I get calls every day from this woman who calls herself Lila. She told me that I owed her company $25.00 but would forget about if I talked dirty sex talk to her over the phone. I hung up. I keep getting the calls from 716-564-4905 but will not answer them.
Is there anything I can do to stop the calls? I can not change my phone number.

A woman from a First Source Advantage called and said I owed her client $150,000 (!!!) dollars for some mink coats, jewelry, and other luxury goods that I never did or would never buy. She went on to say that unless I agree to pay them off at at least $3,000.  a mo th until the "debt" is paid off, her company would send me to jail and confiscate my home, car and other assets.

Why are these types of people permitted to call like that? Supposedly she was recording her call ... it would be interesting for a sheriff to raid the office and confiscate all of the "recordings".

From Tonawanda New York. The most rude, disturbing man called and starts accusing me of cheating, being a deadbeat and a terrible person. When I asked the nature of his call and who he represented, he claimed that my telephone number is on multiple files at his company and if I don't pay up he will get his people to take care of me.

I told the him if I get any more calls I will notify the state attorney general and file a harrasment case against them.

Why are you grilling a commentor from 2.5 years ago who was a fellow call recipient? Can you maybe look around first before you post next time?

Your callers do not maintain this site or this web page. Your callers cannot magically determine which numbers should not be called based on anonymous comments. You cannot expect compliance with your orders until you deliver them *directly* to your caller.

First Source Advantage, previous Niagara Credit Solutions of Niagara Falls, calls all time. For someone else.

If you are getting collection calls for someone else:
Take notes. Write down the phone number they are calling from and try to speak to someone to get the name of the collection agency. Remember, under the FDCPA, if you are receiving calls for someone else, they are required to provide the name of their employer upon request.
Tell the collector they have the wrong person, and ask them not to contact you again.
If the collector calls again, tell them you are going to report them to the FTC and your state attorney general?and do so. You may want to offer to fax them a copy of your phone bill with your request that your number be removed from the debtor?s records, but you are not required to do that.
If its not you they want ask the debt collector for the company?s fax number or email address. ?If the calls don?t stop right away, the person being called can email or fax the collector the first page of their phone bill?showing the phone number the collector just called, and the name of the person on the bill (not the debtor). This is your proof to sue later.
If the calls continue, contact a consumer law attorney.

They called my cell and refused to give me a message regarding the person they were trying to reach, even though I asked several times who they were and what the reason for the call was.  I called the number back and actually got the same guy and the name of the co, first source.  They may have laws regarding collection, but in my personal experience they will do and say whatever they want over the phone!

well these people call my phone, and when i dont answer they call my GRANDMOTHER, and start harassing her. Yes, thats right I said they call MY GRANDMOTHER. she always picks up the phone no matter the number, as pharmacy companies and others are always calling about meds from different numbers. I dont know how they got her number, and I dont even know why they are calling me for a loan I supposedly got, and never paid off.
1. I have never received a loan except the one for my car, which it automatically paid every month without fail with an account i set up just for the car.
2. How am i supposed to pay back $800, on a $200 loan I never even received?

This doesnt make sense its a bunch of bulls*it. and I am so over them calling me and my poor granny 4-5 times a day with out fail.

I got a call from this company, asking me for my birthdate and zip code telling me its a company that I signed up for to look for a job.....Ive been unemployed for almost 3 yrs, and I have signed up with many different recruiters and temp agency...When I found out this company was a collection agency.  Unbelievable.

Saw the number on my cell , caller ID. I did not give my cell number out to anybody except the local library and  the handyman who worked in my home. Guess what...getting call from this number. No message was left. Anyway, I think several big companies like AT&T & Time Warner Cable screw up my bills so I canceled their services after giving my last bill. Instead of doing the right thing, they probably just give my number to some collection agency just to give me hard time. What should I do?

A one-party state requires one party (you) to be aware the call is being recorded. No confirmation of recording is necessary to the calling party.
A two-party state requires both parties to be aware of recording.
Federal guidelines adhere to the one-party rule. This comes into play when the caller is calling from out of state.
To avoid any technicalities simply inform the caller that the call is being recorded.
Debt collection firms routinely record their calls. As a business, they are required to inform you the call is being recorded. They rarely do, which is a violation of federal law.
When dealing with a suspected bogus or fraudulent debt collector record all of your calls. Tell them you are doing so. If they object it's a sure sign that they're engaged in unlawful practices. At this point you tell them to put it in writing and put it in the mail. Not e-mail or fax. They object, they're frauds. Simple as that.
Be safe. Be aware.

Hey dear,

You are mixing state law and federal law.  Two totally different things.
It is not against federal law to record your own telephone as long as your telephone is in your own name
and your name only.

Now to states, most states law allows the owner who's name the phone number is in to record incoming calls. As for proof. After you send a cease and desist letter telling them to stop calling you.
Call your phone carrier / company and order detailed billing. There will be a small charge but well worth it.
Make sure you tell the carrier you want ,  out going called numbers as well as in coming numbers listed in detail on your bill.

You will not need a recording, they should'nt be calling you for any reason after you send them a ceasse and desist letter.

But  Rachel,  your  mixing  state and federal law. Two TOTALLY DIFFERENT things.

Your wrong dear. You have in backward. Most states are a one party state.

Even if you live in a 2 party calling state. Get your attorney to check into getting a warrant to tap your own
telephone for harassing and threatening calls.
No one on here can disagree with that. What judge would deny a court order for you to tap your own
telephone.

Yesterday on cell phone + residential phone/never left a message,
Thentoday; this morning looking for me. I did not recognize the number & party so,
I used my alias on Cell Phone & Residential phone.
The party says that they will remove my numbers from my list & conversation was being recorded for quality assurance purposes.
I also went on to say that I was conducting a legal investigation into this matter & this conversation was recorded. Then I heard an abrupt "CLICK".
Obiously, they are some sort of a fraud.
