Debt Collector
I am receiving Threatening phone call stating that i need to call immediately in order to avoid a costly trial.  When i call they say you have reached "INVESTIGATIONs"  I did speak to them one other time and they said it was for a pay day loan that i never paid on and closed an account.  I know i paid on it, and she said that is something i can bring up in trial.  It took me five minutes to get her to tell me what it was all about in the first place and when she said the pay day loan company i know that i never borrowed from them and asked who the original creditor and she said that was them.  I told her i was filing bankruptcy and she said it didn't matter becaue it was over the internet. I told her a couple of things i know to be true and she started screaming shut your mouth and i told her i was going to hang up and when she could talk to me appropriately to call me back.

Who's Calling? That Debt Collector Could Be a Fake

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

Debt Collector
I got a call from them today threatening me.  I told Samantha Evans that I looked the number up online and was conflicted with what I found and would like for the original lender to call me and validate the attempt to resolve the debt.  Samantha said that people like me get online and say bad things about the company and now she is mad and does not want my money.  Wants me to pay court costs and litigation fees including original debt.  Stated that she is investigating me over a cashland debt in 2009.  I filed a complaint with Federal Trade Commission and filed a complaint but she assures me that I will be served with court papers to pursue legal charges.  She said she is calling my husbands job etc and has called my previous employer.  She stated that she knows my bank account number, how much my house payment is, everything I own, how much my husband makes.  I have been extremely nervous and even more so now that she has refused to take any money from me to resolve the debt.

As others, I received a "scare phone call" today about me being investigated for fraudulent activity and also they will take action today with me if I don't call immediately.  I believe these people to be an overseas payday loan company.  They threatened to call my job, the police and any government agency. (whatever that means).
Very rude and left message ending with "you have been notified!".  I'm in chapter 13 bankruptcy so theres not much they can do to me.  I would like to know where I can report this number though.

These people are Scam artists. They will say they are attorneys with Brown Andrews and Scott, saying you owe them money and if you don't pay you will go to jail. Do as I did and please call federal trade commission and also your local attorney general state consumer. Don't pay them any money!!!! I called the bar association of New York and they aren't attorneys. They aren't even a collection agency. As I understand they are over seas and getting people like us to pay them for debts we think we owe. They will contact your family, you and your job. Know that these people can't do anything other then to harass you  but please put a fraud alert on your credit.
