GMAC Escalates Collection Agent Harassment, Tom-Fookery

Consumers beware, you may not wish to believe this, but the most sadistic, vicious and unscrupulous (potentially illegal, even) collection agents in the whole of the Fortune-500 are those in the curiously operated, suspiciously located, GMAC Financial Services Auto collection department.

This came to our attention over two months ago, when the GMAC collectors would call one alleged victim an unbelievable [and generally illegal] six to eight times a day, (though graciously resting on the Sabbath.) Godly as hell, don't you think?

He came to us for help in the media fashion, and we gladly took on the task. After all, if the media won't uncover corporate abuses against consumers, who will be the champion for the common man?

Curious as to whether or not this article would constitute libel, Glossy News' editor said, "I've supervised the [agent-authorized and fully disclosed] taping of calls from these law-indifferent collectors. They're violating no less than six Washington state and federal statutes, according to my research."

He added, "The agents all agree that this is standard business practice, except the repeated calling, which they consistently deny, despite our thorough documentation. If and when these tapes are sent to the respective states Attorney General's offices, GMAC could be facing yet another class action suit for collections abuses."

Better Business Bureau complaints have reached a dead end without even the vaguest semblance of resolution. A Seattle-area venture capitalist suggested, "those guys [BBB] are more corrupt than Puzi's Mafia. Trust me, I'm almost twenty complaints into that worthless pursuit of justice, these guys are basically owned and operated by their members, all of whom pay top dollar for inclusion and a clean consumer record. Getting a complaint to actually stick to a big company is literally, statistically impossible."

Calls recorded over the past two-months have shown an alarming corporate philosophy of threats, outright lies, and consumer abuse grossly in excess of legally accepted limits.

Documented abuses include:

Up to eight documented collection calls in a single day.

Requests for written statements of collection and settlement repeatedly denied.

Verbal threats, including promises to continue calling practices, regardless of any proposal of payment short of payment in full.

Some agents refusing to identify themselves or provide any contact information (including mailing address.)

Perpetually renewed "absolute last deadlines" prior to litigation, which have never moved beyond threat status. (The law states that claims of legal action MUST be legitimate, not just to be used for intimidation purposes.)

GMAC collections agents still typically claim a long-standing history of having not yet established contact, despite possessing and presenting information from prior conversations (not to mention our own growing audio tape library and contact log.)

No mailing address has ever been provided, though after fifteen consecutive conversations requesting it, it was finally acknowledged that this collection hub is located in India, though wholly owned and operated by GMAC.
The defaulted debtor in question, who wishes to remain anonymous, explains, "I voluntarily gave them back the car without incident. They know I haven't worked since my back injury. Every day I talk to them and every day they tell me I am working, which I'm not, and tell me I have houses, jobs and bank accounts that I don't. Then they threaten me. I still haven't seen anything in writing from them, not even a post-repossession statement."

Conversations have repeatedly confirmed that his current address matches the address or file, so no reasonable explanation for this lapse has yet been deduced.

His disability pay has been expired for over a year, yet his injury still prevents gainful employment, as a pre-authorized conversation with his physician has confirmed. While his cashflow may change week-to-week, it's fair to say it doesn't change between each and every business hour.

Diligence may be virtuous, but this behavior is literal harassment, and that's no way to treat a human being.

The very best part is the denial of harassment. Despite our documentation, caller-ID logs and lengthy series of audio tapes, every single caller pretends that no previous calls have been made that day. Conversations look a bit like this:

"This is the third time you've called me today!"
"How do you intend to pay?"
"You know I'm not working."
"How much will you pay today?"
"You've called me three times today."
"That's not possible. How would you like to pay?"
"I've got audio tapes and caller-ID logs, this is seriously the third time you've called me today."
"No it isn't, how would you like to pay?"
"I haven't found a job in the last three-hours. What do you expect from me?"

A discussion with a supposed supervisor affirmed that this calling pattern would continue "forever, or until the account is paid in full."

Real doubts come in to play about the allegedly existing balance. Do the math with me, since no written account has yet been provided. $22k with $5k down payment, and the car purchased below wholesale value. He paid four years on a six-year contract. Yet over $5,000 dollars remains after the repossessed car was sold... Suspicious accounting, don't you think? No wonder a settlement statement has yet to emerge.

Glossy News' attorney, having reviewed this story for liability and potential for libel claim, stated, "I can't believe anybody works like this in the modern era. If you really have [those tapes] and proof of these claims, they may be facing class-action liability again." He added, "I've seen allegations before, but never with tapes and other substantiation."

And oh honey, we got the tapes right here. Right next to the ridiculously detailed call log.

Whether you're an investor or a consumer, our victimized, defaulted debtor and Glossy News alike suggest you steer as many miles clear of GMAC as possible, whether motorist or pedestrian. They've got a history of illegal collection practices and it hasn't ended yet. Doubt it as you may, we've already audited our evidence, and it's all right here.

Got a call and number 866-654-6221 to call back and an extention - 4154 in which I'd be able to speak with "Rose," who has a conspicuously heavy Indian accent.  She did not inform me what it was regarding, but ....
I do know it is for a GMAC loan for a totalled car that I about died in.  GMAC alerted me (at work, which I'd asked them several times to not contact me there) that my account would be transferred to a collection agency in India.

had call come into cell # and ansewred wanting to speak to me, stated yeah, what can i help you with and wanting confirmation three times then i hung up on him...india(n) accent....no msg left previously and returned call waited for 5 mins before actual operator came on line....couldn't tell me at time who or what was it for.....

I just got a call from this number too. I also got a letter in the mail from Monster.com regarding their website getting hacked and someone getting all the contact info. Wonder if this is related. Like stated above, no message was left.
