Keep getting a call with a recording asking for the guy who owned this house before us...he was foreclosed on and we bought the house 4 years ago....I think all they did was google our address and since our phone number is listed, they associate our number with the previous owner because of the address.  Message tells me if I'm not "John Doe" to stop listening and hang up....ummmm... sorry, but it's a recorded message and maybe they need to put a live person on so he/she can hang upo when they get my answering machine...

She did have me panicing! And she had my previous address which she said is why I had not received the written notices she was sending. She had a quick and descent answer for everything. Now that I've had time to think about it, nothing adds up. But, when being rushed and having her pressure me and make me feel so guilty....her answers seemed good. I am so thankful I went to the bank in suspicion of a scam and they froze my accounts when I did! This could have been a very hard lesson to learn! Banks and others should explain what a creditor is allowed to do and say and what they are not as well as our rights when opening a new account or anything else. Just an idea....

The lady had an answer for everything! She has definitely done her homework! This for sure has taught me a lesson. The general public (myself included) are not educated on what our rights are and the rules for collection. In this experience, I have researched and learned many things. Glad I know them know, it won't ever happen to me again.  I have already changed my bank account, etc. The lady (Toni Warren) called my phone nonstop for 2 days in a row leaving me ugly voicemails and the last one she advised me I better have my attorney contact her!

Gotta love these desperate "collectors".  they break about every law out there about collections, and figure they are going to panic you enough so you'll send them something.    Practice saying "I deny I owe this", "send me the legally required written notices", "you say I've been sued so you must have my address so you could have legally notified me of the court date"; "my employer won't let you and your goons on the premises", and "I have 911 on speed dial just in case you try" , "see you in court".  

There is a statute of limitations on most debts (not student loans, and a few other things are exempt)

It's a scam. and you almost got taken. But now you are going to have to change bank accounts, change debit cards etc. Why in the world would you or anyone else provide this kind of info to a stranger on the phone?

Why would you pay money for a supposed debt that couldn't even be verified?

People like you are the reason these bottom feeders continue to do this.

I received a call from an unknown # on my cell phone. Voice mail was left from Toni Warren saying a suite was being filed on me in 2 days for $ I owed on an old account that was just about to reach the statue of limitations, to call her back @ I 800-214-7862, that this is a very serious matter, etc. and said what my case # was. I called her back. She was VERY rude!! Couldn't tell me if it was an old credit card or what just the original creditor was MBNA Consumer Finance. She put me on hold to go ask the attorney if accepting $3,000 would be okay but never said what attorney or collection agency she was with. Wouldn't let me call her back after lunch, said that moment was the only offer and chance to settle for that amount. If I didn't do it right then suit would be filed, with court costs and interest on the original credit amount of $2500, it would end up costing me about $10k. So I agreed and give her my bank routing & cking acct #. I started to worry about being scammed b/c I just bought a home in February and my credit was cked and credit report gone thru with a fine tooth comb, twice! It wasn't on there.Toni said it didn't show up cause it was already being prepared to file suit. I went to the bank, explained what was going on, they immediately froze my accounts and a week later I went back and they suggested I close that account and open a new one. The bank researched all the info I had and couldn't say for sure if it was a scam or not but leaning more towards a yes. The day I give Toni my info she said I'd get an email from Brandy Smith stating our agreement. I did. It was attached as a picture file and the top of it said it was from Commercial Recovery Systems but the bottom says it was from Pinnacle Credit Service & a Marc Clark signed it. Nothing completely adds up I get an Urgent Communication letter from Commercial Recovery Systems (Toni Warren & her #) REMINDING ME of my telephone ck deposit, date, & amount. The bank told me they tried to pull the $ but because of the freeze on my accounts it was not allowed to go through. I have not gotten any more calls from her and have not had a visit from from the sheriff's office delivering me papers of a suit. So.....I am still unsure. Guess it is still to be determined.

I got this call as well today. some lady name Tony Wards called. she didnt say what company she called me from ( first red flag) !!!!!
She have an affidavit of complains for the petition of civil suit to be filed against me... She called me by name only. I guess she couldnt pronounce my last name.  She ask me or my attorney to call back before may 13th. otherwise, law suit will be filed against me.
Looks like she was reading it from the paper with very serious voice.
Went online and I found all your comments.
I used to work for the collecting agency and it was illegal to use any kind of threat against a customer and lie about it. customer could have disputed later and win the case. but this definitely seams like a scam.

Had two messages on our answering machine regarding a civil lawsuit against my husband.  When I called the 714 7862 number to inquire about the matter, I spoke to a Ms. Warren. I was told that at this point in time our case had gone to court.  They (capital one), were granted a (rue/rule 106) whatever that is...Next court date is in four days in which the judge will determine to garnish 30% of my husbands wages, or collect through attaching liens on our accounts..we could avoid this if we settle before the court date by paying $4.700.00 today...if not, court fees, attorney fees, IRS collections on the taxes??? can be $19,000.00.  I called our county courthouse to find out if there had been a civil lawsuit filed against my husband - absolutely no record. So glad I found this site...I was worried there for a second.  Glad to know about the 4 year California Law...thanks to everyone who has shared!

I received a call yesterday from a man he didn't leave his name but said that it was a time sensitive matter and that they have a civil suit that is going to be filed against me on 12/31/2012 and that he's calling from Tony Warrens office. I called back and the lady that I spoke with said it had to do with JP Morgan Chase and I haven't dealt with them since I was 2004-2005. She said that I would have to pay at least 50% of what I owed. I looked up statute of limitations and they're out of their limitations because it has been 7-8 years and in Maryland the limitation its 3yrs and where I live now its 6yrs. I always pay things that I owe but when you're rude and ugly it doesn't make a person want to give you anything.

I just got a phone call from this woman today. She was very rude and said that they were filing a judgement against me for a loan I had that went into defult. My husband wanted to find out more information about this but she would not give him any. Did you find out if this woman is for real? With so many other posts about this I think it's a scam. The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

CALL FROM THIS NUMBER, SAYING THERE IS A COMPLAIN FOR NON-COMPLIANCE FOR SO SO.... I AM NOT THAT PERSON.  SO I CALLED, TOLD THEM TO GET MY NUMBER OF THEIR LIST. THE RUDE WOMAN TOLD ME WE DO NOT HAVE A LIST OF NUMBERS, YOU GOT A CALL BECAUSE YOUR NUMBER IS ON A COMPLAIN NOTICE.  I SAID GET MY NUMBER OF YOUR DOCUMENT.  SHE SAID, WOMAN CALL WHEN YOU CAN MAKE SOME SENSE AND HUNG UP. LOL!  I CALLED BACK SEVERAL TIMES ONLY TO BE DISCONNECTED IMMEDIATELY. THIS IS RIDICULOUS!!!!

I've had three calls message over the course of the last two months. The first time it was a Mr. Abbot that called and the other two was a woman names Toni Warner. All three times they have said something about a judgement that has been filed against me. Mr. Abbot actually basically threatened me in his message saying that he didn't understand what I didn't understand about a judge, contempt of court, court but he was about to educate me. The second phone call (first by Toni) I returned. She was short and had an attitude. When I asked for the number a the credit card company that the old debit was originally with she refused to give it to me and proceeded to tell me that if I didn't pay her to settle the debt that I would be served with papers within 24-48 hrs. No one ever came...tonight I hav received the third message...same woman, basically the same message except this time she said failing to comply can result in fines and/or jail time. I have also noticed that I have received several automated messages from the 800 number. I tired of these people calling me!

yes, i did received the same voice message from David Silverman. He mentioned about my Federal tax form was return. He insist me return his call. My first thought was Federal Tax. so i return the call immediately, it turn out the old debt collection. they are nasty, rudeness. they try to threaten me with court and he ask me how i put food in my mouth. they also try to threat me about my wife immigration that she can't not come back to this country.

I just got a call from an unknown number and Mr. David Silverman left a message saying that he needed me or my attorney to return a call to 800 214 7862.  His voice was really loud and very demanding.  I laughed after I heard the message, lol.  I knew it was a scam. He even dared to give me a case number. hahaha.  

If you are Mr. Silverman, stop stealing money from other people.  Get your butt of the couch and get a decent job.

I just got a call from "Mr. Silverman" too. BTW, the IRS no longer uses private collection agencies to collect on past due taxes.. so even if your taxes weren't done, they'd come after you directly. I think its just some (expletive) trying to collect money.

got a message today...telling me that he (Mr David Silverman) sent me, today, a registered letter to my address (which he repeated-and its the correct address) regarding a form that was returned to him today in reference to my federal income taxes. I was asked to contact that number and reference a specific case number.....to my knowledge, my income taxes were done, and completed satisfactorily way back in February and i've not been aware to this point of any issues/problems/discrepencies.  I'm a bit worried, and slightly annoyed.  Has anyone else gotten anything resembling this same kind of call?

Omg. The same person called me, saying there's some case involving my dad, with a huge sum of money, and it didn't seem to matter that the addresses he said we supposedly lived under weren't true, and my day never worked for some company he mentioned, plus my dad has a different name. He said that my dad should probably have an attorney when the case gets to the court. And my dad doesn't even know English. I didn't know what to say, I'm only 16 and I freaked out and now I'm crying in my room.
Do you guys think it's something to worry about? Is it serious? Or is it just a scam?

A person calling himself Bernard Segal call today 3/12/2012 at 11:55 asking for my son.  When I told him he was unavialable he said he was contacting him because someone had a judgement againest him and wanted to sedale out of court. A legal mater should not have been discussted with me. I feel this is a prank, someone trying to money on the sly.

I also have received a call from CRS concerning an old debt. The gentlemen I spoke with was very nice and he explained to me the nature of his call. He stated the companies sell the old debt for pennies on a dollar to the collection agencies, in turn these agencies buy the debts in order to collect the payments. I explained to him under the CA law any revolving accounts such as old credit cards that the company has charged off can not be collected after 4 years. Once I explained that to him, he backed off. He advise me to get a copy of my credit report and work on getting that charge off of my report. I thank him for his call and I told him I will work on doing just that.

My suggestion to those who are receiving these type of calls go online and check your state's collection policy concerning the limit of time that a creditor can collect on an old debt. Like I mentioned before for CA its 4 years...for other states it might be 4 to 6 or 7 years.  But make sure you check.

Said that I had talked with someone and they would like to settle this out of court [Case GA vs "Me"].
So I said I wanted a copy of the complaint and what address I was at...
At that point he said that wasn't available because they had already started the "case."
I told them I'd see them in court.
I also told them I knew this was a scam.
