Okay here is the deal. They are only allowed to contact you between the hours of 8am and 9pm in your local time zone, they can do this on any day of the week.

However, if you do not want to have them contact you anymore you must send a certified letter to them stating that they are not to contact you. The only other letter you will get from them is stating that they will no longer contact you. This DOES NOT get you out of your debt, it just means they can no longer call you.

If they do call you after they have received the letter you can sue them for violation of the FDCPA(Fair Debt Collection Practices Act). You can sue them for $1,000 per violation, plus any damages because of that.

Also, you have to be sure about the your reporting limit. The 7 years starts from the last time you became delinquent, and would be reset if you had made a payment since then. There is also the Statute of Limitation, after this time they can no longer legally come after you for the debt. Depending on the type of debt and your state this is anywhere from 2-15 years. However, if this is a credit card debt that is usually around 3-5 years.

Below is a few links on the FDCPA and a sample letter to have them stop contacting you, and the chart of the Statute of limitations for all the states.

I keep getting phone calls from 718-351-2547, 718-351-0258, 718-979-3710 and all I keep hearing is someone breathing in the background.   These calls happen all hours of the night.  If this is a collection agency mabe somebody can find out who owns it and get the owners home phone # where we can all harrass his family through out the night.
