716-568-7940 JUST RECEIVED ANOTHER "I'M GOING TO JAIL IF I DON'T RESPOND TO THIS PHONE CALL" #1. IF YOU WERE LEGIT THEN THERE WOULD BE A "LIVE" PERSON ON THE OTHER END #2 YOU REALLY NEED TO IDENTIFY YOURSELF FIRST AND FOREMOST #3. I DON'T RESPOND TO ROBOTS.       GET CALLS LIKE THIS FROM DIFFERENT NUMBERS, ALL THE SAME THREATS.  I USUALLY HANG UP BEFORE I GET ANOTHER PHONE NUMBER TO CALL THEM BACK ON, I'M NOT GIVING ANY INFORMATION TO SOMETHING I KNOW NOTHING OF....

They strike again!! Different #'s of course. They have been calling me on and off for about two years now. Funny I was just talking about these people the other day. They have said ask the things everyone is stating on here. One guy called my work phone over and over when I kept hanging up on him. I told him to stop calling my work phone which is completely illegal. He kept threatening to deliver paperwork to me. I told him come on, if you got papers for me bring them to my job at 4pm when I would be done with work. I work at a restaurant. I waited about 30 min and he called wanting to know if I was still at work. I said yes along with a deputy from the sheriff's office. Needless to say he never showed up. The calls stopped until now. Looks like I get to have some fun today when they call back until I let them know I am not giving up any information. The last guy got so heated with me. I have reported in the past but they change #'s so often its hard to keep up. They never produce paperwork they just try and scan money.

They claim they are a attorneys office but no attorney acts in that matter. Go online and file a claim with the Federal Trade Commission. Also, DO NOT give them any information about you whatsoever. Also if you do owe a debt, they are required by law to send you a letter of validation in the mail by certified mail only. If they ask for your address, don't give it to them because if they claim they have filed papers on you then they should know your address.

This whole collection industry is going over the line. They call at all times and cell phones. Then people get charged for their minutes. they make all kinds of threats.people feel in a helpless situation. I saw a show Empowering Minds on PBS hosted by Martin Sheen that brought light to this situation. It was very eye opening. There is a lot someone can do. Call your local BBB and report. read the FDCPA and know your rights and don't fall for their scam.

This company is called Resolution Performance Group (RPG) and they are just scammers. They way they go about collections is completely illegal. It is illegal to threaten and harass, disclose third party information and they definitely CANNOT threaten with a summons or legal matters. A sheriff will not come to your home!! It is scare tactics and that is all that is. I suggest anyone being threatened by this company, look into your rights. Read the FDCPA! It will tell you what collectors can and cannot do. It will tell you what is and is not illegal and will probably help you more If you are looking to file a lawsuit or get some justice. I also suggest that you RECORD everything! Hope this information helps, I had to learn the hard way.

I have received numerous calls that are threateing me with either coming to my house to have legal documents dropped off or come to my place of employment and I need to notify my supervisor that they are coming so he can wittness me signing these legal documents. They also say they are charging me $75.00 every time they call or try to come to our house.  They have actually said they have been to our house on numerous occasions.  I have no idea who these people are.  I have not received a letter from anyone that I owe any money. Funny they say they come to my house,  my husband has suffered a severe stroke and these phone calls are upsetting him to the point of seizures and he is home 24/7 with our daughter helping out so there is ALWAYS someone at our home.  I can produce medical information if you need it.  I have told these people to stop calling me and harassing me but when I talk to someone they are denying that the "canned" threat was not from their office.  I am stumped and I need them stop right now.  If my husband is hospitalized because of the stress this is causing him I will seek more advice from my attorney.  He is more than aware of this situation and has a file on this particular phone numer.

The fact that you and Brian are willfully ignorant of the scope of the Do Not Call registry and the Telemarketing Sales Rule does not render those things useless. Why would you complain about actions which, once again, DO NOT APPLY and expect anyone to "look into these things further"? The triple-B is a blind alley mainly because it's a glorified business directory service with no regulatory power, known to be run like a payola scheme.

The real issue is one of apathy. When your rights are abused by collectors it's *your job* to assert them. Filing complaints with the proper channels, chiefly the FTC and attorneys general, may help your neighbors but will not summon a rescuer to fight your battle. As stated here months ago, the controlling federal law is the FDCPA. "Look into" that and you'll have a whole toolbag of defenses and weapons for defeating scofflaw collection agencies, often without a lawyer holding your hand.

As to the good suggestion of recording phone evidence, the stinger is an issue of consent. The majority of states won't require you to announce your recording. Linked below is a guide to the issues aimed at journalists which does good job of explaining things. Also of use, in August 2010 the U.S. Second Circuit Court of Appeals ruled that single party consent is just peachy for recording the phone person-to-person, so long as your intent is not in some way criminal or malicious.

Jordan,  Thanks for the warning.   Why do they do this.  She has so much information that it is scary.  The company that took my 150.00 was an east coast number as well.  It was only after I faxed them my information that I realized that the fax number was a San Diego #.

This all went back to October of last year when my account was compromised,  I am sure that if i did in fact owe any company they would have been trying to contact me back then,  A real collection company. Correct?

I rec'd 2 calls from a Sabrina Mcdaniels both times at WORK!!!   She stated she had my file in front of her and I had 48 hours to clear this up.  I asked with who and she stated from Peppercash? I looked online and I dont have anything with a Peppercash. I told her I don't have any money and that if I did in fact owe something they would not get any money until July 15th.  She stated she would email me the information.  that was last Friday and I did not hear anything until today when she again left a message for me at work?   I was recently taken for $150.00 about 2 months ago so I will not give anyone any information.   If I do in fact owe something why haven't they tried to get in touch with me.

Any suggestions?  this is making me worried.

They have called me twice. The first time they called, they told me they were with the ** County Municiple Court. (My County I live in). I called my Municiple and County Courts, neither had a person named Michael Stewert working there. They said this in their message

MY name is Michael Stewert, I am calling from *** County Municiple Court. I have some papers to serve against you, or you can call and take care of this matter before I serve you with the local sheriff in the next 24 hours. You can call at 716-568-7670, but I must receive a STOP order or I will serve you with these papers. This is a very important matter, and needs to be taken care of"

The second phone call stated that he was an Independent Process Server with *** County Municiple Court and that I could call 716-568-7925

Again, immediately after hearing this recording (First time I answered the phone - it was a 0 calling, and got no response when I spoke to "Michael Stewert", the second time was a voicemail), I would call our local courts, in our town and the surrounding counties. They would tell me they have had several complaints just like mine, and that NO ONE by the name of Stewert or even Michael worked at their locations. They told me DO NOT give them any information.

The first time I called back the number. It was a number for RPG (Resolution Performance Group). They knew information about me from when I was TWELVE. Where I was in school at. They tried telling me I had a bad cell phone bill with Sprint from when I was TWELVE - Not hardly. Either way they wanted IMMEDIATE payment in full. They would ONLY accept Debit Card or Bank account routing info. No Credit Card, No western union, no check or money order. They wanted my bank account, period. If I couldn't give them that, they were going to 'sue my f****n a**" (that was their exact words, the woman was even screaming at me, before I even lost my temper!) - I've filed SEVERAL FTC Complaints, I've filed Complaints with the BBB, and I've spoke to the law. Nothing can be done apparently.

Hahaha, that wont happen. Did you get served yet? probably not. I don't think people realize if this company gets numerous complaints to the Ny state attorny general pertaining to the companies misrepresentation of themselves. calling themself process servers, irs employees, law office, etc. then eventually the ny attorny general is tired of it and everything starts to look fishy..so they look into it and terminate the company or the lesser consequence fines and fees.

Caller left a message on my voicemail stating her name, Ms Sanders and she said she is an Independent Process Server. She said she was ordered to serve a court summons to me at my home or place of employment within 48 hours. She provided a Civil Case number 23-4062 and said I could settle the matter with the orignial petitioner and to ask for a "stand down order". Then she wished me "good luck".

I just got a new number a month ago, and they have called every day. Finally I just called them back on the 716 number, and talk to a representative. They asked if I was this person (Ms. Smith) and I told them no, and she took my number off their list. I guess the previous owner of my new number has debt issues.

You can file with the bbb or the dnc and you definitly won't get results. they do not look into these things further..my suggestion is to find an attorney that specializes in this type of dirty collections..record calls but be aware, these collectors will try to use it against you and state that without their permission you can't record the call...record everything whether they know or not..

} "What their motive is...  I have no idea."

They want money from you or someone else. What more of a motive do they need?

} "My telephone company ... will allow me to "block" up to 11 phone numbers."

My my, eleven whole block slots from your generous telco! It should take you all of three weeks to fill those up. Do you seriously think a determined debt collector will use only one number?

} "I have no outstanding debt, nor have I ever."

You don't need a valid debt or a derogatory trade line on your credit reports to be hassled by debt collectors. They call third parties to alleged debtors all the time for permitted skip tracing purposes, or often pretending it's a trace to annoy and shame an intended target whose location is already known.

To a ''not me'' case I always recommend putting the agency on notice, just as you would if you were the target and the debt claim was invalid. Send a cease-comm notice via USPS Certified with return card. The FTC and many consumer watchdogs explain how to draft one. This will set a legal landmine, as such a notice is ignored at their costly peril.

The cost to you in paper, ink, and postal fees will in a year amortize out to 48 cents a month. That will handily beat your blocking service fee, and it's a permanent solution as opposed to a temporary noise muffler.

You've proven you can clip 'n' paste from the FTC but have not noticed what it has to say about debt collectors. They are not "telemarketers" and are therefore exempt from scrubbing the DNC registry.

The following URL links to the FTC FAQ page which the DNC site *twice* coaxed you to read before you registered your numbers. See items 28 through 32.

The National Do Not Call Registry

National Do Not Call Registry

The National Do Not Call Registry gives you an opportunity to limit the telemarketing calls you receive. Once you register your phone number, telemarketers covered by the Telemarketing Sales Rule have up to 31 days from the date you register to stop calling you. You can register your number here or by calling toll-free 1-888-382-1222 from the number you wish to register. Registration is free.

Placing your number on the National Do Not Call Registry will stop most telemarketing calls, but not all. Calls from or on behalf of political organizations, charities, and telephone pollsters are still permitted.

Organizations with which you have an established business relationship can call you for up to 18 months after your last purchase, payment, or delivery - even if your number is on the National Do Not Call Registry. And companies to which you've made an inquiry or submitted an application can call you for three months.

If your number has been on the National Do Not Call Registry for at least 31 days and you receive a call from a telemarketer that you believe is covered by the National Do Not Call Registry, you can file a complaint at the registry's website or by calling the registry's toll-free number at 1-888-382-1222 (for TTY, call 1-866-290-4236). To file a complaint, you must know either the name or telephone number of the company that called you, and the date the company called you.

Debt Free,

Please protect yourself.  Take the steps provided for you in the law, as ignoring these jerks can result in them getting a default judgement, even if the debt is completely bogus.

Some low life collectors depend on you ignoring them while they use "sewer service" and default judgements to take your money.

Demand validation and follow with a dispute/drop dead letter.  If you get served, go to court, and take your documentation.  If you have kept records of their unlawful collections activities, this would also be a good time to file a counter-suit.  You could be the one going home with a judgement against them !
