Well let's see how funny they like it once my lawyer sends them notice of my intent to sue them for violation of the FDCPA.  Let's see how aggressive they get now that I have the law on my side.  They can play the pre-legal status game with my lawyer and then pay up for the violation.  Bottom feeders like this ought to be shut down without question.

You obviously know nothing about collections and are upset with the shut down of the company in said country .. pre legal means that once you do not pay there office it will be forwarded to a lawyer for further actions .. so yes they do prelegal collections.. people are just upset that they have bills to pay and fall behind .. I am a former employer of Budzik and Dynia and know all the ins and outs .. next time you want to spell names get them right its Cruz .. and the only reason they closed down your said office is cause you were not meeting your quota ..

A call came in this morning from a man claiming he needed our help URGENTLY. He asked if we would go to a neighbor's house (gave us the address) and have him call 877-685-5791. After looking up caller's number and realizing it belongs to collection dept of Budzik and Dynia, I called back for an explanation of this new and unethical tactic. The woman who answered became extremely rude because I did not want to give her my personal information or phone number and hung up on me.

This law firm called me on April 18th and didn't leave a message.  Later that day, I returned the call and spoke with a rather pleasant woman.  She explained that verification of information was required, before going any further.  Once we satisfied that requirement, the woman began her "mini miranda."  "This is an attempt to collect a debt and any information will be used for that purpose."  After telling me the company she represents, she then told me this account was "in a pre-legal status."  In the Commonwealth of Pennsylvania, that is a direct violation of the FDCPA.  When this lady took a breath, I advised that I have representation of council.  Having given the name of the law firm, the administrative office handling this matter, and the telephone number to contact, her tone changed.  She then became aggressive with me and demanded to know how long I was a client of the attorney of record.  I just repeated the information and told her to call my attorney.  After that, I told her she was going to have a good day and hung up.  Four days later, I received a demand letter from this company.  Armed with this information, I then filed a lawsuit against Dynia and Associates for FDCPA violation.  If more of us file FDCPA lawsuits, bottom feeders like these will just go away.

Short answer:
If they want to reduce your "debt", but will only accept a check or Green Dot (or similar), it IS a scam!
No need to contact a lawyer or file bankruptcy.

Long answer:
This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

* Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

* Debt collectors may NOT
- repeatedly use the phone to annoy someone.
- falsely claim that they are attorneys or government representatives
- falsely claim that you have committed a crime
- falsely represent that they operate or work for a credit reporting company
- say you will be arrested if you don?t pay your debt
- say they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
- say that legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action
- use a false company name
- take or threaten to take your property unless it can be done legally;

The debt collector may not garnish your wages unless there is a court order to do so.
Many Federal benefits (including Social Security Benefits) are exempt from garnishment

You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,

Report any problems you have with a debt collector to your state Attorney General?s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.

I received a call from Budzik & Dynia on my cell phone.  Then they called my work.  I thought you could not be called at work?  Can someone confirm that?  I also received a letter from them tell me they would reduce the amount to about half of what I owe.  Guess I will have to contact an attorney or might have to file bankruptcy.  Any suggestions?

These callers are violating bankruptcy protection laws.  And, per the FDCPA, the burden of proof is on the caller to prove that you not only owe a debt, but that they have the legal right to collect said debt.

However, since this debt was taken care of in your bankruptcy, you could file your own action against them for violations of the bankruptcy protection laws, as well as harassment.  I found this webpage interesting - has links on how to protect yourself from such zombie debt collectors:

Warning! These kind folks are buying paper debit and trying to collect on it. I sadly had to file bankrupt a couple years back - they tried telling me I had a billed that was not discharged. They quickly tried to put the burden of proof on me.
These people look to use fear and intimidation, they are hacks and have no legal backing - laugh at them and offer to give the your favorite split pea soup recipe but let them know that's all they will ever get because you know they are hacks!

Called my place of employement twice asking for me and giving the last 4 digits of a SSN (not mine).  Gianna Love from Dynia and Associates.  Trying to determine if I was the person they were seeking.  No idea why they are calling this number.  It's a place of business.   Isn't that illegal?  Sound like a debt collector.

it may not be them but a person you know that may owe money and that they have an answering machine that instead of saving messages it forwards the call to you trust I have family members already doing that.

Kewan Jones called me from this number from the company of Dymia and Associates calling for Crown Assets regarding an account with HSBC. I have NO outstanding debit.

About three years ago I had a credit card from HSBC that was paid off. This company is a vulture company. They buy names and telephone numbers of old debits for pennies and then harass you and try to scare you into thinking that you have an outstanding debit. I learned this the hard way. When they told me about my debit I was able to pull up the file and proof of payment. They told me that the debit they are collecting was for the interest on my previous debit paid to another company more than a year ago.

This company is b***s***. Please report them if they call you.

The caller name was Jamie Feria calling from 773-902-1130 x51 asked to speak to my neighbor and my neighbor doesn't live with me at all. I just found it strange for someone to be calling me about my neighbor and they stating they know I live next door to my neighbor. If at all possible I can give out my neighbor's information which is an invasion of their privacy.

Showed up on CallerID as CHICAGO, IL.  I check the answering machine and the entire message was some easy listening instrumental.  Had another call from Chicago a few months back (different number) that had the same style of music as the message.

I have receive numerous of calls from this number. I have recieve maybe two messages out of the numerous of calls. Stating that I need to call them and regards to outstanding debt. Not stating what debt, just that I have an outstanding debt. Mind you I have not receive anything in the mail stating that I have an outstanding debt of any. So to me this call is a fraud and I will not entertain this call at all. If I owe money send me a bill, because according to my records all my bills are paid on time all the time and I have no outstanding debt that I am ignoring.

These people have called my mother and wife about my mother in law's supposed debt.  They made the mistake of calling me tonight.  I used to work in law enforcement in Iowa.  I let them know it is against the law to harass debtors in the state if Iowa, and asked why they don't just call my mom in law...she got real quiet and ended the call.  I am going to report them to the Iowa Atty General tomorrow.

I got a call from Budzik & Dynia saying that I owed a GE Money Bank /PayPal MC     GE Money Bank / Paypal opened up an account in my name several years ago and even after I called to close the account, some one was charging on it..  Last year I got a letter from GEMB / PAYPal saying that the debt was charged off as they had allowed someone to charge on the account even after it had been closed.  

So this B&D calls and says that I owe and I tell them that it was charged off and closed last year, Kimberly Miles tells me that GEMB never charged off, except that when I look at my Credit Report is shows that it was.  

I will not be answering the phone any longer and will not pay this "debt".

Think about it, a lot of people have just received tax refunds.  So they're all calling and trying to get that cash before we do things like put clothes on our children, buy food, maybe insure our 20 year old vehicle for another year.  Ignore it or file bankruptcy.  In the current economy as many people have defaulted on debt, it would probably improve your credit score anyway.

I got a few calls from this person calling herself Rowanda, she said she was from the lawfirm of Budzik & Dynia, and she was calling about an old BoA credit account. She calls about 8 times a day trying to get me to talk to her and resolve this issue, which we all know is BS. She has gone so far as to contact my neighbor to get me to call her, can you believe it? I am now seeking my own legal representitive to sue them for Harassment, and Libel. You cannot talk to neighbors and spread false information, or any information at all for  that sake. This definately falls under Harassment and Slander, and that is a valid law suit.

These yay hoos just called my cell.  I don't usually pick up to strange numbers but I have a son who is away right now and not sure of the area code where he is, so I answered.  The first thing the guy asked me  was if this was *****.  I  asked him who he was, he said from Budzik and Dynia, a law firm and he was an attorney and had a client who he was representing.  I said I don't know you, and he asked again if I was *****.  I told him no, then he started to argue and asked why I said I didn't know him.  I just hung up on the dude. I have a current account with BofA in good standing.  Don't know what he wants, but my cell phone will NOT be answered again to an unknown number.  I wish I knew how to block numbers on my phone.  I don't know who would have my cell phone number as a business person anyway.

I have received calls and letters from these Jokers. I completely ignore them and refuse to acknowledge the debt. WORD OF ADVICE .... Never, Never, Never acknowledge the debt. Tell them
to send you all the Statements and Documentation proving you owe the debt in question. Do not give them your name or address. The more information you give them the more they will hound you to collect the debt. They are not authorize by the bank or debt collector, they buy the records from the bank or debt collector and then they try to collect the debt. The Bank has already written the debt off and has placed it in the uncollected file (end of story). This company makes their money by intimidating you into paying a debt that may be many years old. Don?t play their games and completely ignore them and their calls.
