I'd suggest you check the law, sir. There is absolutely a time limit on debt. That's the whole point of a statute of limitations. If that's run out, and the creditor didn't get a judgment, the debt is uncollectible. If there's a judgment against the consumer, that is collectible but even then there's a point where judgments expire.
"Debt collectors must be resolved before anyone can receive your estate, even your worn out shoes." Debt collectors? Thanks for unmasking yourself. And "worn out shoes" - what contempt.

>>> The statute of time limit on a debt is only for time to file a law suit. There is no time limit when the debt is no longer collectible. Even your death does bot stop collection if you owned anything of value. Debt collectors must be resolved before anyone can receive your estate, even your worn out shoes. <<<
Baloney. But you do win the prize for being one of the more creative shills this month. Whether or not your state goes into probate, most, if not all states have laws setting time limits beyond which a court will approve the closing of an estate. And the executor, executrix, or administrator of the estate can challenge claims from creditors -- in fact, they may have to do so, as fiduciaries to the estate. And what do you think they are going to do if a debt is beyond the statute of limitations? Can you say, "reject it?" I knew you could.
Moreover, the order you cite for the distribution of the estate is deceptively incorrect, too. The usual rule in almost every state is that an allowance comes right off the top for spouses and children. Then, costs and expenses for administering the estate are paid, followed by funeral expenses. Only then comes payment for debts and taxes, followed by any other claims.
So there goes your old shoe fetish, I would think. But don't worry. I have a pair of smelly, worn-out old sneakers I can let you borrow, if you are willing to pay in advance for each whiff.
Of course, the laws regarding probate and wills are slightly different in each of the 50 states and in the District of Columbia, so you will have to consult an attorney in the state of legal residence of the decedent at his or her death. But you may want to enjoy the following light reading before you do:

just to provide a source of information from a few states selected at random.

Portfolio Recovery. These p**cks have been calling me for years and I am not in debt to them or anyone else. They use many different phone numbers and have filled up my phone's reject list twice.

This same company has several different numbers from which they call. After the iOS7 update on my iPhone, Apple gave us a "block this number" feature. I've blocked every 663, 800, 757 number they've called from but they always find a new number from which to call. So I'll keep blocking and they'll keep trying! Scam artists. Trying to recover a debt that WASN'T mine that is also over 10 years old.

Just download a call blocker program from google play or Amazon for free if they are calling your cell phone. Once you add the number it will block them from bothering you again.

Portfolio recovery. Debt collectors got it all wrong. If they really wanted my money they would send a couple of fellas that looked like Russian kgb to my door to politely ask for the money. I may be more inclined to pay. Just a thought not a sermon.
| Annoyed 2014-01-24 16:19:55 Unknown |
I literally had my credit run 2 days ago and so I KNOW I have absolutely ZERO outstanding debts...so why do they call me?! Cause it must be a scam!! I got a call from them a few months ago, and then today. I NEVER answer, they seem to call less if you never even acknowledge they exist. Don't answer, don't deny, just let it ring and it'll be over before you know it.

Portfolio Recovery Associates has been calling me for years now. At first I answered the calls but there was never anyone on the other end and they never left a message. Over the years they have used so many different numbers they filled up my caller reject list. I don't owe any money nor do I have any outstanding debts.
| Mandie 2014-01-02 21:44:28 Unknown |
Called me today. If I get a number that calls twice, it is blocked (thank you Apple). I owe debt, but this is clearly not a legit company and not even in my own state. I don't answer the phone if I do not know who is calling, and this company is a bottom feeder touting the legal line. You can't squeeze money out of a stone. Good luck.
