Answer: When libel is clear on its face, without the need for any explanatory matter, it is called libel per se. The following are often found to be libelous per se:

Answer: Publication is the dissemination of the defamatory statement to any person other than the person about whom the statement is written or spoken. Question: May someone other than the person who originally made the defamatory statement be legally liable in defamation?
Answer: One who "publishes" a defamatory statement may be liable. However, 47 U.S.C. sec. 230 says that online service providers are not publishers of content posted by their users. Section 230 gives most ISPs and message board hosts the discretion to keep postings or delete them, whichever they prefer, in response to claims by others that a posting is defamatory or libelous. Most ISPs and message board hosts also post terms of service that give them the right to delete or not delete messages as they see fit and such terms have generally been held to be enforceable under law.
Question: What is Malice or "Actual Malice"?
Answer: Malice is often defined as, "the intent, without justification or excuse, to commit a wrongful act." It is the conscious, intentional wrongdoing with the intent of doing harm to do the victim. In many civil cases, a finding that a defendant acted with malice will often open the door to liability or increased damages, such as punitive damages. "Actual malice" is a legal term of art that is mainly relevant to defamaton claims. "Actual Malice" is found to be present when a false statement is published with either a) actual knowledge of its falsity or b) reckless disregard for its falsity-- a "should have known" standard. Question: What is "intrusion into seclusion"?
Answer: Intrusion into seclusion occurs when you intrude upon the solitude or seclusion of another person or his private affairs or concerns, if the intrusion would be highly offensive to a reasonable person. It generally comes up in the context of paparazzi photographing celebrities, but covers any reasonable expectation of privacy that is intruded upon. If the person intruded upon gave you consent to do it - i.e., gave you permission to take his picture or write about him - then you have a defense against this claim. Interception of an electronic communication (i.e., an email or IM chat) can raise additional legal issues, such as federal wiretap laws.

Answer: A statement of verifiable fact is a statement that conveys a provably false factual assertion, such as someone has committed murder or has cheated on his spouse. To illustrate this point, consider the following excerpt from a court (Vogel v. Felice) considering the alleged defamatory statement that plaintiffs were the top-ranking 'Dumb A***s' on defendant's list of "Top Ten Dumb A***s":

A statement that the plaintiff is a "Dumb A**," even first among "Dumb A***s," communicates no factual proposition susceptible of proof or refutation. It is true that "dumb" by itself can convey the relatively concrete meaning "lacking in intelligence." Even so, depending on context, it may convey a lack less of objectively assayable mental function than of such imponderable and debatable virtues as judgment or wisdom. Here defendant did not use "dumb" in isolation, but as part of the idiomatic phrase, "dumb a**." Are ex's of his trying to get revenge.  Telemarketing is what it is no matter what company. I hope you do.  This con-artist took $460.00 from me and destroyed my carpets.  The advertisement comes out as "Are your carets dirty?"  We have a special of $9.95 per room, etc., etc.  I am reporting him to the police and have reported him to Channel 13. I am hoping to hear back from Channel 13.

I too have been hounded by an automated recording from "Ray"... same identical speech as above. I've hung on the line and listened to the entire message and hit 2 to be taken off their list, I've talked with an operator and told them take me off, but the calls keep coming. Funny how NO ONE knows the name of the company they represent. So I set up an appointment. They came today and I asked them for a business card and then told them I'm tired of the calls. The guy went ballistic on me and told me I would regret wasting their time. As he drove off he told me he's going to make sure my number is on EVERY call list. The number on the card, 720-708-6474 is registered to TCE Marketing in Aurora, CO.

This jerk is a company that local carpet cleaners in your area are contracted with.  You call and he dispatches one in your area.  He gets around the DNC list because he uses Magic Jack or something similar that can't be tracked.   I have a mortgage company doing the same thing and the recording tells you to hit 3 if you don't want any more calls.  But what that does is that it sends an acknowlegdement that it's a good number....so they keep calling you.  I had an operator answer and told her that I wanted off their list and she just hung up on me.

This A** is now operating in the Denver area.  Not only does he use a couple of different numbers, his caller id is now shown as ABC Marketing with a phone no. of 720 583-6935 as well as Tcemarketing 720 708 6499.  But the voice and message is the same.  What a sicko. Maybe calling the telephone company and reporting the harassing calls coming from this number will help.

this office has phone equipment in it, but there are no people there. He may not be there for long as he can't pay his bills on time. he lives in ca. but is in the dfw area now and will move on to another state later once his phones and suite are taken away for none payment. Kevin Calvin may also be a fake name... Jeff Harris is not a real person. I would go to the FBI & also the FCC he is breaking every law in the book. and his tatics could be considered a federal offense.. He most likey has other offices that use the same tatics for set up. and runs them a few months at a time and then skips town and pays no one for the office suite and phone lines he buys he then does it all over again a few months later. if you live in dallas you can go to this location and wait till someone shows up to check on the equipment in that suite. no idea how often the suite is checked for service. This guy will burn everyone around him. My guess is he will set up lines using a false id, then run them for a few months until they are turned off for none payment and then do it all over again using the same mo fake Id's. the equipment in the office suite is the crown jewel.. he has to have that equipment to make all the phone calls... like a robo dialer.

I just checked TX driver's license records and there is no one here with the name Kevin Calvin.  I even ran his birthdate to see if there was someone with the same last name.  Nothing.  So, if he's here, he doesn't have a TX driver's license.  He only has 90 days to surrender his out of state license and get a TX license, and only 30 days to register his vehicle.  Active duty members of the U.S. Armed Forces and non-resident, full-time students attending a Texas college or university are the only ones who are exempt from the requirements to title or register their vehicles, but the driver's license law applies to everyone.....so he might be breaking those laws too!!!

Spoof Companies include:  spoofcard.com,  telespoof.com,  spooftel.com, phonegangster.com, bluffmycall.com, spoofapp.com,  freecalleridspoofing.com,  ETC.  ETC..   One can change their voice while making these calls as well.   Congress was going to shut them down but there's more serious problems right now.  You could always call some of them and ask about telemarketing.

Also, the phone companies can trace calls and will usually do it for free.  You just need to collect as much information as you can about the calls.   If you have cable, they also have departments to go after these people.  Call and complain, collect times, dates, phone numbers, everything you have.  Keep your head about you and get the info to as many places that might help as you can including Do Not Call List  complaints.

I get these calls as well.  I left a message one time saying I was going to schedule a meeting and then beat the crap out of who ever showed up.   Then I started getting phone calls from TCE where there was no message, just back ground noise like a tv or radio then it would hang up after a bit.   So who knows.  There's even someone who needed their carpets cleaned and never heard from them???   Sounds suspiciously like a nasty prank.  Which is very illegal as well.   I will bet I'm not the only one that has made idle threats.  It's making someone happy,  the Sicko.  I called the TCE number and got mailbox like message to put in the number for the mailbox.  All automated.

Note:  There are companies called "Spoof Call" & "Spoof Tell"  I think.  Look up anything with the word Spoof in it and you will find these companies.   They spoof phone numbers for anyone willing to pay.

Interesting - last night at 10:20 pm, I got one of these calls. It was from an Irving, Texas phone number: 972-887-3023.  But when I checked this number it does not belong to a Jeff Harris or a business; it's a woman's personal line.  I think Jeff is fiddling with his outbound caller ID so that fake numbers show up.
