I know this is a scam because my brother is a lawyer and he told me that most of these scam collectors use the tactics like the ones that are posted here.  My call that i received was from a Indian who stated straight out I was being sued and that my name and social security # was attached to a case file in their office. I immediately hung up and blocked the #. This of course is only a temporary fix because 2 morrow or next week sometime they will call from another #. I am so sick and tired of these calls that I have got to the point that when a legitimate collector calls me i let it go to voice mail. when i do call back I always request a written copy of the paper work associated with the debt. if they refuse they don't get paid and I will submit removal paper work to all the credit bureaus. PLEASE PEOPLE IF YOU GET A CALL FROM THESE PEOPLE HANG UP. THEY CANT GARNISH YOUR WAGES WITHOUT A COURT ORDER FROM A REAL JUDGE AND THEY CANT TAKE ANY KIND A OF CRIMINAL LEGAL ACTIONS AGAINST YOU!!!!!!!!! THEY HAVE BASICALLY STOLEN YOUR INFORMATION AND THEY TRY AND USE SCARE TACTICS TO GET YOU TO PAY A DEBT YOU DO NOT OWE!!!!!  IF THEY SAY THEY ARE GOING TO SUE YOU CALL YOUR LOCAL COUNTY COURT HOUSE AND CHECK TO SEE IF THEY HAVE FILED A LAWSUIT ODDS ARE THEY HAVEN'T AND THAT TELLS YOU THEY ARE JUST FULL OF S@$%.  OK I'M DONE RANTING BUT I JUST WANTED TO LET PEOPLE KNOW THAT THESE SCAMS ARE GETTING OUT OF CONTROL AND THEY ARE MORE AND MORE FREQUENT. PLEASE PEOPLE ONCE AGAIN JUST DON'T ANSWER AND IF YOU DO HANG UP ON THEM DON'T GIVE THEM THE CHANCE TO SPEW THEIR GARBAGE TO YOU!!!!!! SAVE YOUR MONEY DON'T PAY THESE A-HOLES A DIME!!!!!!!!!

I got another phone call from (718) 407-6378, claiming to be William Jacobs calling from Smith Law Firm. They want me to call back ASAP or they will sue me and contact my payroll department to garnish my wages. I received phone calls from this same number, same person, and same thing back in May of 2013. I added myself to the National Do-Not call Registry and reported the call to the Federal Trade Commission. The calls stopped after that and when my husband called claiming to be my lawyer. They hung up on him when he claimed to be my attorney and was going to report them. But now, the calls are starting again. It's getting really annoying.

Same thing. I have contacted The Florida State Attorney Generals Office, The Pennsylvania State Attorney Generals office and the local police. I have never received any paperwork on this, have never heard of this company and I have no idea what they are talking about.
On my caller ID the number shows up as 718-407-6378 but they want me to call 561-235-7900.
Complete Scam.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

This sounds like extortion dressed as collection. Consumer debts in America, including payday loans, are a *CIVIL* matter, not criminal! The agents' horrid threats are empty and their conduct is illegal. As early as possible it's critical to determine if your collector is domestic or yet another South Asian faker. The former you can sue into submission; the latter tend to be out of reach. Try to get a true business name and share it with the readers. By federal law this name cannot be withheld.

My notes from October 2011 on payday loan and "hot check" collectors are found here ...

Well, you could try a slander angle, but you already have the FDCPA banning the extortionist behavior of South Asian thug collectors and their cousins in North America. The trouble is you can only privately sue what you can find within your own borders.

Same thing. Know this. Legit bill collectors can't say all of these things in a message. Slander laws among others see to it. Scam. And yes, use google voice! Get the "the number u have reached, has been disconnected" tone. :) Forward these call and even those annoying ex acquaintances... to this blocked list :)

Just had this ***hole call me for the second time this week, finally decided to leave a message. The voice on the other end in the message definitely sounded Indian, identifying himself as William Jacobs of the what sounded like Down and Smith Law firm. My phone showed the call originated in New York. He threatened to "sue me due to an account they received", and if I don't call back he "promises to give me legal trouble, such as suing me and garnishing my wages". Well Mr fake, if you decide to call me back I'll threaten you right back. I have gotten enough of these bull**** calls to know scams when I see them, and you stepped on my last nerve.

Received same call as others have with the same lame message. I didn't recognize the number so I didn't answer.  I'm glad I didn't.  I hope these people are caught and punished.  I am filing a complaint with the Attorney General's Office, FTC etc..
The caller has an indian accent says his name is William Jacobs of Down & Smith Law Firm (which obviously is an American name). He may have said Brown & Smith but accent sounded like Down & Smith. He called from 718-407-6378 and wanted me to return the call to 929-268-1973.  Beware of this SCAM!
