Received call 02/11/2009 from 757-484-3309 regarding pending matter to be processed at Lexington County regarding my ex-husband. I have been divorced from my ex-husband for 18 years.   The caller ID showed this number to be from Norfolk, VA; This is the first time they have called my house and I do not intend to return their call.

Received call 04/02/2009 from 757-484-3309 regarding pending matter to be processed at Greenville County. She identified herself as "Jordan" (giving no last name) and said that I would want to call back before this matter went any further.  I do not have anything outstanding; nor would I have any reason for someone like this to be calling me.  They called me at work!  The caller ID showed this number to be from Norfolk, VA; This is the first time they have called and I do not intend to return their call.

Has called me at work and states I have a pending legal issue that is about to get filed against even after I told her Lowesha (sp) that I have no pending issues she starts yelling at me so I hung up then she calls back and leaves a message with the receptionist. Who Seeks a Career as a Debt Collector?

In a industry where deception, craftiness, and deceit are rampant, you might imagine most honest people would seek work elsewhere.  And you're right. My experience says the average debt collector is male, has a large ego, bounces from job to job, suffers low self-esteem and enjoys using the telephone as an instrument of empowerment. You shouldn't be surprised to find most of them have great debt problems themselves.

The debt collection business is plagued with high employee turnover. Constant training of new collectors puts great strain on the agencies and the employees.  Every moment someone is in training is time lost on the phone.  You can imagine the shortcuts that are taken to get a new caller on the floor as soon as possible.

Collectors see themselves in a position to take advantage of those they deem weaker, in an effort to overcome their own insecurities. They normally will talk-over any issues you may have, threaten and intimidate you, lie, misrepresent themselves, abuse, annoy and attempt to push you as far as they can. After all, a portion of what they collect from you becomes theirs.  Unfortunately, far too few consumers complain about debt collectors overstepping their bounds,  because they are intimidated or embarrassed about their dilemma.  Over the years I've dealt with literally thousands of collectors and suggest that only 2 out of 10 are honest and hard working. The greater percentage are deadbeat scum either just out of, or heading back into a jail cell.  Collecting is a male dominated business and because of the shortage of skilled workers, agencies are hiring anyone who can walk and chew gum to make their calls. Social skills, education and career orientation are NOT normally the prerequisites for a debt collector ? money beggar position.

What Techniques Do They Employ?

You'll hear standard phrases such as: "what is your intent" or "I'm going to recommend that our client take immediate legal action against you." The innocent unsuspecting consumer feels threatened, even terrorized by the antics of unscrupulous debt collectors. The really bad ones will call you at work, violate third party disclosure, or worse, threaten you with arrest or wage garnishment if they don't have the money today! They'll try to persuade you to pay off old debts using your new credit card, via Western Union wire transfers, bank drafting, debit checks and cash.  They will tell you your credit report will be clean if you just send them the $ MONEY$.

The National Consumer Law Center (NCLC) and the National Association of Consumer Advocates, (NACA) assist attorneys across the country in pursuing agencies and collectors who violate the law and your rights. Collectors are learning that the phone name they use and the perceived anonymity of hiding behind a telephone can easily be overcome with today's modern technology and investigative techniques. Some collectors are learning first-hand that they too, can be charged with making threats over the phone and that their employers don't provide bail money or legal representation. Creditors are increasingly becoming less tolerant of agencies that allow abuse and will drop those that don't comply.

I urge you to complain about collector abuse by contacting the FTC, the American Collectors Association, the original creditor and your state bar association (against attorneys), or me if you feel your rights are being violated. There is a nationwide group of professional consumer attorneys, skilled in debt collection laws that passionately defend the rights of consumers against these illegal collectors. No consumer should ever suffer abuse from a debt collector.

For the bottom feeders at AFS, this is a numbers game. They pay about three cents on the dollar to purchase old debt. They know when collection is unenforceable, but they also know that a certain percentage of debtors (really, former debtors) will not call their bluff and make payments. This percentage is what keeps them profitable.

The main b1tche's name that works there is Amber. Now I've seen a post from an Amber Night on here, but who knows if she is the one who answers the phones. I've aked this miserable cunnt numerous times to speak with the inhouse lawyer. She has claimed in past conversations that one is sitting "10 feet from me". For what ever reason they will not provide a name or number for their counsel. Before you work with them and give them any money, I would definitely find who, if any, legal representation is being retained by them and do so through the court process. I would also check to see if your state allows you to record phone calls. I use a dedicated cyber line which falls outside of most statutes pertaining to this.  I have captured conversations with them in which they broke fair debt collecting laws because they shot their mouths off in an attempt to scare me into paying them. These people are amatures and worst imposters, so don't take them seriously.

If your name really is Amber, don't you think that you are conducting yourself in a less than impressive professional manner? The majority of the people here came here after they had this misfortune of actually talking to someone like you on the phone. I for one am more angry in which they way your company has conducted themselves on the phone than the fact they you are collecting a debt. Because the employess for AFS have illustrated themselves as being extremely rude and condescending, your reputation is suffering and is driving away potential profits.

Because most of us are so shocked and insulted by the way in which you conduct yourselves you can see why there is so much unresponsivness to your business model. I know you think it works, but really try getting your MBA instead of thinking you are in law school. It is really, really bad for business and would probably keep you employed until you finish your GED.

There have been many calls from this company to former fiance parents who I have not been around since 1987, my grandfather, my mother and my house on top of that. They have said to these people that if I do not call them immediately there were going to report me to county, whatever that means, or report me to the authorities as though I committed a crime. This has place great stress and worry on family members who love assuming that I am in trouble with the law, which is totally untrue.

Received a call from this company today; they left a message regarding an ex husband of mine that I haven't seen or heard from since 1988.  1988!!!  The problem that I have is that they have my current married name and contact information - no WAY should any of this be "attached" to the six month marriage I had to an idiot when I was 19 years old.  And they demanded that "I have him call immediately"... WTF???? I haven't seen him in 20 years?  Buncha morons.

Thanks for all for this information on this collection agency re: the 757-484-3309 number "Ashley" leaving the same script message of case and county processing, etc. on a relative (not your business) and the ways they try to work information and bully payments as agencies are known for, never called them back googled this number first and got all your information posted on this number, thanks for sharing the ways to try to prevent these phone calls. Now I know this message was totally a waste of their time!
