Just received a call from this number due to a request I sent in for an actual account number.  I've had two people from Creditors Interchange about an account that was charged off back in 1999 (last I checked it was 2010, which is 11 years later).  The SOL for credit cards in the state I live is 5 years.  So if they try to take me to court, it will get dismissed with predjudice.  It doesn't matter because I will be filing for Chapter 7 in the next couple of weeks.  So they can keep calling and leaving me voice messages on my cell.

there is NO DEBTOR's prison! I always paid on time, had perfect credit....then the job market went to S**T!  They have to understand that feeding my family is more IMPORTANT than paying them while I am unemployed -- and they could care less!  So, I don't answer, it does not bother me anymore.  As long as my kids eat and have clothes I'm good.  I'll get to it when I get to it!

I keep receiving calls from them along with mail. I have been paying Bank of America, just sent them a check and they cashed it. then why is CI calling me and harassing me. I haven't called them back and don't know if I should. I've been paying what I can and they won't stop the mean calls. What should I do?

To date:
They have called at 6am and as late as 9:30pm
Claimed to be an attorney
Made false statements about my credit rating
I will go to hell for not paying my obligations
State, every credit card I have is frozen (not true)
First I owed 9800.00
THen 13900.00
Now it is 19980.00
They have called the store I work in and talked to anyone including customers that have answered the phone and told them aweful aweful things that end in make sure you tell her what I said.
THey attached a bank account that was not mine, it was my employer first they took 186.00 then 215.00, we had to close the account and open a new one.
All I want is the charges made after the account was closed removed.  I will pay what I owe, not fraud charges.
I am at my wits end, I have no money for an attorney so now I do not sleepm am waiting for a knock on the door and I am fearful of every phone call.
What horrible people I hope they reach their just deserts.
Thanks for letting me sound off

It's Creditors Interchange, the sleaze of the debt collectors world. They lie, cheat, and try to scare you. They are rude, obnoxious and just plain idiots. When they call they claim to be from various law firms, government offices, county offices, etc etc. Look at the link above this post it's a very accurate description and what to avoid. Be wary, and do not give them any account numbers, they will steal from you.

I had a nice long "talk" with on of their representatives today. She went off on a barrage and tried to not let me get a word in lol. Threatening to call my parents (I am 30.....) wanting me to pay them with my student loans trying to tell me that student loans cut you a check and you can do whatever you want with them.. Morons, sure student loans may be able to be setup like that, but most loans and grants are handled completely by the finance department of the institution you are part of.

Just let them talk to your answering machine, they cannot take actions against you, they cannot write bench warrants for you (creditors do not control the law enforcement) etc etc etc

Cannot believe that Bank of America uses these con artists, shows how crappy a company can be.

To Anon, June 19,
I worked for Creditors Interchange, B of A department. Just so you know, most of the Bank of America accounts that Creditors Interchange handles are Arbitration and Pre-Arbitration accounts.

While NO collector should tell you that they, themselves will take action against you (because they, themselves, cannot and it is illegal to say so), know that if you're getting a call from CI pertaining to a Bank of American account, your account is very possibly in pre-suit status.

Unfortunately, with so many collectors out there NOT telling the truth, how can someone getting a call be able to really know when they're being told the truth that their debt is in a legal status?  Understand, I denounce this type of collector, who gives the rest of us who do our job compliantly, and with compassion, a bad name. It's one of the reasons I left the industry.

Anyway, just wanted to give you the heads up. If Bank of America has put your account in this arbitration cycle, they send it to collections to try to work out the payment prior.  (And, in fact, Bank of America was not the only creditor who gave us pre-legal accounts to try to collect).

Next, I strongly advise not sending a Cease and Desist letter. The American Collection Association has indicated a direct correlation of increased arbitration cases with the increase of CAD requests. When you demand no communication with your lender, and you're not paying the bill, you've basically taken away their ability to try to work out an arrangement with you. Think about it... if someone owed YOU thousands of dollars and then legally demanded you not contact them to ask for your money back, wouldn't YOU consider a civil suit to force them to pay?

I hope this has been helpful.

I'm canceling my AT&T home phone service over these kinds of calls, and here's why:

1) I PAY for "privacy manager" service, that supposedly isn't supposed to let solicitor calls through, but somehow Creditors Interchange can get through it when my PARENTS can't!

2) I PAY for "call blocking", but when I enter these phone numbers from Creditor's Interchange, I get "we're sorry, but the number is not correct, please try again". It does not matter if I enter the area code first, try without it, with a 1, without a 1 - it always gives me this message. Strangely enough, I can add my PARENTS to the block list, but not Creditor's Interchange!

3) AT&T is not giving me what I PAY THEM for, and they can't/won't fix the problem, and it's happening on their 100% owned and controlled network, which they are 100% responsible for.

4) We do not DO credit, AT ALL, so I know automatically that these calls are ALL fake. We pay everything in cash on the 1st of each month, and we haven't had anything like a "debt" in over 10 years.

Conclusions:
a) AT&T is double-dealing with/is in cahoots with, the scumfuck junk-debt collectors and scammers! Seriously, what other explanation is there?
b) Creditors Interchange is an obvious SCAM!

Solution:
Ditch my land-line and stop funding AT&T.
The only people who call my home phone were scammers and my PARENTS, and they can call my cellphone!

Yes they call, do not leave a message, then when you call back, you receive the following:  high pitch sound "the number you have reached 716-614-0000 is not in service, if you feely ou have reached this in error, please check the number and dial again, thank-you"

Very irritating since they have called early the last few days.

I have also received numerous calls from this and other numbers asking for someone (always the same person) I've never heard of...actually it is a name of a completely different nationality than mine.  Today, Nov. 5, 2010 was the first time I was contacted from this particular number, but all the different numbers claim to be from "Card Services of America".  I have talked to numerous people to try to get the calls to stop but they never do.  I wouldn't answer, but I don't want my number associated with anything involved with these people, so I usually answer and tell them the same thing I tell all the other callers.  I also don't think I should have to change my phone number on account of a company that I have never been involved with.  If what I read here is true about Giove, etc.,  legal action should be taken and these people should be STOPPED!

Creditor's Interchange is located in Buffalo, NY,  and they have a large collection operation across the river in Canada where the wages and worker benefits are even smaller.

VERY aggressive debt collectors who lie, threaten and do any illegal act imaginable to separate you from your money. These are nasty, desperate conmen,  and should NEVER be trusted. They have posed as bankers, lawyers and other professionals to scare consumers into believing something bad would happen, if monies were not immediately forthcoming.

In reality, these low-lives of the collection industry are nothing but a fraud! Any debt collector from Buffalo, New York is desperate, however Creditors Interchange apparently is hiring the WORST of the WORST! Stay far away -- they are desperate and dangerous.

http://www.budhibbs.com/collectorpages/creditors_interchange.htm

The "IRS"? I don't THINK so!

Creditors Interchange is a bottom feeder collection agency out of NY and they have violated FDCPA laws by misrepresenting themselves as a government agency.

They have also been sued by the NY AG's office for illegal debt collection practices and are currently under a court order to "clean up their act":

ALBANY, N.Y. (June 2, 2009) - Attorney General Andrew M. Cuomo today announced that his office has reached an agreement with three New York debt collection companies that failed to adequately supervise employees who engaged in deceptive and fraudulent methods to collect debts.

The three companies, Creditors Interchange Receivable Management, LLC, Capital Management Services, LP and Tri-Financial, LLC, have agreed to substantially reform their business practices in order to be in full compliance with the Federal Fair Debt Collection Practices Act and New York?s Debt Collection Procedures Act. The companies, which are based in Western New York but do business across the country, are also paying $245,000 to the state in penalties and costs.

?We will continue to investigate the myriad deceptive practices that debt collection companies, debt settlement companies and others employ as a means to exploit consumers who are already down on their luck,? said Attorney General Cuomo. ?These three companies have agreed to immediately stop these practices and reform their policies to ensure their collectors comply with both state and federal law. I call on other companies engaged in the business of debt to do the same.?

According to complaints received by the Attorney General?s Office, collectors at the three companies employed fraudulent tactics in an attempt to collect debts, including:

Contacting alleged debtors without a lawful justification for doing so and even after being asked in writing to cease all communication
Contacting consumers at their places of employment even though the collectors were aware that such contact was prohibited by the consumers? employers
Discussing consumers? debts with third parties (i.e. employers, neighbors, etc.), and doing so even after the third party told the company to cease such communications
Falsely claiming that the company was acting on behalf of an attorney and that the company or a creditor was about to commence legal action against the consumer
Failing to respond to consumers requests for debt verification
Under separate settlements with Attorney General Cuomo?s Office, the three companies have agreed to enhance their compliance protocols and make it easier for consumers to file complaints against individual collectors. All three companies must create a direct link on their respective Web sites to consumer complaint forms. The companies must also maintain an employee disciplinary history database, as well as a comprehensive database of all complaints made by consumers or third parties who were wrongly contacted by collectors.

For the violations, each company must pay penalties and costs to the state.

Tactics prohibited by both the federal Fair Debt Collection Practices Act, the New York State debt collection and consumer protection laws include: posing as an attorney, threatening lawsuits or other legal action which cannot be taken, saying a consumer committed a crime or will be arrested and talking with third parties except to get location information. The law further requires collection agencies to send a written notice within five days of initial communication with the consumer explaining how he or she can dispute the debt. If properly disputed, the collection agency must stop all collection attempts and send verification.

The settlements announced today are part of a larger investigation by Attorney General Cuomo into unlawful debt collection practices. Last week, Attorney General Cuomo subpoenaed nearly twenty companies and law firms operating as debt collectors throughout the state. His office also shut down two collectors for threatening and intimidating consumers into paying debts that they did not owe. In early May, Attorney General Cuomo announced a lawsuit against two debt settlement companies for fraudulent business practices and false advertising by selling misleading debt settlement plans that very rarely deliver the promised benefits to consumers dealing with debt.

Cuomo also launched a website - www.NYDebtHelp.com - that explains consumer rights, allows victims of debt settlement companies quick access to the Attorney General?s office to file complaints, and outlines the stages of the Attorney General?s investigation. These three cases were handled by Assistant Attorney General Dennis Rosen and Senior Consumer Frauds Representative Karen Davis under the supervision of Deputy Attorney General for Regional Affairs David Sampson and Assistant Attorney General in Charge of the Buffalo Regional Office Russell Ippolito.

http://www.oag.state.ny.us/media_center/2009/june/june2a_09.html

Go to www.NYDebtHelp.com and file a complaint. Cuomo's office needs to be aware that they are violating their court order.

?Rubber Duck? Reports:

In a fairly recent 2008 memorandum decision in the Supreme Court of New York State, the modus operandi, and therefore inherent personification of the entity, ?Creditor Interchange?, its ownership, management and counselor?s is made public for all to see.

Although the defendant was ultimately awarded dismissal, the plaintiff?s reference to the use of misleading oral promises, as well of employing ?dark legal practice? in the phrasing of written contracts by Creditor Interchange is eloquently described within the context of the decision, and could be construed as a warning to others deliberating on whether to enter into any business agreements with the parent company, Credint Holdings, LLC, Creditor Interchange, LLC, its ownership, management, counselor?s and others, directly or indirectly involved with its affiliated businesses and/or ad hoc associations.

The text of the above referenced proceeding is posted on the internet at: http://www.nycourts.gov/courts/comdiv/PDFs/8th%20JD%20DOIs/Gouchie%20MD.pdf

It is of additional interest that the planned acquisition of Creditor Interchange by Debt Resolve, Inc. (AMEX: DRV), terminated by the buyer, was due to Creditors Interchange?s breach of its representations and warranties under the purchase agreement related to its financial condition as well as the existence of a material adverse change in the financial condition of Creditors Interchange.

Debt Resolve Co-Chairman and CEO, James D. Burchetta said: "We are extremely disappointed we had to terminate our efforts to acquire Creditors Interchange. Unfortunately, the deterioration of the financial condition of Creditors Interchange left us no choice.?

You're obviously being called because you owe a debt. This translates to "The creditor is giving you an opportunity to pay this of your own volition".

Please keep us informed of what happens. I look forward to reading a post from you down the road when you are complaining that no one notified you, beforehand, that you've been sued by your creditor.
