyone here by that name. He said he'd take me off of their call list.... we'll see.

If you can, try staying on the line and speak to a "live" person. Sometimes it really is a mistake and they'd appreciate knowing that just as we'd appreciate them not calling.
