Some of you people are so dumb. They are required to call so all you have to do answer the phone say that you will pay the last day of the month and get the phone call over. That's probability 1 minute a month you spend with the mortgage company combined for 12 minutes a year. Compare that to the time many of you spend bitching and complaining on this website. If your not making the payment by the first then it's late and you get a phone call. Tough s*** your not getting a late fee so get off your high horse and stop being so petty I mean if you can't make the payment by the first and they Arnt charging you the late fee why are you all so bent out of shape about it. And to the guy who spend 3 hours typing out a story get a life and if you just spent that time working maybe you could make the payment instead of complaining about it.

I just got a call from this number at 2:03 PM.  When I answered the call, I paused for a second, to see if it was a recording, I said, "Yeah..." and was disconnected after a few seconds.  The caller ID read 800 Service.

Maybe because they have a outbound call center and a incoming call center that closes at different times. And wouldent it be easier to make sure everything was going fine with your payment than risking it by being to lazy to pick up the phone and talk to them for 2 minutes.

I didn't answer because I didn't know the number. The guy in the voicemail said it was US Bank about my mortgage. It scared me because I've never missed or even late on my mortgage to them. He also said to call between 8 AM and 8 PM CENTRAL time. But that meant they were calling me at 10 central time and it was even after 8 PM in MY time zone. What gives??? Don't wanna call them back.

US Bank Home Mortgage

Trying to get us to refinance our mortgage.  We have a very low fixed rate and they'd like to sell us a new adjustable loan. No thanks!  

We're on the National Do Not Call list, but I guess that doesn't matter.  Sick of these people calling all the time. Especially during the day.  I work from home.

I got a scary letter from "Default Counceling" at USBank.  I have autopayment set up from my bank and have paid on the same day every month for 5 years running now.   They are trying to spin a story about being past due, and are very careful to say "past due" and not to say "late" or overdue.  FNMA mortgage does not allow fees or penalties until 15 days after the payment date.  The make a good deal of money on float, so anything they can do to try and get you to pay earlier makes them more money.  I pay consistently on the 8th of every month I am not late until the 15th.  Scaring me and a million others into paying a few days earlier means millions of dollars to them.  If I were a more vindictive person I would change my payment date to the 12th, just for annoying me.

This is a scam. I have a mortgage with US Bank that has never been late. When I called these people back they asked for my SS#. When I told them I do not give that out over the phone but would be happy to give the house address (they have the mortgage, they have the address) they hung up. Highly doubt this is even US Bank. Just because they have official sounding phone prompts means nothing, I could program that phone system in 20 minutes.

I've read web notes from others (including when they called me 2013Jan08 about 7:30pm CST)
that they identify themselves by trying to say they're working with USBank mortgages;
which is probably their way of saying "we know you have a home mortgage with USBank"
--I'm sure information on all mortgages in the U.S. are somehow accessible on the web.

In past years (between 2000 and 2005), I've spent many hours on the phone with that
company; they are a hard-sell (i.e. very pushy) company for trying to get home owners
to refinance--they always try to get you to refinance so they can make a commission
on the financial transaction--even though it may NOT be in the home-owners' best financial interest.
Personally, I would not deal with such a company; because, they may be what are called "brokers"
in the "home mortgage" industry--which I think are always far less reputable than dealing
directly with a bank.

Got a call at 7pm from US Bank and they left message. They also called my work at
8pm and left a message! I've had a mortgage with them for a year and a half and never been late or past the grace period so I'm confused why the harassing call. I'll call them tomorrow to find out why they are calling.

We have received two calls from them. They left a brief message on my cell and then called our home number but did not leave a message. We have been doing business with US Bank since 2004 and have never had any issues. Our home loan has been with them since 2005 and we refinanced our home with them once again 3 months ago. We have never ever missed nor made a late payment. I am more than disturbed by this phone call. At any rate, I am going to contact our loan officer at US Bank, perhaps she may have some knowledge of these phone calls or do a little research from the inside.

Repeated calls from this 800 Service.  Started receiving phone calls after I mistakenly did not sign a check and it was returned to me for signatue, making a mortgage delinquency FOR THE FIRST TIME IN 8 YEARS!  Now, if my check is not there by the 1st (even though the grace period is until the 15th of the month), I get these nasty phone calls.  I assume my name and number were given to this agency by my mortgage company, U S Bank.  I think I will start with US Bank, make a formal complaint, then contact the States Attorneys Office in the state of my residence.  These phone calls are nothing but harrassment and cannot and will not be tolerated.

I have to thank you for all that information. I think people should really inform themselves. I am going to do some more research myself. I also had an accident. I had 3/4 of my spinal cord crushed in my neck. Almost leaving me a paralyzed. I have had two surgeries last year. Leaving me with nerve damage and lots of pain. I haven't worked in over two years. I had an agency by the name of Merchant Credit calling my neighbors, and asking them questions, and to give a message to me. I was furious. My neighbor was very irate, and told me to keep my ***** to myself. That if I didn't I would be sorry. My neighbor is a very crazy man. I don't think they should be calling my neighbors. What can I do?

We get calls from this number all the time.  About a year ago, I answered, and they wanted me to "enjoy a lower interest rate," which was HIGHER than the one we had .... WITH THEM!!  Since we *are* their customers, I guess we can't make them stop calling ... but we can sure refuse to answer!

Today they left this message: "This message is for [our names].  This is US Bank Home Mortgage.  Please return this call at 800-365-7900, Monday-Friday, 8:00 am - 8:00 pm."  Uh, no!

I have a set of practical suggestions that should prove effective; these cover calls from telemarketing companies that use automatic-dialers to continuously call a list of numbers.  These may display "800 SERVICES."  

Here are a few tips to manage these calls.  I tried option #3 - I added my phone to the National Do Not Call Registry.  It is very quick and easy.
    
1. If you are receiving silent or hang up calls between 8 a.m. and 9 p.m., these calls are usually from telemarketers, collection agencies, or other types of business calls using automated dialers. Many of these calls will display on Caller ID as "UNKNOWN", "OUT OF AREA" or "800 SERVICES." Companies use automatic-dialers to continuously call a list of numbers. The reason there is no one on the other line when you answer the call is because the companies may not have enough operators to answer every call the computer dials. These calls may be annoying but most are legal and legitimate attempts for companies to sell their products or to make contact to customers for other business purposes.

2. You may choose to stay on the line and wait for a representative from the telemarketing company to come on the line. When a live person comes on the line, you can decide if you are interested in the offer. If you are not interested and do not want future calls from that business, you can ask the representative to remove you from their calling lists. Since there may be multiple businesses contacting you, you may need to be removed from numerous calling lists before noticing a decrease in the number of telemarketing calls received.

3. You may choose to have your name added to the National Do Not Call Registry to reduce the number of telemarketing calls you receive from national companies by calling 1-888-382-1222 or via the Internet at www.donotcall.gov. Certain calls are exempt from the National Do Not Call List. For example; political organizations, charities, telephone surveyors or companies with which you have an existing business relationship can legally call you even if you have registered on the National Do Not Call List. For more information contact the FTC at www.ftc.gov.

Received a short message on my answering machine.  The caller just said my very young daughters name and hung up.  The way he said her name was evil.  I called the number and it is a US Bank Collections and Foreclosure department.  Funny.  My loan with them is brand new and I have no reason to be contacted by them.  Please post if you are having a similar experience.

Debt Collectors ? Collection Agency's do NOT fall under Do NOT Call registry, as they are not telemarketers.  However, they do constantly violate other Federal Laws, because us American's don't know the laws to protect us.  They are counting on that.  

- Federal Law says you don't have an obligation to Collection Agencies or Debt Collectors; you can send them a written letter and they cannot contact you after that.   This includes Attorney's in state's other than your state of residence.  The only Attorney's that can sue you, have to be licensed in your resident state.

A word of caution:  Some Law Firms do have Firms in other states, and Lawyers licensed in other states, so you have to do a little research before sending a Cease & Desist (Do Not Call & Go Away letter) to make sure they aren't in your resident state or you're likely to get sued by these #%#&*@!#%&@$^*.  

Once a debt collector makes contact with you, they also have to contact you within 5 days after the first phone call, letter etc., and give you validation/proof or judgment of the debt.  You are not required to ask for it.   They never do this!!!!

This law is known as the Fair Debt Collector Practices Act.  You can get it at FTC.gov; as well as other Consumer Protection Laws.

Most collection agencies, purchase your delinquent debt for pennies on the dollar.  Guess what? It is no longer your debt!!!  You don't have any agreement/contract with the debt collector or collection agency.  Your only agreement/contract was with the original creditor.

Do NOT agree to any payment arrangements, or you'll be creating an agreement/contract, where upon initial contact by the Debt Collector, one didn't exist.  The collection agencies are counting on you not knowing this little bit of information.  

The best advice I can give you is, do NOT talk to these idiots - they will leave you in a frustrated heap on the floor.  They lie, and will tell you whatever they need, in order to get you to commit to paying them.

The lies are illegal, but they honestly don't care, they're probably on commission for how much they collect from you and others like you.  

If you do answer the phone, do NOT give out your employer, social security #, DL #, Credit Card and/or Bank information, or any personal information.  Tell them to send you a written statement & you'll respond. Then hang up.  When you get that statement, google, Fair Debt Collection Practices Act and you'll probably find a letter you can send them   Or:  send the letter I?ve enclosed that I use.  Sign and mail that letter Certified Mail, so you have a signature and confirmation of delivery!!!

In the Law of Novation: if a debt is purchased by another, for that to be a legal owed obligation, a new contract / agreement has to be written and signed by all parties.  Google Law of Novation and read up!!!

No I am not an attorney, just a well knowledged, educated consumer.  I have spent the past 2 years studying various Federal Consumer Protection Laws.  

I wasn't just satisfied knowing I could send a letter to a Collection Agency/Debt Collector and they had to go away.  I read that in the Fair Debt Collector practices Act law;  I needed to know why, what law tells me the reason why I can.

Everything I have typed, I have learned basically on my own through reading, studying, printing out and binding the laws and underlining/highlighting them.  Not to mention the knowledge I have gained on my own fighting two lawsuits without an Attorney.

I was sued by a Collection Agency, and waiting for a Court date. The Collection Agency Attorney, sent us a letter willing to dismiss with prejudice our lawsuit, if I dismiss our Cross/Counter Claim for Fair Debt Collector Practices Act violations.  Oh, I forgot to mention, we do not have an Attorney representing us; and I have not had any legal experience, in the past whatsoever.

I have read / printed & bound, my State's Rules of Civil Procedure and Rules of Civil Procedure - Evidence.  I catch Attorneys on violations of State Rules of Civil Procedure all the time.  And our Judge's let them get away with it.

And for those of you who say pay up and quit being a deadbeat; it appears that you have never had your life turned upside down, because a good job, not high paying by any means, but a supposed secure job, got your hours cut by 3/4.  

And then a couple years later, as you are just recovering, you lose that job.  And when you are in your 50's, a new job is not so easy to come by.  And when that happens, then what?  

Or what about a major illness, guess you've never had that either - too bad.  Maybe if you did, you'd understand why and how people end up getting in financial straights. Not because they chose to, or decided they were going to find loopholes to get out of paying obligations etc.

What if the money isn't there to pay these debts to begin with?  We've been barely able to pay a mortgage, let alone credit cards etc. It's easy to tell someone else what to do.  I hope someday, something throws your secure little world off its axis, and you find yourself in the very situation as some of us here. Maybe then you'd learn it isn't such a cut/dry situation.

Oh, we've struggled.  And the job last hasn't exactly been replaced.  We're still behind in our Mortgage and trying to catch up, as with our other legal obligations.  I can't work because of various health conditions, or I would, including a part time job at least.  My husband started his own company with the tools of the trade, and now contracts for copier, computer, IT technical jobs as he has a computer science degree, and has years of experience in the others, especially the wide format copier / printers / computers.

People, please read the Fair Debt Collector Practices Act; if a Debt Collector violates any one harrassment or other law in there; Federal Laws says you can sue them for $1,000.00 per violation.  Do it, and then THEY can pay off YOUR obligations!!!  

Again I am not an Attorney - but have learned these by my own experiences.  There are Attorneys you could talk to, and I would, if any violations of the laws have occured in your circumstances.  I am posting this strictly to help others maybe have a piece of mind, if they are up all night worrying about financial problems, and sick to their stomach in worry as I have been, and still are in some ways. I am again just a well informed, knowledgable consumer, who has spent hours studying the laws, because I had no where else to turn for help.  If anything I have written, causes you questions, please seek the advice of an Attorney.

Certain situations such as Mortgages and Car Payment loans usually do not apply here; so you may need to seek the advice of a Lawyer for your individual situation.
