Debt Collector
I'm in Florida and so is this company.  I understand it's a 1500.00 fine in this state for every call a collection agency makes to your cell?

i too have been receiving calls throughout the day on my cell number. I don't answer calls that I don't recognize and figure if they really wanted to speak with me they would leave a message. This company or caller does not provide any callback info. I would like to stop receiving the calls but I guess I can live with it by just ignoring them.

This number has been calling me for about a month now. I actually did receive a letter from them during this time. As stated by others in this posting, the company is 1st National Collections. They are trying to collect on a car loan that was paid off in 1999 or earlier. This item is not on my credit report yet they claim I owe them over $15,000! Good luck with that...

This is a collection company and I know that they do work for CarMax and other large companies.  Bottom line the phone calls mean nothing, do not talk to them and simply ignore them. If they are calling your cell, have their number blocked with a call blocking program (if you have a smartphone). The MAIN issue is that if you honestly dispute the debt I understand (and this is in no way a legal opinion) that the Fair Debt Collection Practices Act, U.S.C. Section 809(b) (Federal law, your state may have a similar one) provides: "If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector."   It seems that once in receipt of a proper letter mentioning the act (form letters are online) collection must cease.  NEVER ignore a written demand. Also be aware than in this economy OLD debts are being purchased (ones where statute of limitations has been exceeded) by companies that sue the alleged debtor, knowing many will not respond based on the statute of limitations having run. IT IS MY UNDERSTANDING THAT STATUTES OF LIMITATIONS are AFFIRMATIVE DEFENSES and DO not bar someone from suing on an old debt; meaning they are NOT SELF EXECUTING, and a judge will not dismiss and will allow for a default if a person does not show up in court and actually raise the affirmative defense. If a suit is anticipated ask for as much info as possible:
Example:
This notice constitutes written notice that I hereby dispute the debt alleged and demand verification thereof. The requests and demands herein are pursuant to The Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. 1692. This validation request constitutes constructive notice wherein, notice to the agent is notice to the principle and notice to the principle is notice to the agent.

6. The complete legal name and address of the current owner(s) of the obligation and documentation that they have complied with all applicable State and Federal laws.

Please provide certified documentation of the alleged debt detailing the transactions and accounting and how the alleged debt amounts were calculated.
10. Documentation as to which credit bureaus, including but not limited to Experian, Equifax, TransUnion, this alleged debt has been reported.
11. The agreement with your client that grants you the authority to collect on this alleged debt and documentation that nullifies any previous agreements.
12. Has any claim of loss been made under any and all insurance policy affording coverage to any creditor regarding this alleged debt? If so, please provide the amount of the claim and final outcome of claim. Additionally, provide a certified copy of any and all insurance policies that were/are available to any creditor related to the alleged debt.

I personally would also remind them that all collection efforts of any type must CEASE until all info is provided.

Please see my post below regarding the difference between calls and writings.  If thirty days has past for a dispute letter, if it were me I would be sure to show up in court and raise a statute of limitations defense as no one will for you and unless you RAISE IT IN COURT, a statute of limitations will not bar suit on an old debt, if you fail to show a default could be entered (likely), and then they can sue to enforce THE NEW JUDGEMENT, which will have reset the statute of limitations to day one so to speak; the new judgement will likely be much higher (given interest, etc.) and not subject to your old statute of limitations affirmative defense.  Good luck.  Note: This is strictly a personal opinion and I would consult an attorney, especially one in your state, for a legal one.

I have been receiving calls for several months for these bottom feeders. They almost never leave a message & when they do it is only the last 4 digits of their phone number.  I did receive a letter prior to the calls and it stated that I owe a bank loan for a car from 1998! Are they serious? This alleged loan from which I have a letter from the bank stating that the loan was satisfied;is not even on my credit report, was never for the amount they are claiming I owe THEM!! Talk about scum..... lets jack up a 12 year old loan to double the amount and scare people into beleiving they never paid and that they owe it now or else.
And annoyed yet again

Just an little FYI, this First National has another # 714-495-4807, and with this # the "agents" actually leave their name (assume it is fake) and a number to call them back along with a file # to give them when returning the call.

Just got a call from them on my cell and called them back on another line...someone answered with "First National Collection Agency".

I never give my cell# out unless it's family or friends, so this First National would never have a way of calling me if it was legit...

They had called twice.  The first call I did not answer and they left a blank voice message.
I answered the second call later on that day and it was an automated message saying press 2 if you are not this person or press 1 if you are.  I pressed 2 (even though I am that person) and it disconnected me.  Stupid collection agency!
