IIRC, checks will no longer exist in the UK as of 2016. I'm surprised they're still in existence in the U.S. at this point. I can't recall the last time I wrote a check but it was probably years ago.

Who writes checks nowadays?  Ever try to write a check at a store?  They want your phone number, work phone, driver's license number, SSN, home address, practically your life story, while the people in line behind you grow impatient.  And if you send a check, someone could take down the numbers from the bottom, access your account and drain it dry.

Wow, you just show up out of the blue to comment on a post from three years ago (and call the OP names).  Obviously, you didn't read that post too well.  He was infact correct that what the caller was talking about would be a civil matter under ORC.  A "felony bad check" would have to exceed a certain amount and one would have to indicate clear criminal intent and file charges in a short order (i.e., John Doe closes a bank account and writes several thousand dollars of checks to several people).

Now, to demonstrate said intent, the "investigator" would surely have information about the checks in question (e.g., date, amount, payee).

None of these factors are present in the OP's comments.  You are a shill.  You troll around the Internet looking to call people names who post any information about the boiler room operation you work for.

I love to see sow many people are breaking the law by passing bad checks, and blaming the individuals that call them for their mistakes. You wouldnt be in this position if you didnt pass bad checks to begin with. Its tiring listening to the ranting of those that think they know the laws. Crosschecks is also not a third party. They actually covered the check that bounced to the company that it was written to and have every right to expect their funds back. Its unfortunate these hard working ma & pa companies that work so hard to build their business even have to pay a guarantee company to begin with because they know the checks will never be good!!! So filthy. And there are bad check laws in each and every state. Just because you cant be prosecuted criminally for a post date doesnt mean you can run around writing bad post dated checks and stealing merchandise because you think its a lesser offence. And you are welcome to contact your local courts or DA office. They will tell you FDCPA laws dont apply to a bad check (for those of you that know it all) and its not considered a debt. Its illegal. Therefore a check that is not a debt, does not fall under fair DEBT collection laws. You should all be ashamed of yourselves. ALL of you deserve to be placed into check systems. None of you should have a checking account that you feel you have the right to abuse. Its a privilege not a right.

The majority of states will not prosecute "post-dated checks" or checks that are "guaranteed" by a third-party such as CrossCheck. Post dated checks are considered an extension of credit and are not an offense that can be prosecuted. A post-dated check is written because somebody doesn't have funds in their account at that time and the creditor is aware of that situation. Accepting a post-dated check waives their right to prosecute. ALSO - when CrossCheck purchases the check it is now "sold" to a third-party - only the original creditor can seek prosecution - any purchaser of the check can seek CIVIL penalties but NOT criminal penalties. I've worked as a paralegal for a criminal attorney for over 10 years. CHECK YOUR STATE STATUTES! If all else fails, move to Texas - they can't garnish your primary source of employment or put a lien on your house.

My father who is retired and suffers from Lupus received a call from 716-675-0386 (which they blocked when they called his #)  They left a voice mail stating they were looking for me and said I had 48 hours to contact Attorney Chris someone, or several charges of fraud would be charged against me through our local district attorney's office.  My elderly father was so freaked out, he tried to phone me however kept calling the incorrect number and decided to come to my home and let me know and when he arrived he was very shaken.  I was instantly angry.  I am actually in the middle of working with someone to clean up my debt and she and i have been working together for about a year in a half now.  I looked up this phone number on the internet and was shocked to see these posts.  Happy but shocked.  When I called them back the next day - I had my father save the message.  I looked up the fair debt collection law for WI which states 427.104 Prohibited practices.  (1) (a)  Use or threaten force or violence to cause physical harm to the customer or the customer?s dependents or property; (b)  Threaten criminal prosecution;
(c)  Disclose or threaten to disclose information adversely affecting the customer?s reputation for credit worthiness with knowledge or reason to know that the information is false; (e)  Disclose or threaten to disclose to a person other than the customer or the customer?s spouse information affecting the customer?s reputation, whether or not for credit worthiness, with knowledge or reason to know that the other person does not have a legitimate business need for the information, but this paragraph does not prohibit the disclosure to another person of information permitted to be disclosed to that person by statute; (g)  Communicate with the customer or a person related to the customer with such frequency or at such unusual hours or in such a manner as can reasonably be expected to threaten or harass the
customer!  The woman referred to herself as Mrs. Wells.  When I yelled at her for calling my Fathers house she hung up on me, I repeatedly phoned her back and I did ask her why it was okay for her to bother my dad and harass him but it was not okay for me to do so back to her?  She hung up.  I kept calling and finally a man answered.  I asked him who he was, he said "Investigator Fontana" I asked him to spell his name for me and he refused.  He asked me why I needed his name spelled.  I said it is my right and I am taking notes on this conversation (I also reminded him, I was recording our phone call)  I recorded the phone call from my cell phone - Mr... oh sorry...Investigator Fontana stated I did not have any rights.  Investigator Fontana would not discuss Attorney Chris w/me either.  I kept asking him if Chris was an attorney, he just kept ignoring me.  I continued asking him if Chris was an attorney and he kept asking for my attorney's name, I just kept asking if Chris (the person they referred to in the voice mail as an attorney) was an attorney.  Investigator Fontana finally said, "No, he is not an attorney."  I told him that was all I wanted to know, I said goodbye and I hung up.  I have now on tape, falsely introduced Chris as an attorney when he/she is NOT an attorney, on a 3rd party voice mail they threatened criminal prosecution & falsely stated they would contact the District Attorney's office.  I called the DA's office and they have a program that deals with "bad checks" and the DA's office does NOT handle those issues.  

I too will wait for my time in court and will have all the information and data prepared when we do go.  DO NOT TOLERATE THEIR RUDE AND CRUEL TACTICS TOWARDS YOU OR YOUR FAMILY MEMBERS. I know I did nothing wrong accept one thing:  let them get me so upset.

FYI: Fair Debt Collection Laws do not apply to bad checks. It actually is a felony to write a bad check.  Check with you local District Attorney's office to confirm this...you will find out that most counties have a program to recover bad checks.  I am retired from the DA's office, which is how I know this.  They will give you all the information you need to know.

This company represents themself as "Cross-Check Incorporated", however You can contact cross-check and they will look up your information and more than likely not have any of your information on file. This is what happend to me anyhow. I was receiving calls from this number and the woman said she was with the check fraud department of cross-check, in actuality after extensive research this is a company called Empire Check Services, they are based out of New York. From what I understand is that they purchase old debts for a fraction of the cost in attempt to collect them.......I confronted the caller with this information about cross check telling me that they are not affiliated with this empire company and the woman replied "...umm...umm.. they are our client" Ok so let me get this straight cross check is a client of empire check services, yet I was told they are not affiliated or connected with you in any way? "....umm umm yes they are our client"....The caller eventually hung up on me after I started asking too many questions. Needless to say I do not think I will be getting any more calls from these people, in fact I called them back several times only to be hung up on...LOL Turn the tables on them, educate yourself on your rights and let them know you will not be intimidated into paying something you do not owe!

I received a call yesterday advising me that I had 48 hours to take care of a "bad check" situation, or I would be charged with check fraud. I spoke with "Investigator Hall". She was very adament in demanding that I pay $500 or be charged with fraud, and have all present bank accounts put on freeze in attempt to collect this "debt". The weird thing is that she had information on a post-dated-check I had written in January of 2007. I ordered a stop-payment on the check for good reasons, so the check was not dishonored for insufficient funds. I do not intend to pay these people a dime. I assume that they are scavenger debt collectors that have purchased my so called "bad check" for a fraction of the amount it has been written, and are now attempting to collect the check in full through these illegal tactics.

I live in Indiana where there are fair debt collection laws, and I noticed in a short phone conversation this woman succeeded in breaking several of them.

The first thing she did was contact my mother and reveal my indebtness to my mother by telling her that I was going to be charged wth check fraud if I did not take care of this matter in 48 hiurs. The B**** even gave my mother the last four digits of my SS#. This is unacceptable, hell she did not even know if she was in fact speaking with my mother, and had no right to legally discuss my indebtness with anyone other than myself or my attorney. A debt collector is only to contact another person to verify or obtain location information only ONCE, which this woman called my mother several times in one day.

I could go on and on, but the bottom line is whether these people are a debt colelction agency or some type of con artists is irrelevant to me because I was disrespected and treated unfairly by their repeated contacts with my mother and rude assumptions of my situation. I WILL NOT PAY CROSS_
CHECK INCORPORATED! I will wait on that court date and be fully prepared to sue them for damages if they have the balls to mess with my current checking accounts!

This lady called advising she works for CrossCheck Inc, stating that she was calling referancing my wives involvement in a check fraud case. She couldnt provide any information about the check but wanted me to call an alleged "attorney" Chris Houston at 716-675-0386. "Chris" also had no information about the check, but wanted me to pay $500 to avoid felony charges for an alleged bounced check. As a police officer in Ohio, I quickly advised "Chris" that bouncing an "alleged" check in Ohio is not a criminal matter, its a civil matter.. "Chris" quickly became aggitated and began threatining me with charges. People...DO NOT PAY THES PEOPLE ANYTHING...ITS A COLLECTION SCAM... they refuse to provide any information on the alleged check fraud and only threaten you with criminal charges. Check with your local authorities about your states laws regarding debts...and advise them of this scam. I also sent CrossCheck Inc and formal complaint, I encourage you to do the same
