Received a call on Mother's Day at 5:00 pm.  No one on the other end.  I kept the line open for over a minute and still no one came on the line. The nerve calling at dinner time on a holiday and then not talking!

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

They've called more than once with such horrible english I always have them repeat what they've said. They ask for a lady that I've never heard of, yet they continue to call everyday. So finally one day they asked for the person and I gave it to my husband (very manly sounding) he said what do you want? They continued with all the "personal"info, who and what was owed. Then got mad when he said do I sound like a Amelia to you? They threatened him for pretending to be "Amelia"  He never said he was her, he only said hello what do you want. Lol.

They call my business after hours and ask me to if I have an account with AT&T.  I do not.  Then they say they will make sure I receive no more calls.  Then, they ask me what the number was that they called.

Getting frequent calls from this number. Its an auto dial I think, when my machine (I filter calls) picks up it hangs up. They leave zero info. Persistant. I dont deal with AT&T and have outstanding debt that isnt paid off or on payment regular as clockwork. I do have an exhusband for sale, I have change for a five...

They call my number everyday sometimes twice a day. Leaving message on answering machine for a debt.. I am getting different phone numbers. 765-313-4020, 202-888-2764 (AICR) showed up and 800-399-2019.
Bay Area Credit Service or State Area Credit Service. Wish they would just stop calling.

Very suspicious about the call from this number saying he was a collection agency called "Bay Area Collections" and AT&T had transferred our account to his company and we owed a specific amount.  There was NO WAY, of course, that I was going to pay anything over the phone with a credit card.  Checked with AT&T and we don't owe them this amount of money.  The guy was amazingly persistent - wouldn't stop talking - gave me his number and said to go ahead and call AT&T and when would I be getting back to him?  !!

If they are still calling you at work, that IS against the law. My sister in law had a collection company calling her at work after a divorce. She continuously told them not to call her at work. One day after one of the calls she was so upset, she wasn't paying attention to her work and ended up injuring herself. Thank goodness it was too serious, but it was serious enough that she sued them and got enough to put a nice down payment on a home she bought thanks to the collection agency.

Just received 2 calls in a row from this 1-800-399-2019 number on my land line before 8:00 am.  Did not answer or let go to voice mail.  Called back, said it was some kind of credit service in an Indian or Pakistan type accent.  Every website I checked said this number is a debt collector, many said for AT&T.  Do not have an AT&T account now.  Have not had one in over 10 years and all those bills were all paid.  However, did have a long running dispute with them about charges on my bill which I thought was straightened out in my favor.  Wonder if they are trying to drudge that up again!

I've had my phone number for over 3 years. I'm an add on phone to my husband's phone. He's had an account in good standing with ATT for over 7yrs. Today I received a call from this number asking for a person who was neither me nor my husband. She was foreign and didn't believe that I wasn't the person she was looking for. After me telling her that she called the wrong number, she asked if I knew the person she was looking for. I said no and I then told her how long I've had the number. She then spouted off an address and asked me if that was mine. Regardless I was going to say no because she didn't identify herself and I have no business with her. I hope this isn't going to be a repeat event.

Got a call from this number recently. I don't have any business with ATT or any unpaid debts. I think it's the same tele-scammer that calls me at least once everyday (Monday - Friday), usually around the same time, but with a different number each day. I don't answer, and they never leave a message. My policy is that I don't answer the phone unless it's from someone I know. Plus, I won't hear the ringer anyway ... I have the normal ringtone set to a very silent ringtone. Only friends, family and contacts have regular ringtones, so I'll hear when they call and I'll answer the phone for them. Oh, and I have any unknown numbers set to "automatic reject" so they won't even get a chance to ring my phone! I used to really hate these tele-scammers, but now I get a little satisfaction knowing I've wasted some of their time! Maybe if more people do like I do, the tele-scammers will only be wasting the time and resources of the telephone service providers, and then, maybe the service providers will take some action against them. One can hope....

Even thou you have a block number they can still get your number.  They start at 000 first and continue on down the number scale to 999 unstill they get someone to answer the phone and you say your name or your name is left is a message if you can not get to the phone.

As far as we can tell, this is a collection agency wishing to speak to the person who has the debt. Upon informing them, we have a # from someone else, who has debt, as many collectors called us, asking for the same name. I informed them of the name, asked to not call again or we would take this matter further. They asked for our #, said they were taking it off their list and they would never call again and thanked us for our time. Lets see if they actually follow through. We believe this is the way to handle it, if you are truly  not the person they are looking for

I finally figured out how to use my "rejection call" on my phone, so have blocked this caller.  Not to mention that I have a block on my phone for all telemarketer calls!  As soon as I answered this call, there was no one on the line.

800-399-2019.  I don't know these people, so I google them and the first entry caught me eye Bay Area Credit Services are scammers.  Don't give them any informatio about you. Don't even let them know who you are because they'll keep calling and fishing for money.  The best thing I did was let my supervisor know and the woman never call back again.

got a call tonight from 1-800-399-2019. Guy with accent so bad I could hardly understand his English asked to speak w/my husband. I said No. He asked if this was # for (my husband's name) I said "A" (husband's name) lives here but I am his power of attorney (which I am) and you can talk to me. What company are you calling from and in regards to what? He said Bay Credit Services, but I cannot tell you why unless you prove you are his POA. Send me a fax. I said No. You can go look it up in the county register of deeds office 'cos it's recorded. I asked where his company was located. Wouldn't say. I said you've got about 2 seconds to tell me what this is about 'cos you just called a # that is on the do not call registry. Told him I handle our finances and I have never heard of your company & have never had any dealings with your company. He said calling (my husband's name) who lived at XXXX Any street, Houston TX (He did give a house # & street name but I'm not putting that info on here) Said Sorry guy, I'm not in TX & never have lived there. You have a wrong #. About 3 mins later I called back realizing he never told me where they were located. Got another rude guy with a foreign accent. Asked for a supervisor. He put me on hold. I hung up, called back & got THE SAME GUY. I thought that was odd. I hung up again. Called back again. GOT THE SAME GUY again. Odder still. He kept asking for my husband's info. (Fat chance) Asked for last 4 of Social. I said no. Asked for last 2, I said no. Asked for last one, so I threw out a #. He said "Oh, it matches! I need the last 4 now!" Told him no, take me off his list NOW and that I was filing a complaint. Said he would remove us but might take 24-48 hrs. I told him I pity the next rep from his company that calls my house! DONT TELL THESE JERKS ANYTHING! Anyone with a brain should know when they have an area code what State it's for!
