Debt Collector
I recieved a letter from falzone collection agency stating they were collecting money from a on-line class. Which i never took the class on line never received any books. i called the company to let them know i declined to take the class, because i was no longerr with the company who told me to take a class asap in order to get paid a higher salary.  i allowed the company to take the money out of my checking account paid the debt in which i should not have. $150 every two weeks from 2009 to 2010. now that its 2013 i recieved a letter from another collection agency demanding more money. im like what the hell is happening here! i explained to them the money was given to a company back in 2009.-2010 and i will not be paying a dime more. they are being pushy!

My message was from a different number 877-630-6402, but the gentleman said his name was Alan Cross, just like someone else mentioned. Gave me the same crap about a litigation suit and that he was going to serve me if I didn't get back to him that day (called 2/8 and 2/11) at my home or place of business.  Which he never did.

Debt Collector
I am a debt collector. I am here because one of my clients owes money to my company for an auto deficiency loan and he provided a letter from Frank S Falzone and Associates stating he had paid $4600.00 to them and the account was now paid. The problem is, this is a fraudulent letter. My client got scammed and he is still in collections, even after paying the $4600.00.. I tried to verify the letter, when I called Frank S Falzone Law, they said they are not affiliated with Frank S Falzone and Associates. The letter doesn't even look legit which is why I had to verify it in the first place. There is no phone # on it, only a fax # of 716-362-8964. The address is 5140 Main Street #303-329 Williamsville NY 14221. The collectors name was Mike Shaw. Date of notice is 04/18/2011.
This really sucks. I take a lot of pride in helping people resolve their credit issues and restore pride in their credit and it's people like these that make my job harder. Again, I am a debt collector and this pisses me off!! My advice to anyone that is contacted by them is NOT TO ANSWER OR RESPOND. Check the laws in your state. SCAM!!!

Just wanted to let you know as an IT person in Network Administration and Network Security, there is a program that you can download free of charge. It is a private proxy server that encrypts any information you send over the internet. It blocks all cookies, does not store history, among other things. I use this program myself and it is one of THE most secure programs out there available for free download for public use. It does make your internet run a little bit slower, but it's not too bad.

First of all, you are full of it. I have gotten 4 calls from QAR/Atty Frank Falzone Law Firm in the last few months. When I refused to verify a social security number, the rep I talked to got very rude and cocky, but proceeded to tell me all kinds of information regarding the case number which is a complete violation of privacy. I clearly asked him to please send me any information regarding my "case" and I would review it and return their phone call when I received the mail. He then asked me if I currently lived at an address and when I said "No" he proceeded to ask me if the other address they had on file (which he gave to me) was my current living address. Now first of all, that is complete violation of the FDCPA. By law, NO debt collector is allowed to give out that information regardless of anything. They may ask you to verify your current address, but they CANNOT give you the address and THEN ask you to verify it. The other thing that they did without me verifying anything, was say a complete social security number which again, by law is ILLEGAL and is also a violation concerning the FDCPA. Upon PLENTY of research, your company is completely ILLEGAL and you are scam artists. Any debt collector comes up on Caller ID with a 1-800 number. Not a random 713 number or multiple other area codes. The REAL debt collectors also come up with the company's name, not "Unknown" or "Out of Area" I highly suggest you get your s*** together before you try to defend your b***s*** company.

The most important thing to do is to record every call you get from them. Any calls that they get from an attorney with a recoding that includes FDCPA violation, will make them wipe out the debt, as they own it, and dont want to be sued. That is their company policy. And if you want to make money off of the deal, hire an attorney, in this type of case most will work for a percentage of the award in court. Federal law is very specific, $1000 per violation weather on the same call or different calls. Even little things like using a false name- that's $1000 for you. The actual owner's name is Mike Shaw (Frank Falzone just gets a fee for letting them use his name). Anyway, Mike Shaw uses the name Mike Richards. I say make money off of them. These people make more money than you can imagine by scamming people. If enough people sue them, they will have to shut down, and that's the only way they will.

These people called my 78 yearold mother and told her they needed to talk to me immediately about a criminal matter and that if I didnt call them back to day I would have a warrent out for my arrest. Needless to say they about gave her a heart attack.  She called me crying telling me that they had all this private information on me, even knew how many kids I had and that I lived in 4 other states.  Well they had the kids right but the rest of the info they gave my mom was wrong.  They also contactedmyexmother-in-law with the same information.  I betmy ex's tongue was a wagging over this, but any how I am also not a dead beat.  I have always paid my bills.  These people and the slanderous allegations will be going to court with me if theydo not send a letter of apology for the error on their part.  They had transposed the last 2 digits of my SS#

These clowns called me demanding to speak to "Carlos" and I told them they had the wrong number. The moron said he KNEW I was Carlos and to quit with the BS. Well I'm not Carlos, don't know Carlos, and could not care less so I hung up. The idiot called me back screaming about how I was going to be very sorry I hung up and I would be put in jail by the end of the day. So I looked up the number and found out about Frank Falzone and his merry group of thugs. We have become very good friends now. I call these a**holes all the time from every pay-phone I see. When talking to me they are not bothering others. It is fantastic entertainment and a good way to relieve stress. I highly recommend it. Remember it COSTS them money when you call. It ties up a line, and it really pisses them off. Now several friends are doing it as well. One guy even bought a throw away type cheap cell phone to use to hassle them with. He says calling the 800 number is free from the cell which is an added bonus!
Even if you do owe a debt then you should NEVER pay these jerks. Not a DIME! Make them verify EVERYTHING which more than likely they will not be able to do. They can't have you jailed, they can't garnish a paycheck without a court order and they can't do that without a hearing, PERIOD. You do NOT have to pay a debt after 4 years in most states and while yes that is not ethical it is the law. If you pay these jerks then you reset the clock and then they can get a judgement. If you don't pay then they are pretty much screwed. Let them take you to court, demand proof of the debt, they can't, and when you win, which you will, file a counter claim. You will win but you won't be able to collect cause Frankie does not pay his debts. He is a deadbeat debtor! Frankie is a LOOSER and so is anyone working for him.

a lady kept calling me from that 716 number and then  she left a really urgent one. She said its regarding my moms social security number. i called and a man picked up saying he was with falzone law associates. i told him to stop calling this number and since he has this number to mail papers regarding whatever this was about to the associated number. he told me i could talk right now about what it was about. i told him just to mail it to me. he said we'll have to make a note that you declined to speak with there representative. i told him that was fine i just want him to mail me info. he said he wouldnt and to have my lawyer call him. the said to have a happy holiday and hung up on me -- oh, and when i asked him about the company all he said was they are not telemarketers or anything like at, the are an "accredited law firm"  --- so happy to have the internet and to find out that other people were getting calls too.and that it's a scam (suspected it was) that budhibbs.com website is very informative

Yea those people called my sister who lives in Tennessee asking about me.  Of course she did not volunteer any info.  They went as far to ask her if she would pass a message to me, she said no.  It continued even further that they called my other sister in Florida leaving a voicemail on her home phone to call them about me.  Then they finally called me and left a message on my voicemail.  If that's not harassment what is?  So I called them because I wanted to find out what the call was about.  They told me and I asked them why they were calling every one else about me.  The guys name was Pedro and he said it was a last resort to do that.  I told him not to call anyone else about my financial information.  So my family is not involved and not to call anyone else.  Then he hung up.  This is not legal and collectors are legally to make one call a day, and that is all.

On October 15, 2009,I will be sending out a large amount of paperwork to the New York State Attorney General's office. An investigation should begin soon after. If this company calls you- RECORD ALL CALLS! If they provide your personal information to any person other than yourself, or in some states, your spouse, this is a criminal act called third party disclosure. ANY THREATS including wage garnishment, seizure of accounts and attaching leins to your home or car are criminal acts. Even if they use the word "potential", this would be the case because they never sue anyone- ever. If you had a payday loan and they claim you committed fraud by closing your bank account and you are looking at criminal charges- again- criminal. They buy debt for 1 cent to 4 cents on the dollar and again- they never sue anyone. Every violation of the FDCPA is punishable by $1000 each. 10 violations on 1 call equals $10,000 for you. 50 violations on 50 calls equals $50,000 for you. Do yourself a favor. Record all of the calls made to you by them- you do not have to inform them that they are being recorded- and then call your own State Attorney General's office as well as the NYS Attorney General's Office, Consumer Frauds division at 1-800-771-7755.

To all of you...especially "you should all know" and "employee". Firs and foremost knows the rights you have and the rights that debt collectors have in your state. In Texas, debt collectors have 4 years from the date the debt became delinquent in order to pursue any type of action against you (i.e. sending notices, calling you, putting it on your credit report, taking you to court, etc.) Yes you are forever responsible for the debts you owe, they do not go away, however, after the 4 years statue is passed they can longer contact you, try to file a lawsuit, or put it on your report if it has never been put on there, or if it was on there and has fallen off after so many years. You can look on the web for your states statutes. Oh and for "you all should know" people can't just out of the blue get a judgment against you. They have to serve you with proper court paperwork (or a certified letter) stating they are suing you.You have the right to be present in court to state your case to the judge before a judgment is put against you. People learn your rights so that you can fight idiots like these scam artists and so many others who take your ignorance of the law as a way to bilk you for money.

Look, these goofs called my wife as well.  Without going into a long story, she was gainfully employed, paid her bills, life was good.  (Keep in mind just my girlfriend at the time).

She became totally disabled in 2004 and judged so by a court in Georgia.  She can't pay a few of her old bills with no income, so on occassion we have to explain this to the few collection agencies like Mr. Gambino's, I mean, Mr. Falzone's.

Let me explain a few things as well:

1.  Don't fret when some goof like "employee" starts threatening or shaming you.  Things happen in life you don't want to, and sometimes bad decisions or bad circumstances (disability for example) take control.  Employee can talk all he wants, but let me clear it up for him as well:  HE DOESN'T HAVE A HIGH EDUCATION OR MORAL POSITION, because no one willingly works collections unless they don't have another option.  It's why you typically get a call from a foreigner in these cases.
2. If you can't pay, and simply won't, just stop the calls.  Also, follow up on your threat to file with the attorney general.

Here is a letter that works, and make sure you send it certified mail and keep the receipt:

Re:     Fill in Account, etc. here

Dear Sirs:

(Explanation if you choose here.)

Pursuant to my rights under federal debt collection laws, I am requesting that you cease and desist communication with me, as well as my family, friends  and neighbors, in relation to this and all other alleged debts you claim I owe.

You are hereby notified that if you do not comply with this request, I will immediately file a complaint with the Federal Trade Commission and the New York Attorney General’s office. Civil and criminal claims will be pursued.

Sincerely,

That's pretty judgemental of those who are saying bad things about us who are receiving these calls.  You don't know our situations, and obviously haven't fallen on hard times like millions of others -- good for you.  Life was happening along for many of us -- and then it stopped.  Jobs were lost, or wages were cut, and other expenses were increased such as gas for our cars to get us to work or to seek new jobs out.  Don't lump everyone together in one place -- because it's all different.  We pay our taxes, we pay our bills to our best ability -- but when you contact a creditor before you're delinquent and let them know you're having issues and want to work with them and they tell you too bad, or I don't care if we force you into bankruptcy, or don't feed your kids then -- if you walk away from that debt, that creditor deserves it!  Most of them were bailed out by the government in the first place -- so in my mind, they got paid and are just being greedy!!!

Just had the pleasure of talking to these dopes - they even called my 80 year old mother and gave her the impression my son had been in an accident and needed to get in touch with me.  I have lived in the same house for over 20 years, had the same phone number and address.  In a panic my mother gave them what she thought was my cell phone number but was really my teenage daughters who they managed to freak out.  After calling the NH Attorney General's office and learning that this is a company well known for unfair debt credit and collection practices I called them myself.  It appears they must buy up old lists of outstanding debt somewhere and think their intimidation tactics will get people to pay debts that are very old.  Bottom line, when I told them I had already called and reported them they were not too happy with me, and they weren't even looking for me but one of my sons.  If they call just report them right away and tell them you have done so.

I get approximately five calls a week from this company over the past three years.  The call is for someone that does not live in this household and I have no idea who they are calling about.  I have called at least eight times asking them to stop harassing me.  Each time, they promise to remove my number and the very next day they call again.

If anyone can advise how to get them to stop calling me, PLEASE let me know!

It's amazing how people can lie in order to justify in their mind that they are being scammed, if these people are calling you about money you owe and can provide your ssn, account info that you owe on such as dates which the delinquent account was opened on, date the last payment was made, and even the account #..... What did they do just happen to make up the correct numbers. Because of you people who refuse to pay their debts evryone else in the country gets to pay higher interest rates. It must be nice having the entire country paying your way!!

I received a call from a gentleman requesting  the office fax #.  I gave the man the number and he started going into detail about what was being faxed and who it was for.  I asked for his name and the company he was calling with he told me his name was Richard Aiello and that he was with Falzone Law Assoc.  I had calls coming in and told him I had given him the info he requested and hung up.  He called right back asking me if I had hung up on him I said yes I was busy and hung up again.  He called back again and I hung up again.  He called right back yelling at me to "put someone else on the phone right now, to do as I was told and do it now that I was only a secretary"  I told him no to talk to me that way and that he better not call back that he was harrassing me and hung up again.  I received yet another call from another individual from Falzone asking for the same employee I told him about the phone calls prior to his and he hung up on me.  I then received a call on my personal cell phone!  I told the guy who called Brian Swain (who identified himsself as working for Falzone Law) that I was not who they were looking for and he wanted my personal info I refused to give it to him and he told me I was not giving it up because I was chicken and that because I was a female he would continue to call me if he wanted to.  I told him to remove my number from the database and not to call me again.  I received another call on my cell phone just minutes later the same guy!  He asked if I was the person they were looking for and I said no and asked who was calling he said the same person I had just talked to and would I have her contact his office I told him no and that I didn't appreciate the phone call and the way he had talked to me.  He asked "why because I called you chicken, big deal".  I again told him to remove my # he said fine and hung up.  Now mind you they have been told that employees are not allowed personal phone calls, I received another call at approx 9 am on 5/18/09 from Richard asking for the employee again I said I wasn't her and he told me again to "do as I am  told and put them on the line"  I laughed at him and he put me on hold.. I spoke to my attorney and am filing charges with the BBB and the attorney general.  These guys are a joke and you're right they try to bully you.  Too bad I grew up in a law enforcement household and they don't scare me, they have overstepped many of the collection laws.  I would love to see them shut down
