Anyone that STEALS from me is a scammer.  These scammers keep calling my cell phone without any number showing on the caller ID forcing me to incur cell phone charges BEFORE I find out that they are a scammer, not a customer. ----------

Bottom line is that they are spending MY money, WITHOUT my permission, to sell THEIR product.  That is the classic definition of a THIEF.  And if they will STEAL from me BEFORE I send them the form, it is a slam dunk that they WILL STEAL from me AFTER I fill out their form. ----------

And look where the form is coming from!  DirectbusinessLOAN.com.  These people are out to steal every penny they can from you eventually bankrupting you. ----------

Anyone that fills out the form is a sucker and is asking for problems like identity theft and the like.

"These guys" sound like close friends of "DrWho". Selling aggressively should not have to mean deceptively. The OP's report describes an implication that you're in danger of losing your claim until you hire another bunch of lawyers as middlemen to the litigants' counsel. That kind of thing would spark TCPA claims if the cold calls went to consumers and not a business. Viewed from the sidelines, if you cannot find anyone within your company who is able to understand English and fill in form blanks, maybe running a business is just not for you. This is how the Bowling Proprietors' Association of America put it:

    "Please note that there are specialized companies or settlement negotiators that may offer to fill out and file your claim in return for a percentage of the value of your claim. Before you agree to that, however, take a look at the claim form and the kind of information you will need to provide. It may be that the process is very easy for you and you will not have to hire a settlement negotiator."

These are people who wax flooring and spray the insides of ugly rental shoes every day, not exactly high finance, and *they* think you can handle your own claim papers.

The claim forms have yet to be released since the big-box plaintiffs are still arguing over what they view as unfair settlement terms. Class members may not get that decision, never mind a form, until Spring 2014 or later, as reported below.

Seriously, what's the hurry? How you get paid won't alter what the judge says. This strikes me as a Laziness Tax riding on the billable hour cash cow which class actions tend to become. CoinStar takes an obscene ten percent of what's in your piggy banks and Mason jars. You're going to give up over one-third of your award to people who were *not harmed* by a creditor? This whole thing is over burdensome interchange fees, yes? Those single-digit charges for the privilege of moving money electronically? Can we say "penny-wise, pound-foolish"?

I called the number at the bottom of the page at www.paymentcardsettlement.com.  Apparently a real claim form will be automatically sent to you to file your own claim once it is available as long as you did not exclude yourself from the claim.  The (merchant claim center) will fill out the real claim form for you for 35% of your refund.  That is possibly why they are trying so hard to get me to send it in.  I almost sent back the form that they said I must fill out but I had second thoughts when they wanted my mobile phone number.  So I did some research and decided to wait for the real claim form in the mail.  I want to keep my 35%

You must file a claim to get money from the settlement, the scam part is the fact that they are suggesting you must file through them.  They are a 3rd party filing company, kind of like hiring an accountant instead of doing your taxes yourself, they will take 35 percent of your recovered amount for fileing for you.  You may use them if you like but you do not have to.

They are offering a legit sercie but they are overcharging.  Thier contract say they will take 35 percent of what you get back. I work for a company that does the same thing but only charges 25 percent.  Here is the main difference.  you DO NOT HAVE TO USE A RECOVERY SERVICE, you may file a claim yourself if you want.  You do not need to use our company and you don't need to use them.  you must file a claim but you don't have to pay someone 35 percent to do it if they say you must use them they are lying.

Clearly they are fishing. For some reason they think I am a doctor. My university department (not patient care) has never accepted credit card or even cash transactions. Same stuff about the $7.25 billion settlement. According to a NYTimes article, most small companies are not eligible for a variety of reasons anyway.

Hi. Got the same "Mark" or "Sharla" calling from the Merchant Services Claim Center.  I left my  my fax # and they faxed over 2 copies of "their" form to file for settlement monies.  According to their forms, they are Settlement Recovery Group and the form authorizes them to assist you in getting your company's portion of the settlement.  Their fee is 35% of what you get according to the paperwork.  So...they seem legit are just trying to get in on the winnings.  The official website for the settlement is www.paymentcarsettlement.com.
This is a legit website and has nothing to do with "Mark or Sharla".

We also received a call from the Merchant Claim Center, and we thoroughly checked them out before deciding to move forward with them.  From our research, what they are doing is completely legitimate.  They did not offer to send out the "official settlement claim form" to us.  What they sent us is a "claim settlement agreement" that gives permission to a very experienced settlement recovery agency to work with the claim settlement administrator (on your behalf) when the settlement is finally approved by the court.  They are doing this for no up-front cost in exchange for a contingency fee to be paid out of any money they help you recover from the settlement.  The statement that you "must file a claim" in order to get any money from this settlement is absolutely correct.  This is clearly stated on the second page of the legal notice that was mailed directly to every merchant last year by the federal court.  The statement that "your settlement payment payment is NOT automatic" is also correct, and is clearly stated on the second page of the legal notice that every merchant was sent by the federal court last year as well.  Bottom line, these guys are very motivated to recover as much money as they possibly can from this settlement for you because they get a piece of what is recovered.  Through our research, we found out that the settlement recovery agency they are promoting has been doing settlement recovery for many years.  Bottom line, this isn't their first settlement and these guys are experts at recovering the maximum possible from major legal settlements.  So, you can try to get more money back on your own - or you can let these experts do it for you on a contingency basis.  I agree that these guys are aggressive in their marketing, but they are definitely NOT a scam.

Got the same call and rap.  Was suspicious because caller id showed blocked/unknown which is bogus.  Checked with the notice I received about this a while back and then checked on line.  The SETTLEMENT is legit but "Mark" claimed if I didn't fill out the claim form NOW I wouldn't get anything.  Well, wouldn't ya know, the real settlement website is:  www.paymentcardsettlement.com and, since the court won't approve this IF it goes through til 9/12/13, there is no claim form yet.  When it's available it will be posted on the real settlement site.  F******g scammers!!!

I also received several calls from both 'Mark' and 'Seth', at Merchant (something or other) the first week of July.  Due to interference, I could not clearly make out the name of the company, but the gist of the messages was the same as jlv's.  Since the name was similar to my bank processing system, I called them back but didn't understand a lot of what they were talking about, although I do recall getting a postcard concerning a civil suit on the same subject.    I received email with attached forms from "seth@merchantclaimcenter.com", but as I couldn't open them and don't have fax or a smart phone, they had to send them to me again as mail.  I did get a PO office address for sending the forms back but don't have it on my desk right at the moment.

I've since received a couple of more emails 'updating' me on the case.

"Mark over at the Merchant Claim Center" called about a Visa/Mastercard class action settlement of $7.25 billion.  He said I can fill out a simple one-page form to initiate my claim - but I "must" file the claim because my settlement payment is not automatic.  No cost to file claim, but I "must" file before the deadline.  If I call him at 800-256-5161, ext 713 he can re-send the simple form that I "must" fill out.
