Tracy- you are full of something & its not good intentions! First of all you gave an incorrect web address for the Colorado Supreme Court, secondly Brad Daybell is an attorney in the State of Colorado but he isn't in anyway associated with Peachtree, I just spoke with his office. I'm pretty sure he isn't going to be too happy to get my message that people are fraudently using his name to try to collect debt. I had your company call me seeking someone else & they were rude & accusatory, not at all professional. Get a real job.

Received call on my home phone. Message said to call "Alfredo at Peachtree Legal Services" and gave a file number and return number of 888-497-4954. The 888 number goes to an all Spanish recording---and hitting 0 gets you a very confused "Que?" guy on the other end.

How to deal with collection calls:

1.) If you receive a call from a collection agency, DO NOT admit to owing the debt over the phone, as far as you are concerned it's only a voice over the phone and should be treated as such until you are certain (documentation) they are legitimate and following the law!

2.) You are protected by the FDCPA (Fair Debt Collection Practices Act), these laws are designed to protect you from scams, therefore you should exercise your rights.

3.) Ask the voice on the phone; their name, the full name of the business (ask them to spell it), their address, and a direct telephone where THEY can be reached, next, proceed below.

4.) Tell the alleged debt collector they have 5 days to send you a dunning letter (also known as a letter of collection)
through the mail, tell them you are counting the days and keeping a record of all communication to make sure they are complying with the federal law (FDCPA).

5.) If the debt collector refuses to give you any information that is a BIG RED FLAG. Do not give them any of your personal information, do not admit to owing any debt, and do not discuss anything over the phone.
File a complaint immediately with your state attorney general and the FTC.

6.) If and when you receive a letter of collection, you will send them a debt validation letter, certified, return receipt requested, it is extremely important that you send the debt validation request certified. You can obtain sample debt validation letters in the DIY section of this forum.

7.) It is VERY important that you respond and dispute a letter of collection within the 30 days of receipt, don't take any chances, send the debt validation letter immediately, make sure you date it and keep a copy. Again, keep a record of all communication a collection agency attempts to make with you.

8.) Educate yourself on the FDCPA.


This is a sample debt validation request letter for a collection agency of illegal online payday lenders. This letter should be sent after you receive a dunning letter (letter of collection) in the mail. Anytime you receive a telephone call demanding payment for a payday lender (3rd party collector) you should tell them you will not discuss this matter to a voice on the phone, instead, tell them to send you a letter of collection through the mail within five days of their first initial contact, or you will file complaints against them with the FTC for non compliance of the FDCPA laws.

There's your answer. There was no "letter" to begin with...and they KNOW it. They have stopped calling because they know that you have PROOF in your hands you requested validation of the debt, they failed to honor your request and will be in violation of the FDCPA if they continue to dun you on an unvalidated debt. No validation, no debt. It's that simple.  

Hang ON to all your paperwork. It will be essential, should they decide to take you to court anyway or sell the debt to another JDB who may come after you. You will have proof the debt was never validated.

Received call on cell 2/14/11 3:54pm caller informed me he is looking for RL, I informed him he is my exbrother in law and I have no contact with him.  I have no idea where he is and have been divorced from his brother for 15 years.  He said he entered RL?s ss into a database and my name and number popped up as a family member

Minutes later Caller called my boyfriends work place, which I have never been an employee of

About 30 minutes later caller called my home phone I again told him, this was the third call he was making to me after I explained the first call that I have no connection with RL.  I asked him to stop calling and harassing me.  He said he needed to remove his law firm from any liability in informing RL of his situation.  I repeatedly told him I could not assist him and to stop calling.

a mr. gilbert called me looking for my brother and said he had a message for him  when i asked what the message was he said he could not discuss it with me   so i eventually called them back to find out what kind of place they were and they wouldnt answer that  so i talked to the manager and he said i was making more out of it then what it was   i told him that first he could GO **** HIMSELF and dont ever call my cell looking for my brother and then not give any info.........then i googled them and found all this negative stuff    they are a scammer possing as a laywers office  just say you are a collection agency   idiots

Some person called today and said they had an "urgent message" from "Salteen Howard"?  (or whatever the hell they were attempting to say)

Told them to GFY and hung up.  

This type of nonsense started happening once we allowed our phone number to be listed again.  (just first initial and last name)  Lots of debt collectors phishing for stuff now.

Hi there. When I received the receipt it didn't have a printed name nor a date but when I was tracking it on USPS.com, it gave a delivery date on Jan 24. It also gave a time stamp on when it was delivered. To this day, I have not received any phone calls nor did I ever receive that letter I was requesting.

They called me about a month ago and the man's name was "Mr. Gilchrist".  I got my lawyer on the phone with him and she asked him to send a letter regarding the debt in writing.  He said he did not have to, so she asked him to fax it on their letterhead.  He said that their fax machine was not working and he was going to go tell the lawyer that I wouldn't comply.  My lawyer then asked to speak to the lawyer herself and "Mr. Gilchrist" hung up on us.  Then he called me today and I reminded him that he spoke to my lawyer and I a month ago and we asked him to send a letter regarding the debt so that we could verify the debt.  He stated that he never spoke to my lawyer and I.  This time I hung up.  This is a scam and anybody on here is saying that they are legitimate is probably connected with them. Be aware of this one!

Hi Alfalfa,

Yes I did send them the letter (certified) of course. I tracked every minute of it on USPS.com and I printed everything regarding it. The certification came back with a name that was unreadable and it did not have a Printed name on the return. I sent it on 1/22/2010 and I have not heard anything from anyone about it since. They even tried calling me on 1/24/10 at around 11am and left me a message stating that he was ready to give my file to the attorney and said "it is what it is." They received the letter at 2pm that afternoon. So I'm just waiting to see what happens next.  Thanks Alfalfa for all your help!

Hi Jessica. It's funny coz when I asked Peachtree Law Center to send me a copy of the original letter they supposedly sent to me to my old address, they said they couldn't do that because it costs their firm money to send it out. I don't know what number they called from coz they called my brother but the number they gave him to give me was 800-668-6163.

They are in clear violation of the CFDCPA by refusing to validate the debt.

Collection Agencies
Under the Colorado Fair Debt Collection Practices Act (CFDCPA), all collection agencies and debt collectors who work for collection agencies must obey the following procedures. Only creditors who collect their own debt are exempt.

First Notice - within 5 days of being contacted by an agency, you must be sent a written notice stating the amount of money due and the name of the creditor.

Disputing the debt - within 30 days of first notice you may dispute the claim in writing. The collection agency must then stop all collection efforts until it gives you proof of the debt (validation) - in the form of a contract, invoice, bill or a court judgment. You must also be notified of the original creditor's name, if different from the person who referred your debt to the collection agency. During that time the collection agency has the right to sue you.

In writing, you may tell the collection agency not to call you at work or at home. You may also refuse to pay the debt or demand the collection agency stop contacting you all together. If you make this demand, the collection agency must then stop trying to collect the debt from you.

You may not be contacted by a collection agency if an attorney is representing you in a case related to the debt. You should provide information on how to contact your attorney. However, the collection agency may send you one final notice stating whether it will stop trying to collect the debt or has plans to sue you. If you are sued, you have the right to argue your case in court.

In writing, you may also ask the collection agency for a copy of your payment history. You are entitled to one free copy per year. A $5.00 fee may be charged for any subsequent copies you order.

The CFDCPA does NOT prevent a debt collector from, the following:

-refusing to take a partial payment

-suing you at any time unless you have a payment agreement and are complying with the terms

-adding interest to the debt if permitted by law or contract

-adding information about the debt to your credit report. However, if you dispute the debt, that must be reported as disputed.

Under the CFDCPA laws a debt collector may not
contact you by postcard or use an envelope that shows the sender is a debt collection agency, or that the piece of mail concerns a debt.

A debt collector may not call you before 8:00 a.m. or after 9:00 p.m. your time. Notify the collector in writing if you find these times inconvenient, but you must state when they may call.

A debt collector may not discuss the debt with those who do not owe it without your consent or by a court order. The debt collector cannot identify themselves as a collector or state they are affiliated with a collection agency unless specifically asked. This means your neighbors and relatives may only be contacted to obtain your address and phone number, but a spouse or co-signor who is also responsible for the debt may be called.

Further, is it unlawful for a debt collector to misrepresent things like amounts owed, any statements, documents or actions against you, or to misrepresent your case when reporting credit. You are protected from being threatened with illegal actions, arrest or committing a crime, and they may not threaten to take or sell your property, garnish your wages, or attach bank accounts unless that action is legal and the collector intends to do it. They cannot deposit a post-dated check before the date on the check, and if the check is post-dated more than 5 days, the collector must inform you in writing no less than 3 days or more than 10 days before the date the check will be deposited. You are free to decide if you want write a post-dated check in the first place.

Be sure to get all agreements with the collection agency signed and in writing. Keep copies of all correspondence, and keep records of all dates and times you are contacted by the collection agency. Get a receipt for all payments, and answer any legal summons and appear at all court hearing. The Collection Agency Board cannot stop court action.

To file a complaint with the Collection Agency Board, go to www.ago.state.co.us/index.cfm and get a copy of the Collection Agency Board complaint form. Complaints cannot be accepted without a signature so fill it out, sign and either mail or fax to them. If you have received a letter from a collection agency, include a copy of the letter.

Received a call at my work. If this is in deed a law firm- then they are aware that any debt collection must be done in writing. When I asked them to send me something in writing, the lady refused and said they didn't have to. I told her to take me to court and sue me then. I am unaware of ever doing business with the company they were referring to. No I wouldn't send them a dime. Colorado law (which is 720 area code)clearly states that all collection efforts ESPECIALLY from law firms threatening legal action, or say they've been retained by another company MUST notify you in writing within 10 days. This sounds like one of those places busted by 20/20 a couple years ago for illegal collection practices.

I recieved a call from this company//// and i am familiar with them its Peachtree law center.... they were handling an account with Visa for me a couple of months ago and now i am getting called now about a payday loan that i got last year..... i had no idea tht it was delinquent but i trust this company enough to pay off both accounts immediately.... i looked the attorney brad daybell at www.coloradosupremecourt,gov it gave me the confidence to knw this company is legitimate.... the woman i typically deal with is Terynn she was the one that settled my account out earlier this year and she is very professional, if you have any business with Peachtree, just handle it.
