This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

Hundreds of thousands of cash-strapped Americans have been targeted by abusive debt collectors operating out of overseas call centers suspected of links to organized crime in India, law enforcement officials told ABC News.

The calls are part of a massive scam, one that appears to target struggling Americans -- especially those who have gone online to apply for payday loans. Armed with personal information from those pilfered applications, the threatening callers, who claim to be debt collectors poised to initiate legal action, have managed to pry loose millions of dollars from their victims -- even when the victims never owed money in the first place.

"This is what we call a phantom debt collection scam," said Jon Leibowitz, the chairman of the Federal Trade Commission. "It's a very pernicious and innovative new fraud."

Working through call centers in India, the commission estimates that the criminals have dialed at least 2.5 million calls, persuading already cash-strapped victims to send them more than $5 million. Some have reported receiving dozens of calls per hour. They are victims like Cindy Gervais, of New Orleans, who went online for a quick loan when her husband's car was hit by a driver who didn't have insurance.

Even though she paid the loan off, the so-called "phantom" debt collectors with Indian accents began calling to say she still owed money.

"He more or less told me that if I didn't pay, they were going to have someone on my doorstep to arrest me," she told ABC News. "And that they were going to contact my place of business, and tell them what kind of person I am."

At first, she said she resisted. Then the calls became more frequent, and started to ring on her cell phone, and at the grocery distribution company where she had worked for 27 years.

"I was more or less in panic mode because he told me there would be someone before noon at my place of business to arrest me and take me to jail," she said tearfully. "So I agreed to pay him."

After receiving scores of complaints, investigators with the FTC said they began tracking the calls, and following the payments. They alleged the payments led them to a California company run by an Indian-American named Kirit Patel, and that such scams would not be possible without American front men.

"I would say that all roads of this scam, or many of the roads of this scam, lead back to Mr. Patel," said the FTC's Leibowitz.

ABC News tracked Patel for weeks, from the suburbs of San Francisco to Austin, Texas.

Patel refused to talk. But his lawyer, Mark Ellis, said he believes it is far too early to pass judgment on his client. Ellis, a Sacramento-based attorney, told ABC News that Patel was hired for a nominal fee to set up an American shell company, and had no idea what the call centers in India were doing.

"I can tell you, he was as snookered by the people in India as anybody," Ellis said. "He's a 69-year-old man who is nearing his retirement who thought all he had to do was set up some corporations and everything was on the up and up. He's completely dismayed that he has become the lightning rod of this entire problem."

A close friend of Patel's also defended him in a brief interview at his home, saying Patel was not trying to defraud anyone -- he was just an unwitting, bit player in a larger scheme.

Let me tell you about peter Jones/Dan Henderson. He is no Atty and is not a loan broker. He uses # 786 462 5165 and 786 398 9363 He is a scam artist that does not know his sh... I am a CPA/FinMgr for 25 years and I called him on the public records act for BBB and asked him for his access code he blubbered mind you this act does not exist. He proceeded to tell me he couldn't give it to me due to internet problems.  SCAM SCAM SCAM.

I received the same type call from the same number. He said he was state attorney peter jones from the state attorneys office, and I think he said district 4, but that part wasn't clear.  He did have an accent that sounded like he was from India or the part of the world.  He said a lawsuit and allegations have been made against me and my social security number and if I don't call home I'll be arrested within 90 days at my mailing address.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Got the sam message today, also from Attorney Peter Jones. It was actually for my husband, but on my number. Said there was a lawsuit against him and a couple of allegations against his social security number? Said he would be arrested at his mailing address if he did not call back. Said if we didn't call back they would "not be responsible for any extreme situations you're going to face in your future."

After listing to the message I called back the number and got no answer. A minute or two later, the number called me again and asked if I had called. I said I had. They wanted to know why. I said I was returning a call regarding a really bizarre message I got about my husband being arrested. I asked to speak to Peter Jones and was told he wasn't there (when clearly it was the same guy). I asked who he was and he said he was Dan Anderson. They asked me to have my husband call them back. I asked what it was in reference to. There were several seconds of hesitation, and then he said my husband had applied for some loans and they had been approved. I said that wasn't the message I got. The message I got said there was a lawsuit and my husband was going to be arrested. When I pressed him further, he hung up on me.

I called back again and demanded that he tell me what the hell was going on, and he hung up on me again. Forwarded the information to my husband, who also called, and who was also hung up on.

I don't get it. What's the point of this? What are they hoping to gain? Initially, it's alarming. Then it quickly becomes just stupid.

I just received a call from Mr peter Jones as well stating the same thing I ask for identifycation and he got rude and said I would find out later I contacted law enforcement office here in BC they instructed me to call him back and speake to a supervisor I did and got a machine it is time to stop this guy I will be contacting law I f again so please keep these storys voice going so we can fi d him and turn the tables

Just received the same call. He did not provide any information to me. Said that he would read to me an affidavit that he has and I should not interrupt him or he would be forced to end the call and have me arrested. You can tell that it was rehearsed because he basically repeated the same thing that he said on my voicemail. While on the phone with him, I googled the number he called from and found this forum which made me feel a little relieved. I told him that I googled the number and saw that this is a scam and that he needs to not call me again. He tried to say that there was another company out here that is saying they are with his agency and they are the actual scammers. HA!!!! He says that an officer should be at my house tomorrow around 10 a.m. to take me to jail.

I just sure hope that he does not have any of my banking information. He did not read off any of my routing or account numbers. Have any of you noticed any funds missing from your bank account? Should I close my accounts? I will continue to monitor my accounts for any suspicious activitiy.

I recieved a message from Peter Jones last week and today saying that he worked for an attorney office and that I had a lawsuit filed against me. He couldn't tell me what it was for or who filed it. Saying that it was a 3 page affidavit and that if I didn't pay $1,954 within 24 hrs a sheriff will arrive at my door with a warrant for my arrest. I would be locked up in prison for 90 days. I would lose my job. All my money will be seized out of my banking account. He also called out my routing number and my account number too which was spooky.

Per other comments this is a fraudulent caller claiming to be a "Federal Attorney"  hello!!! States have legal licensing boards not the Fed.  Per others he threatens arrest and has way too much personal information most likely gleaned from the internet.  As call progressed, he got into obscene language. Indian accent, should be arrested himself and deported or jailed.

This guy Peter Jones has all my personal information,he claims to be an attorney but he is clearly not,he's been harassing me all week about arresting me for fraud,he has a very strong Indian accent and is very rude,I know that he is an Identity Thief and must be stopped,maybe everyone on this blog can work together to do so.

This person also contacted my Husband but when he found out I wasn't my Husband he got nervous and wanted to know if I would accept responsibility for my Husband.  People use common sense, no Law enforcement agency at any level is not going to tell you when an agency will be out to arrest you, they like the element of surprise.  No Federal Government agency can freeze your banking account accept with a State Banks help if It is a State Bank. The Federal Government isn't going to get rude and hateful with you and if they want you bad enough they will set up sting operations.

I got a call and have been getting them for about two weeks. I'm being told that I am being sued for 3 counts of fraud/stealing money, but he can't tell me where I "stole" this money from. His name is Peter Jones (an Attorney) from the District Attorney's office in Miami. He wouldn't fax or email me the documents he said that I have 24 hours before I will be arrested, lose my job, and spend 90 days in jail unless I pay restitution. I am freaking out on the phone, and then I read this blog. I'm kinda at ease, but should I call the police?
