Unfortunately, you'll never see that money again. If you're going to take out a loan, know your rights in regards to debt collection practices and NEVER NEVER NEVER pay anyone anything until you have written confirmation that the debt is valid and they own it and have the right to collect it sent via certified US mail! Also, Please see Tamianth's post on the previous page for details on the laws and where to report them. Sorry to say though, that money is gone gone gone

A man named Jay Jordan and another one named Micheal Davenport called from 407-512-0583 stating that my ssn is under investigation and I owe $856.13 and must go to a Rite Aid convenient store to purchase a green dot pak and send the money through cash like that. If not local sheriff dept and him will show up and drag me from my job and be incarcerated for 30 days in jail and have a court hearing unless I make the call that day. Don't fall for this stuff it is a huge scam, it can be scary when they first call since they have your information but don't give them any info.

About 3 weeks ago received first call they said they were with the CA State Attorneys office.  So I asked for details about the case who did I borrow from when etc.. they would not provide any information.  So I said let me talk to your supervisor they claimed there wasn't one! So then said they needed money in order to stop the action.  I said know I have a right to know who I owe money to.  They then hung up on me.  I called back and they said don't call them anymore.  So today in the morning I get another call again they would provide no information.  I asked them not to call me back.  Two phone calls later this person calls again and says the are submitting the case I asked for him to provide information regarding the debt and he could not provide any information.  He said he was reading from the court docs but it wasn't listed.  I asked well who is suing me he said it is a criminal offense and I would be arrested have to $8000 in legal fees I would have to stay in jail for 22 hours? So I again asked to speak to the attorney and or provide me with the number of the attorney so I could get information he then hung up.

Is there a place where we can report this kind of activity

Prank Call
Trust me, this is ANOTHER scam from those DOT HEADS FROM INDIA(such a HORRIBLE RACE OF PEOPLE and I DARE ANYONE ONE HERE TO DISAGREE WITH ME OR DEFEND THEM).   I rec'd an "email" from them, tell me I supposedly owed nearly $9,000 on a credit card.  I have never had a credit card with that high of a limit, NOR have ever had one that ends in the number they claimed, and all my legit cards are PAID OFF.

I also have never heard of a Law Firm sending you an "email" offering to allow you(so kind of the dot heads) to pay them, but then NOT providing a phone number, legit USA address or even a return email.  I wanted to send an email blasting these idiots, telling them that their wives were w***es, what not(it's fun), but my emails was returned undelievered, which means this is NOT a legit company.

17863759110.  This number has called me with the same thing, some cash advance on a prepaid card that I never paid back now I owe 350$. Claim they are with Anderson law firm in Miami and if I don't settle now I'm going to jail. I told him to go ahead and file, send the cops and pound sand. He then told me that's what's wrong with American people and that's why terrorist drive planes into our buildings, asking me do I remember 9-11, and how he was gonna bomb my house and everything. I saved the messages left by them ( non life threatening of course) and also told him I was recording this call he called me names and hung up. I called back only to have another guy with foreign accent basically say the same thing. I googled it and found this site so now I know for sure it was some kind of scam.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I just received a call from these people claiming to be from Anderson law firm. They use the names Steve Johnson and Eugene Baker. They threatened to send a sheriff to my work or home and they would drag me to court if I didn't pay. I would also do 6 months in jail. The number they called my from is 786-375-9110. They asked for my attorneys name and number. I didn't give them any information. Has anyone that has gone through this ever had anyone show up to their work or home? Please let me know. I never took a loan out with these people and they won't stop calling.

Scams from Anderson law firm for payday cash advance & another number and message out of Dunsmeir California. They have your personal information and threaten to ensue legal action for money that you never received. Stating a sheriff will be at your house, you will spend at least 6 months in prison for not repaying a loan (again that you never received) and you are liable and will be sued for  at least $7000 for fraud. . It's frightening that these people have personal information through Internet access. - The one message from Dunsmeir actually told me if I disregarded it, good luck.
I'm thankful I'm not that stupid. I spent at least 20 minutes on the phone responding to the "Anderson Law Firm" for "cash advance"  - they were horribly persistent stating I needed to settle this matter before legal action was taken. I told them I was calling my lawyer & they tried to put me on with theirs. I hung up.
I stated repeatedly that I had done nothing wrong and my bank statements would prove I never received money. I then called TMX web cash advance and talked with a rep. She stated this was indeed a scam and there was no connection with these companies to them. That I was in good standing with them and to report it...
My phone has been ringing every 5 seconds & emails are piled up with messages from various companies
I just needed to borrow 300 for car repairs.. Now I'm being hassled by these people that are obviously cons. They used the names John Hardy & Steven Smith but have thick Indian? accents.
Just beware.

This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information from unscrupulous websites like the one you may have filled out an application with, and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

ABC News released an investigative report on this scam a year ago:

I am with you, i have been getting the same exact calls. This time he said his name was David Bently. His English is so bad my voicemail cannot even transcribe his message correctly. I told him to do what he had to.  That if they wanted to scam people at least get a scam that is at least somewhat believable.  I got one to stop calling me by calling him and having people i know start calling him and his office (or whatever they call it) and say that they owe us money. LOL yea the calls stopped at least from that number.   If their not gonna stop start poking fun at them. The eventually catch on that its not gonna work.  I know everyones credit situation is not like mine but my SSN is completley useless cause it so bad. So whatever they do to it  can only make it better.
