Dont give them another dime!!! I got scammed to the tune of 498.86...could have kicked myself ..now I am getting calls saying I owe legal fees...for what I dont know they wont tell me..dont answer the calls let it go to voice mail and keep all the messages..then call a lawyer!

keep getting harrassment calls. I got phone calls from 3 different people alleging that they were going to file a civil complaint for a full balance owed, fines up to $1000 or 2 years in the county jail. Sent a cease & desist letter to stop the first two and another calls me. I'm reporting them to whomever that will listen. pieces of crap.

Please, if these people are bothering you and telling you lies to try to collect on a debt,  this is going against the Fair Debt Collection Act.  Go to the Federal Trade Commission's (FTC) website and file a complaint.  It is really easy and if enough complaints are filed this company will get huge fines for the way they operate.  You can also read the Fair Debt Collection Act at their website.

when and if u speak to a lawyer they are gonna tell you that the first mistake you made was giving them you account info and you never should have told them you were goin to cancel the check and close the account. you should have just went ahead and closed eveything before the could hit you account its going to be hard to prove anything because you volunterialy gave them your bankin info. they've been sued numerous times in federal court and there arr links of the cases on the internet

this has nothing to do with a legitimate debt - Its obviuous based on the messages left and refusal to send any debt validation.

This is not a case of running from a debt - its about extortion attempts from YOU an illegal debt collector and your scamming buddies!

Same thing happened to me!!! Except after I cancelled my check and informed them that i had cancelled my check and was soon going to close that account the guy on the phone, Jack Malone, flipped out on me!!! He used fowl language and hung up on me. Then took an un authorized amount out of my bank account with out my permission. That wasnt even the amount we first discussed. I am seriously thinking about taking them to court! I ahev reported them several times already!

I did the same thing except I post dated the check for $700... I soon found out that they were a scam and I cancelled the check and called them to tell them that I cancelled my check and was going to soon close that account. They hung up on me several times and yelled at me... that following Monday I went to check my account balance and they took an UNAUTHORIZED $400 out of my account!!!! They are a scam!!! And they broke several laws

they called me and said the same exact thing, I went to my bank and asked if they had ever heard of these ppl, my bank accountant told me that he has never heard of these ppl and that the whole situation sounded like a scam. he advised me to close my account, these ppl ask for an account number, they have no proof that u sent a check meanin u cannot bpunce a check that was never sent. Call and ask them for verification of this bounced check and also check with ur bank, if nothing cimes back they don't hqve s***

I have received calls as well I am a single mother my husband is currently in iraq and I don't have any money to pay them. I need some advice I gave them bank info and I wasn't able to pay and they said I am goin to court for bouncin a check over state lines I don't have checks and for defrauding a financial institution can someone help I am freakin out.

I have received telephone calls frim this number identified on caller ID as Eastern Asset M.  A gentleman who has not identified himself by name, insists that I oww a debt that I know I DO NOT OWE.  He insists that I fax him documents to prove my claim.  I told hime to give me the address of this company and he refuses.  He insists that "this is the way it works, you WILL fax me those documents within 24 hours."  I hung up on him and he called back 2 more times. This company does not have my correct address according the address that he gave me where I was "supposed" to be living, having never lived at that address.  I told this man very politely that I was incarcerated in the prison system when this debt was incurred, and he could check that information the the State of Michigan web site.  He was very indignant, rude, and would not listen and insisted that "You fax those documents to me now, I don't care if you don't have a fax machine, go to the library."  I hung up on him and am in the process of filing complaints with the Michigan Attorney General and the Attorney Generals Office in the State of New York.

I had the same exact message on my phone today, as msrozzy.  They said they had my SSN#but didnt seem to know who I was.  My mother has gotten similar calls, but unlike her I have ignored them.  She got into some nasty phone conversations but so far has not paid, and there has not been any legal action against her at all.

I went bankrupt years ago and discharged all my debts except the federal students loans which I repay regularly, so I have no worries.  I have seen this scam on 60 minutes or dateline or one of those shows, its this protocol to a T.  Don't let them scare you into giving up your banking information.

I receive calls from these guys once or twice a month.  Always the same script. Always "the final attempt to contact you."  They threaten to take away my driver's license, etc.  I've never even lived in the county they say they are going to file paperwork in.  I just ignore them and I keep getting "final calls."  I figure if they ever do take me to court, I'll end up paying less than they are trying to make me.  I could be wrong, but I don't think any judge is going to make me pay $5000 for a five hear old $300 debt.

my mother recieved a call for me.. we do not even live together and they asked for me. stating they are from the lawoffice  of  john nicola 716 947-0230 and said i owe money from 11/2005 for 600.00 now 800.00 with fees. the funny thing is i did not fall for it because a month ago i got the same call from another scam..they said it was filed with my county
court, i told them to mail me documentation or email me he said he would email me. he had my SS# and and 5 hours later i still havenot goten anything... if any one knows more let me know.

I sleep like a baby....these people are listed as a collection agency, John Nicolias Attorney at Law office, an ethical collection business, a lingerie party company, adult bookstore among other businesses.  These people are big time scam artists - how do they sleep at night??
I don't really care.  All I know is what they're doing is illegal, immoral and just plain wrong to put it in layman's terms.  
Think I'll try and research Attorney John Nicolias and see if he's really a lawyer or just some made up person that these people use in an attempt to intimidate people over the phone.
Either way - I don't care who they are or what they say.  Until someone knocks on my door with a summons ie: 'you've been served' I'll let them call, leave threats and scare tactics.  I don't owe anyone anything.  Besides they didn't even use my name because they don't know who they're calling.  They hope I'll call back the 888# and give them some info.  They're fishing for anyone that will fall for this scam and hope the person that responds will have an outstanding debt with a company this company has bought a bad debt from.  The person that left a message for me was having trouble reading the script. the caller said,Hi my name is Gina,and I am calling from the law offices of John Nicolia and that a civil lawsuit has been filed against my SSN# and that I needed to call the attorney's office to settle this matter before it goes to court, she did not have my correct name and I doubt she has my SSN#, So i went on line to look up this attorney and found these other complaints so decided to add to the list, hope this helps somebody

My brothers father-in-law received a call from these people and the person did not even call us or send us anything.  We have never used his father-in-law as a reference on anything.  They threatened us with a lawsuit and when I called them back to call them out it they started insulting me calling me coward because I called from a private number and said that I was trash for not paying my bills.  I told them that I pay my bills and am trying to pay off any debt that I do owe.  My husband suffered a car wreck and has a rare nuerological condition and is no longer able to work.  We have four kids and I work from home as much as possible.  The things they said were hurtful and uncalled for.  One of the phrases included low-life white redneck trailer trash.  Does anyone know what I can do to report this and have them investigated?

Im just like the rest of you. I gave away my bank info and set up for payment. Then it dawned on me. I didnt receive any mail from them. They called me out of nowhere. They say I will go to court for something they cant me go to court. They got me on the phone to admit the debt. I was dealing with an extremly tough paper and this was the last thing I needed. Now Im in a mess. I dont know if they are legit or a scam. Also notice this. When you press *67 before dialing their number it goes straight to a voicemail saying leave your name and address. But when you dont it takes right to the company. Im afraid guys, I really am. I might F***** my self.

My Fiancé received a phone call from Eastern Asset Management on 2/24/09. On a Clout credit card I had back in 2005. They told him how much I owed, and what they would settle for. Also that if I did not pay this by 2/28/09, they would subpoena me at my place of residence or place of employment. So he in return requested the information they had be sent to me, and he was denied his request. The man then told him they would subpoena me at my place of residence or place of employment. So I gave them a call because I have been trying to pay this credit card off since 2006 and I hadn't been able to reach anybody. They told me that they have sent out 11 letters in the past 2 months, but this is the first time I have heard anything about this. When I requested the information they had be mailed to me, he then denied me, and instead sent me an email. But the whole time he was talking to me. He did not once mention his name.

And now I don't know what to do or how to go about this

I work now as a debt collector for a 3rd party agency (un-owned debt), and I have some aged debt attached to me from my now defunct marriage.  Ironically, they call me twice a day to the same number (violation), leave messages each time, and within each message are typically  at least one violation per message as per the FDCPA.

Each time they call, I see dollar signs on my cell phone caller ID.  I'll be cashing that in very shortly.

Simple violations by a firm such as this:
- any person other than the attorney that refers to the entire office as "my" is a violation.  It is misrepresentation of collectors identity used to intimidate.  It is a simple Freudian slip that has resulted in lawsuits all over the industry.
- calling any single number more than one time per calendar day is harassment.  They may only call more than once if you/someone else gives permission to call later on to reach you.  Any court will consider this to be as such.
- it is unlawful to give 30 days upon first contact or threaten legal action if the debtor has not received or been sent the initial letter that identifies the debt with the 30-day window to dispute the debt.
- in the transcribed message, the last sentence indicates that the debtor is to reference a case number in your county when calling in.  That, in and of itself is misrepresentation and intimidation, because previously in the message it indicates that they WILL be doing it.  The last sentence misleads that they already have.
- lastly, this is shaky ground, but if the message at all indicates a specific person (YOU), and the message doesn't begin with the disclosure (This message is for _____, if you are not _____, please hang up), then it becomes 3RD PARTY DISCLUSORE.

The lesson to be learned in all of this, is to take care of the debts before they go to collections, and when they do, pay guys like me (2nds, 3rds and 4ths) before the scum scrapers like this buy them up.

I recieved a call from this office..I paid $100.00 until i recieved my taxes. I recieved my taxes and called to make a settlement..when I offered to pay 50% of my debt in cash today to close the bill. "The Attorney" got on the phone and starting screaming at me...now Im pregnant with my 4th child and told him this and that I was trying to get this paid. He told me was taking me to court on Monday. They have also harrassed me at work. I am going to file a complaint against them...expecially if this man is really a lawyer, he is extremely unethical...the way he was yelling at me was terrible.

My wife got a call today from this guy about a 2002 credit card debt.  The charge off was somewhere around $375 dollars but they are saying they are taking us to court/sue for $3000 unless we pay it this month for $1445.  She panicked and gave them our bank card information so they can post date a withdraw for $354 on 1/31.
We want to take care of this debt, we have no intention of walking away from it, but I don't want to be raked over the coals by this leach...  By acknowledging the debt and giving our bank card info, we are now in the fight..  So how do we go about talking the settlement down?  Are there any other options for us?  We live in PA

Trust these guys cannot take you to court in that short of a time. First you will get a letter in the mail(If they do take you to court, which half the time its just a scare tactic). The letter will give you a court date, a chance to pay or to explain your side. If you dont show up to that hearing, then you get a letter from the Sheriff personally, then if you dont show up to that one, you can have a warrant out for your arrest. You cant go to jail if you dont show up for the first hearing, go to the second and you can arange a payment plan with the court appointed mediater.
