Well, I guess those @ ERC who can read at least at aa 5th grade level really liked my posts, as I've gone from getting called once every 10 days, to daily calls, now to TWICE daily calls.  I'm not so sure they got the not so small tidbit their calls are actually forwarded elsewhere (non-emergency numbers only).

Lamet's Sept 2009 in-depth post always starts to give me hope that the plrthora of agencies that tally complaints about bottom-feeders, and all the numbers we can call, letters we can write, what awards can be won in a lawsuit, in a few minutes I come back to the reality of it's been 2-3 years since his post, and it's unlikely that ERC has faced any significant sanctions, or paid out 1/5 of their networth, and I havem't come across any news of a class action lawsuit against them.

So , let's consider what the power of the internet can do.  Instead of spending your quarter calling YOUR attorney General (AG), or spending YOUR time filling out more forms on your own time, consider the following:

What if the masses who hane had enough of ERC and all their dba's and flaunting the law did the following- tens of thousands of people all had ERC's phone calls FORWARDED to a non-emergency nimber of a bigger fish in all our "little" states's ponds. As an example, from just one person in one state, the ATTORNEY GENERAL's office (non-emergency line) keeps getting multiple daily calls from{{{RC.  Multiply that by several thousand in each state that ALL the AGs' offices are bombarded by ERC's illegal tactics. Maybe then someone with clout would fulfill Lamet's dream of ERC getting their just rewards !  The icing on the cake is thar ERC 's actions would NOW be their own undoing via the power of the people NOW using the internet to pass the ideas along. The power of the pen has seen its day gone bye.  Be creative, and don't use emergency numbers or hospitals, etc..  The targets are bigger fish with clout getting woken up by ERC's own n calls!  Good luck to all!

 I'd like to thank all the 2009 posters with all their great advice and investigative work.
Unfortunately here we are several years later, and ERC is still up and running fuLl steam ahead.  I. Don't know if they have incurred any sanctions. Certtainly nonthing that has slowef them down.  I do believe that going through all the prper channels with all the forms and hoops to jump through will eventually get noticed. The cynic in me says it'll probably be 2-3 presidents later.

Neither will the inane ponderings, " but my phone is registered with DNC, so why do they keep calling?". Duh (sorry, same ole story).  Because DNC only works with companys that play by the rules.

ERC does NOT care about rules or laws. They also know enough about the law and its weaknesses, as in not much of a bite (guess Feds don't floss, or maybe gon gives them a poor dental plan, or maybe they exist mainly in name to appease the populous). There is no logical way the DNC feds don't know who's behind ERC, where Directors live, how much and WHERE are all their assests, and have not gone after them.  So much for elected leadership being for the 'people'.  In most areas of the US these days, it seems like money talks and everyone else walks.

I will have to check the link in an earlier post about what can be done to stop these bottom dwellers.  Who knows, it might work, unfortunately most don't.

LOL, little do they know where their calls have been  forwarded to! BTW, if you do forward your calls to a government or law enforcement agency, make sure it is to a NON-EMERGENCY number. Get creative but be smart about it. And do NOT call ERC back asking them to stop calling, because they know. The reality is, unless they tick off someone high up in government, they are infinetly more likely to gain some pittance of a collectiol right or wrong (deception of the elderly), versus any arm of the DNC registry putting a stop to them = 'most posterior orifices'.  Posterior means behind, orifice is a hole. Now put the 2 together and it re ally seems to describe ERC and their tactics.  ERC anti-fan club member. ;0)ortunateely ------------------------------

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

Sue's a LIAR!

She's employed by LVNV Funding - they acquired the account after charge off.  Her statements are hearsay and blatantly false, yet they plead as true in court filings.  This is just another example of lying and using the courts to extort money from consumers.  Sue Argentieri should face criminal prosecution for lying on court papers.

All of these bottom-feeders started from the same mold, Sherman/Alegis out of Houston was originally started by Frank S. Russo, Tony M. Ettinger, Thomas E. Upton, Samuel Bergman and Richard Dunn all of Houston, Texas. They purchased old debts for pennies, and then set up collection agencies to collect on them at inflated prices.

As with most bottom-feeders, they have had to resort to placing all accounts on consumer credit reports, inflate the balances and demand settlements. Alegis became Sherman, which became LVNV and now Resurgent and Ventus are all in the bottom-feeder business. They do file lawsuits, most with bogus affidavits and pleadings. They use under-educated employees such as Allison Moon of Greenville, SC to sign affidavits where she lies about the authenticity of accounts (see ?Allison Moon is a Liar? below) in their attempts to give credibility to their bogus pleadings. The problem with liars like Allison B. Moon is she makes statements known to be false. Her swearing is nothing more than hearsay and an attempt to defraud consumers out of monies they may not legally owe, not to mention the fraud she and her organizations bring into the courts. Consumers dealing with these bogus filings and affidavits are urged to challenge their validity in order to avoid becoming another victim to their scam and being ripped off.

You are further urged to go after these bottom-feeders for the lies they place on your credit reports. Under provisions of the federal law, the Fair Credit Reporting Act (FCRA) any item placed upon your credit bureau reports MUST be ?accurate.? In my experience, I doubt anything placed by a bottom-feeder could ever meet the legitimacy of that test. Consumers are urged to dispute any LVNV, Sherman, Alegis, Resurgent, Ventus account with the credit bureaus and make demand upon the organizations and their owners to abide by the law. They receive a fat check to lie about things that cause you misery, higher interest rates, credit denials and in most cases, don?t have the required documentation that would meet the definition of ?accurate.? All of these owners, board members, attorneys and employees can and should be held strictly responsible when that information does NOT meet the legal definition, as stated by law.

The reason the Allison B. Moons of this industry are getting away with this is because no one is going after her. That can easily change if enough consumers decide they are fed up at being taken advantage of and strike back at these bogus filings, pleadings and credit bureau placements.  

We need to heed the lessons of ENRON and make sure that Allison B. Moon is held accountable when she breaks the law.  



CAUTION: I recommend you NEVER disclose your bank account or credit card information to a debt collector, as you risk them emptying your account, or maxing out your credit card. If you feel they are reporting on your credit bureau files in error or need assistance in dealing with them, email  the details w/your location.  Assistance and referral to a consumer legal specialist may be available.

This will bring up a company called Receivables Performance Management. They engage in all sorts of reprehensible behavior, much as Enhanced Recovery is. Like CAMCO, both these companies need to be destroyed.
I posted at that number on May 29, 2008. But there are many other valuable poss on that number. Do it! Don't put up with this crap. File Consumer Complaints with your State's AG.
CAMCO benefited from the fact that EIGHTY PERCENT of the $$ they collected from consumers was not even owed in the first place! Crooks. Absolute crooks. Deal with them.

Keep getting this call on my cell.  I have no idea why they are calling.  The caller, Chelsia, keeps asking for someone named "Daniel (I can't make out the last name).  Callbacks to this number "after normal business hours" directed me to a website called www.payerc.com.  Under the "Contacts" tab on this website you will find the following address and phone number:

I have no idea who these people are, or how they obtained my cell phone number, since this number is not public or used by me for anything except personal calls to people I know.  I am not the person they keep calling for and I am 100% certain I do not owe Enhanced Recovery Corporation anything!

It might have helped if you had provided a little more specific link.  The article may be worth reading, NBC Dateline has a lot of articles concerning debt collectors.
