In all states they have to file this with the courts before they can garnish your account. I believe. They will deliver a summons that you have to answer. You can get an atty and fight this

I did not answer but they left a message stating that they wanted to talk about a "client" of ours.  I have no clients and no business..a retired guy just minding his own business. I will never answer when this number calls.

They did somehow put a freeze on my parents accounts without any court dates or letters and can't get anyone to talk to her, they send her straight to voice mail, they loose their housing and electricity soon if nothing is done since they can't access their money. And we live in MD. No food, no gas and 3 kids under the age of 17. I can only help so much

I have been reading that these people have been calling yall. Our issue is these people froze my parents account, and every time she calls, the receptionist sends her to a voicemail. She finally got a guy who says he has no idea who she is that her name isnt in their database and that he would call her right back. The next day my mother finally called again to see what is going on and after calling 10+ times, got the guy again and he asked to put her on hold then hung up on her. She called back and only received voicemails....not even the receptionist. They have no way to pay bills or buy food for the family and I can only help out so much.....can anyone help us please.

They are allowed to practice because they have the Georgia Supreme Court and the ex-AG in their back pockets, who stopped the Georgia Department of Consumer Affairs from investigating their shady debt collection practices:

In a 4-to-3 decision, the Georgia Supreme Court has upheld a ruling by a Cobb County court prohibiting a state official from investigating a law firm that collects debts on behalf of creditors.

Background

Joseph Doyle is the Administrator of the Fair Business Practices Act of 1975, Georgia?s principal consumer protection law that prohibits deceptive practices involving consumer trade. Doyle enforces the law through the Governor?s Office of Consumer Affairs in the executive branch. In 2008, after receiving complaints alleging abusive debt collection practices, Doyle issued an ?investigative demand? to Frederick J. Hanna & Associates, P.C., requesting documents and information.

When Hanna refused to provide the information, Doyle petitioned the court to force Hanna to comply. The court refused, concluding that the demand amounted to an attempt to regulate Hanna?s law practice. Such regulation violates the Georgia Constitution?s separation of powers requirement, the court concluded, and ?constitutes an impermissible interference by the executive branch into the exclusive jurisdiction of the judicial branch of government.? Under the Constitution, the judicial branch has the exclusive power to regulate the practice of law. Doyle, represented by Attorney General Thurbert Baker?s office, appealed to the state Supreme Court. Hanna is represented by the former Attorney General, Michael Bowers.

Majority: Governor?s Office Cannot Regulate Practice of Law

?The issue in this case is not whether the [Fair Business Practices Act] applies to a law firm?s own commercial or entrepreneurial activity when, for example, it attempts to collect fees from a client,? says today?s majority opinion, written by Presiding Justice George Carley. ?Instead, this case involves [Hanna's] attempts to collect moneys that were owed to its clients.? Therefore, ?we hold that the representation of clients by a law firm does not come within the [Fair Business Practices Act] even if certain services were provided by non-lawyers within the firm and could have been offered by a company without any attorneys. If [Hanna's] employees engaged in wrongful conduct against debtors, the remedy must be found outside the [Act].? Chief Justice Carol Hunstein, and Justices Robert Benham and Hugh Thompson join in the majority.

Dissent: Lawyers Should Not Abuse Public and Violate Consumer Protection Laws

In the dissent, however, Justice Harold Melton writes that the Fair Business Practices Act ?is a law of general application that has nothing to do with impermissibly regulating the practice of law in violation of separation of powers.? As a result, ?I must respectfully dissent from the majority?s erroneous conclusion that the remedies relating to [Hanna's] allegedly abusive debt collection practices ? must be found outside the [Act].? Investigating violations of the law that happen to involve lawyers does not automatically amount to impermissibly ? regulating? the practice of law, as a lawyer who violates the law is just as subject to investigation as any other common offender.? Furthermore, ?an attorney cannot abuse members of the public by engaging in unfair and unlawful debt collection practices and then shield himself from investigation under the [Act] because he was engaging in such unfair practices ? on behalf of a client,? the dissent says. ?A lawyer can, and must, practice law without punching people in the face. And a lawyer can, and must, practice law without violating the [Fair Business Practices Act] by abusing members of the public.? Justices P. Harris Hines and David Nahmias join in the dissent.

The Campaign Money Connection

A quick check of the Georgia State Ethics Commission web site reveals a disturbing connection between the actors involved in this case and the judges involved. The attorneys involved, including Mr. Hanna and Mr. Bowers, have regularly contributed substantial sums to the campaigns of the trial and appellate court judges that heard this case.

Bowers has donated substantial sums to the campaigns of Georgia Supreme Court Justices Benham, Hunstein, Melton, as well as the election campaign of the trial court judge, Lark Ingram of Cobb County Superior Court. See details.

Hanna has donated $10,000 to Thurbert Baker?s campaigns for Attorney General, the office tasked to enforce state law for the executive branch of Georgia. See details.

Eroding Public Confidence in Law

Debt collection attorneys can use the legal process to locate and collect assets, but consumer protection laws, according to this decision, cannot be used to investigate law firm debt collection practices. The implication is that attorneys are ?above the law.? What relief is available to consumers who are subject to abusive debt collection practices by law firms? Are they supposed to file bar complaints and rely upon the State Bar of Georgia to regulate lawyers? As the court notes, non-lawyers may engage in debt collection and would be subject to regulation by the Governor?s office; therefore, two firms may engage in the same conduct by not be treated equally under the law.

The sad thing about this case is it is just an investigation of consumer complaints. In all likelihood, Hanna & Associates did not break the law. They go after people who are trying to cheat their creditors. Those who complain about debt collection practices are trying to get away with cheating creditors and have strong financial incentives to attack those trying to collect a valid judgment. Sunshine is a great antiseptic. When there is an apparent effort to cover-up, prevent investigation, and use status and money for unjust influence, minor incidents can lead to major infections. A case like this sends a terrible message to the public.

This attorney wiped out my accounts due to a bad debt. I had signed some paper and due to that he came in and took every penny. I called the office that morning and the lady in the office acually laughed at me. I explained that they had taken every thing tht I had and I did not even have lunch money for my child. She thought that was funny. I really was trying to take steps to get the bad debt paid but after they did this, I closed all my accounts.

These people are ruthless and I can not believe that they are allow to practice in Georgia or better yet some companies even give them any business.

I am being sued by Capital One and HSBC.  The original credit limit was $500 each but I am being sued for $2800+.  I filed my answer and got a court date.  Since then they have sent me a letter to "settle" amicably.  They have also called me.  I want to go to court because if I have to pay anything I want to have it documented.  I would not trust them with my money for anything.

Get calls for someone I do not know. Told them that person does not live here and as far as I know never lived here. But they keep calling back. I get calls for this person from other companies looking for him or her. Reeported to FTC, nothing. Went to JP and local police, they cannot help. What the hell is our government for?

Just got a call from this place-they identified themselves as Frederick Hannah, said they were calling about a debt but wanted me to verify my DOB & SSN. I wouldn't give it because they wouldn't give me more information-like what creditor they are calling for. Caller was very nasty even after I explained I am aware I owe several debts, am unemployed & everyone will have to wait. What he doesn't know is I have collection experience & they will be reported for FDCPA violations.

Yes they can if they filed a law suit and was issued a judgement I think they can get all money in the account up to what you owe and all money that come in for 30 day after they place a garnishment on your bank account.

I have an android phone only. They called me but a program on my phone called "Mr. Number Call Block" has settings to block any number you program in it. It also has the ability to block area codes just add 800, 900, 866 etc at it will block ALL numbers to my phone with that area code. It also has a box in settings to check/uncheck called "block suspected spam" that comes from a data base of spam numbers. This number was blocked by Mr. Number Call Block as suspected spam. The phone rings one time and "Mr. Number Call Block" hangs up instantly and will not go to voice mail, so they can't even leave a message if they wanted to. If you have a land line with tons of harassing phone calls and spam calls but need to keep your number get a android phone and have that number transfered to it and drop the land line. Then go to the android market on the phone were all the paid & free android applications are and download "Mr. Number Call Block" to the phone. It's FREE! It has worked PERFECTLY without fail for me at blocking unwanted calls. I have had no false positives with "Mr. Number Call Block". It's a Lifesaver / stress saver

That phone number is for the Marietta branch of Frederick J. Hanna & Associates, P.C., a debt collection "law firm" notorious for their inappropriate and harassing phone calls. They'll probably keep trying to contact your relative using your phone # until you can get them to update their records, and/or file an opt-out request in writing.

I am so pissed off this company woke me up and left a message on my phone.  They said they are looking for somebody I do not even know.  They have called 2 days in a row but yesterday no message was left.  This should be against the law.  All bill collectors should not be allowed to even say if u are not this person then hang up.  The average american is nosey as hell and will listen anyways because I sure did.  Thank god for android phones and call filter they will not be waking me up again.
