I also have been receiving threating phone calls from my cell and to my job from these people.  And the guy that call me wa Andrew Thomas.  Then he says...Good Luck and God be with you.  They keep telling me their something pending against my name and address.  And I need to get in touch with them or their lawyers.  How can we get together and get this stopped?

Over the past two months, I have been harassed continually from a supposed Attorynee's Office.  They use different names and tell me that I owe money to a PayDay Loan Company that I have never heard of and call me sometimes four-five times a day!   Always the same MO.  Different names, but each call has a East Indian Accent.  They call me at home.  They continue to call me a work.  They use various Company names, the one this week is The American Legal Services, Inc.  

The end result is that I am an Intera-State Felon and they are going to send the local Law Inforcement to arrest me.  Unless I give them access to my Checking Account Number's or my Debit Card Numbers!

If not, they will have me arrested at my work-place and taken out of my office in handcuffs!!!!!!!!!!!!

I received a call from 718-873-9114 also with the same MO.   I have been getting calls like this for the last 6 months.  They are always a East Indian accent and always with "American" names.  This time is was
Ken Martin. I get the calls on my cell and at work.    I am going to file a complaint with the attorney general in MO.  I am not sure what else to do?

On 08/20/10, I received a phone call on my cell phone # from this phone number; they left a message to call this phone #1-360-742-1886.  The person had a foreign accent.  The first phone number I searched online and found out that it was a land line in New York City, NY-unpublished and unavailable; the phone number that they told me to call back on was a cell phone # in Olympia, WA.  I did not return the call, but I have started to document all calls that I receive from unknown phone numbers.

I received a call from this number, it was a very bad Indian accent with very bad english. He was threatening me that I owe money to some sort of payday loan company.. and that I am going to be in court if I don't pay that law firm, or they will arrest me and send me to jail. I don't have any loan. He asked me to pay him $392 now, and give him my debit/credit account numbers in order for them to cancel the court something. This freaking stinky guy had all my personal info and his name is Michael Anderson, try to scare me with that name though I know he is indian! After all the investigations, I called them back and asked if its a scam ( just felt like trippin').. and so they guy who picked up the phone said :F%$@! off with his cute little accent that sounded like FRUGSH ORF! lol beware guys!!!

got a call today from 718-873-9114 from a guy named steve said he was from all american services stating that a company is seeking legal action against me for a loan that i am not repaying. Called them back and asked what kind of loan and he stated it was for a payday cash loan, I told him i never took out a loan and he said well good luck. Stunned and confused i called back and used reverse psychology and told him my lawyer will be contacting him and told him this is a scam and that i would report this number and company, he got irate and told me to shove a c**k in my mouth and shut the f**k up and hung up on me. I continued to call back and told him that he was trying to scam the wrongest person--he hung up again.  So i called back and this time he said nothing and covered the phone so i said "so how does it feel to be harrassed" and hung up. i will be looking into this and reporting it to my local authorities and I hope you all do the same so we can stop this scam before someone really falls for it.

keep pursuing. I am trying to report this number to my local authorities. I have wrote to new york newspapers just because the area code 718 says its new york letting them know or if they could publish something. I am currently getting information on how to report them to the FBI because of the fraudulent claims they make and who knows who fell for it and paid them.....

2-5 calls a day from this number on my cell.  Answered 3 times and they asked for the person who used to have my number.  I requested removal of the number but they keep calling.  Finally reported them to FCC and Do not call registry today.  2 weeks of this is enough.

I recieved a call from someone claiming that he works for All American Services. He told me 3 differant names when I asked for his name. He could not get his story straght. Saying he would be seeing me in court. Over a so called payday loan. He hung up on me twice. Then I called back one more time. He answered again. This time hewas another individual saying his name was Eric Burns. I asked for his company address and he refused to give it to me, he said he was calling from New York. He was a India or Pakistan accent. Do not give them any info.

For at least the last four years, possibly longer, a group has been calling former payday loan applicants advising them that they have defrauded a bank and are now being sued for non-payment of a loan.  The callers will claim to be calling on behalf of an attorney's office (name varies), the Dept. of Law and Investigation, ACS, or other similar combinations below:

U.S. National Bank
Attorney General?s Office (usually in California)
American Legal Services
Affidavit Consolidation Services (ACS)

You will be threatened with arrest, a costly trial and possibly worse.  In no shape, way or form can you be arrested for non-payment on a consumer debt.  Do not believe these threats, as they are without merit and cannot be carried out in the manner they allege.  

Who are they?

In the past when pressed by law enforcement for an address, the callers have provided the following information:

They have been previously fined over $1.3 million for various violations.  They have been known to use phone banks in India to make their calls, which more or less coincides with the difficult to understand accent many of us detect when we are contacted.

On July 15th, 2010 a Public Awareness Bulletin was sent out by Missouri Information Analysis Center.  

"..received reports from individuals in Ohio and Illinois reference suspicious telephone calls they received. In both instances, the callers are reporting that a voicemail is received from a man, with a Middle Eastern accent, identifying himself as an officer working with the Financial Crimes Unit.  The message indicates that the reason for the call concerns a loan made by the receiver or someone in the receiver's family. The voicemail requests that a return call be made and a telephone number is provided. When a return call is made, the caller is asked to provide personal identifying information such as their date of birth and social security number.

Reports indicate that the calls are frequent and persistent and that they even threaten arrest or legal action if information or money is not provided. It appears that the individuals making these calls may have access to some records connecting individuals and their relatives.  Missouri does not have a Financial Crimes Unit and all indications are that this is a fictitious agency. If you receive a similar phone call, please be advised that it is a scam and please contact your local law enforcement agency or the Missouri Information Analysis Center at 866-362-6422."

Bottom line:

Do not supply the callers with any additional information.  Inform them you have reported them to law enforcement and hang up.  If you haven't already, go ahead and report the calls to local law enforcement, your state's Attorney General and beyond.  Look up the local Secret Service branch's information in your area and get in contact with an agent there.  

If you ever applied for a cash advance online, your information is out there.  
Possible sources for the breach of your privacy are:

* The scammers obtained your information from Teletrack - a reporting agency used by many cash advance lenders to determine their risk lending to you.  The service is able to tell cash advance lenders if you have existing loans with other companies, for example.  Many state laws prohibit borrowers from having more than two cash advances out at the same time.

* The scammers created their own fake payday loan application site.  People looking for a cash advance went to the site and applied, thus freely providing the scammers with their information for malicious use at a later time.  

* The scammers were able to get into the database(s) of cash advance lenders - probable targets being Sonic Payday and Cashnet USA.  


How to protect yourself:

* Inform your employer.  You are likely getting calls at home and/or at work, so make sure your employer is aware the calls are part of a scam and to not take them seriously.  Advise the callers that they are no longer allowed to call you at work.  If they continue to call, document the date and time of the calls you received.  Save voice mails left if at all possible.  

* Change your number(s).  For some this may not be an option, for others a one-time number change can be done free of charge.

Be advised - any references you listed on your payday loan application will be contacted.  Let those people know that this is a scam, and they can disregard.

* Use Google Voice.  Google Voice is a great replacement voice mail system for just about any phone number you use.  Messages can be transcribed and voice mail recordings can be saved as mp3 files.  

Pro Tip - call the scammers with a Google Voice number before turning off your old phone numbers.  Make sure when you call you identify yourself so they can start up their script.  At any point after they have your information pulled up just hang up.  They will then start religiously calling your Google Voice number.  At this point, you are free to change your regular phone number(s) and enjoy not having these people ever call you again.  (And laugh at the fact these people are basically talking to a brick wall several times a day)

The scammers change their numbers frequently.  Law enforcement used to think it was because the callers ran out of minutes on their prepaid wireless accounts or they were shuttered due to fraud, but now they understand it's simply to evade detection by savvy consumers online.  With the proliferation of VoIP, it's even easier for the crooks to stay a couple of steps ahead of law enforcement.  Below is just a sampling of the 30+ numbers that have been used in recent memory.

So can they really do anything to you?

It's not a simple yes or no answer.  Logic dictates that, if they really wanted to take you for a ride and drain your bank accounts, they already would have.  

So, why haven't they?  

Authorization.  

Why do you think you are being called so much?  Perhaps it is because they like the sound of your voice?  No, they have to have your authorization to take any form of payment from you, period.  The callers know their audience, and that audience is typically a bunch of people that have applied for payday loans in the past.  Most of those people they call couldn't afford an attorney if they wanted one, and are so used to receiving collections calls that so long as they sound like a real collector, they will likely be perceived as one.

Furthermore, they don't even really want to talk to your attorney - that just sounds official and scary enough.  A real attorney would take the callers to task and write them off as two-bit con artists.  The callers need you, in writing, to authorize payment against the fictitious debt they claim you owe.  Go ahead, ask them for proof you owe the debt - more commonly known as verification of debt.  See what they say.  A phone authorization carries very little weight, so if they have something signed by you on file, you are done for - and the callers know that.  That authorization is the only thing these callers are doing by the book, and for good reason.  If they just went all willy nilly and made an ACH debit from your checking account, without your written approval, you could in turn report the transaction as fraudulent to your financial institution.  In about 7-10 business days, you would get the funds returned to your account.  Then the scammers would be up against a bank and their team of lawyers and investigators.  

Bottom line:

If you haven't paid the callers a dime, don't.  If you planned on paying them to shut them up, just don't.  Remember - you are not being contacted by a legally licensed, ethically owned and operated collector.  Read up on the FDCPA - http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf - and know your rights.

This is so very crazy.  They call 15-20 times in a row never leaving a message on my cell p hone.  Then they call me at work and leave message.  Thanks so I have time/date stamp on it.  However, the FBI says there is nothing you can do.  Just report, report, report.  

"Yes - this is a scam I have been dealing with these crackpots for months now. Every time I think I am rid of them they begin to call back using different names and numbers - but always the same silly story - "call me back the minute you get this message - or may god help you as the situation unfolds around you"  Be prepared - they will probably keep calling you - keep posting the numbers and names they use on this and other sites to keep people informed. Sometimes they put up fake posts on this site to make themselves look legitimate - however since they don't write english any better than they speak it you can spot these posts fairly easily.  Good luck!!"

They also called my brother and sister stating  I need to pay them.  They just laugh and call me tell me my "friends" have called again.  

Big Joke between the family.  Be aware and let everyone know family, friends, co-workers, local police, state police, report them everytime they call.  It is a hassle but maybe they will eventually stop?  Who knows.

I called the number back Monday and they answer, "How may I help you?".  What business answers the phone like that?  None!

They have been calling me like previous posters claim from different numbers since July 2010.  It is very ridiculous.  I have answered many times, speaking with Peter Parker, Ned Brown, and the list goes on and on.  They claim I have a payday loan that is past due and needs paid.  They want to settle.  I tell them I have reported them to the state police, FBI, Attorney General and placed fraud reports to the credit bureau.  They just talk over me and ignore my requests to quit calling.  They call 5-6 times in a row.  Call my place of employment and thank goodness my boss understands.  I dont understand what they think they will accomplish by calling so much when I know they are scammers and I will not be giving them money EVER!!!!

It would seem we could do something to stop them.  Back in July when the state police came out to take a report he called a number related to this one and stated there is nothing we can do.  So hard to believe there are no laws to protect us the citizens of the united states from these scammers who obviously are getting money from someone or they wouldnt keep calling people.  

Keep your personal information personal.  Never confirm any information they provide you.

they need to be stopped! i got a message from work and this guys says his name is neil brown stated that i am being sued for not paying a payday loan, and this is the second time i got a call like this but it was a different name and phone number..and he is threatening me of having me arrested and they have all my personal information and was trying to get me to settle a certain amount with my credit/debit card..and i'm thinking to myself that i havent even recieve any call from any payday loan that i owe such amount..so the guy told me to pay the amount and he will be sending me a proof that i owe money..but i refused to give any information to him so he got really upset and said that someone is going to get me and he hunged up..so now i'm getting these stupid calls again its frustrating.

I've been getting calls from the people for months, but the number changes about every month. The guy on the other end is always the same, but his name changes. They are crooks. I pick up and harrass them back every time they call. He is a good person to take your frustration out on. Nothing he tells you is true. Screw them..... scare him, he's trash... treat him like it.

Same deal. Idiots leaving ridiculous messages. Funny part is that they're calling me by the wrong name in the voice mails.

Truth is a) if you were being sued you would receive a notice in the postal mail; b) you can't file suit against a social security number; c) a debt collector could NEVER threaten you the way these people do. There are very strict legal guidelines in terms of how a debt is collected. These guys break every rule in the book (not to mention the debt they are collecting never existed in the first place).

I know it's upsetting to get voice mails like this, but these people are scam artists and crooks. Delete the message and eventually they'll stop calling.
