Caller was trying to locate my estranged brother who has not lived at our number for over 25 years.  The caller harrassed my 80 year old dad who is under Hospice care by saying, "Don't you know where your own son is?"  Very nice harrassing a dying man with phone calls that have nothing to do with us.

I received a call today from a woman named Karen Mahon.  Although this "business" seems to be in Amhurst NY, her address is : KAREN L MAHON 1357 BISHOPS CIR GARDNERVILLE NV 89410. She is a debt collector with one of the sleeziest collection agencies in the country.  She wanted to speak to someone who I don't know.  She was rude, and told me that she would call me all day" day in and out" if she had to.  Please report this call to the FTC, the Better Business Bureau, and the State Attorney's office.  Lets put these bottom feeders out of business, and back in the fast food business where they belong!  You can also check out Karen Mahon's profile at Linkedin.com where she's listed as a PR/Communications mgr!

Automated message, once daily, the name of the intended party was unintelligible, but definitely not mine. Checked out this page immediately and learned the true and scammy nature of the caller. Returned the calls finally, just to get them to quit. Found that the name they had on file was "Rosarita Neil." Seeing as how I am a male, and know no one by that name, I requested that they cease calling me. Guy said, "Yeah, alright we'll take you o..." and cut himself off by hanging up. Though seemingly small time, I suppose these Buffalo, N.Y. based creeps pick up whatever they can, as my number has a Colorado prefix. Isn't the human condition in beautiful shape?

A man stating he was from the law office of Attorney Terrance D. McKelvey. left a message for a relative at my home stating he has a "legal file for litigation review in their law office".  I have received 68 hang up calls from this number and I am on the do not call list.  I believe this is a third party collection company buying old or non-valid debts and harassing people's relatives or people they assume are relatives.  I find the false threats of pending litigation and constant calls to be threatening and in violation of the Fair Debt Collection Practices Act (FDCPA. After researching the number, I discovered others have been harassed by people under this attorney's license which he has lent to third parties.  Please stop these people from harassing people and conning them into paying extortion fees to stop the harassment and threats.

We have just noticed that MeKelvey Law firm has been mentioned several times on our site as a possible scammer and debt-collector. Several people commented to an article about phone calls from scammers and identified one of the numbers as MeKelvey office of Buffalo NY as one of the parties engaged in shady business.


"1-800-496-9019, claim to come from Terrance McKelvey Law Office, Person calling Smantha Spencer. They, keep changing phone number and person calling"


" I Received a call from this number also they claimed that it was the same law office and i owe them money from a default loan from my dad that passed away in 1990. this is a bogus call.DO NOT GIVE THEM INFO ABOUT YOUR SELF.They told me that they would run my credit to see if it was on there.THIS IS BULL. BEWARE."


"I have been receiving calls from this same phone number, claiming to be Maggie MeKelvey Law Office and threatening to put me into court (Fulton County, GA) over a credit card debt from 15 years ago...she has also called my family and revealed this information to them (illegal) and told my mother that she is a bad parent because I live 1100 miles away, and we are not in touch on a daily basis. (Mom refused to give her my phone number and she responded that she was a bad parent...what a SHAMEFUL way to act!)"


"Woman called herself Cathy Jones, ext. 307. Said she used my SS# to determine that someone named Donna Call (also Ybarra) is my cousin and they're trying to track her down. Never heard of this "cousin." I tried to figure out what this woman knew about me and tried offering a few red herrings to get more information, but she wasn't forthcoming about why she wanted this person and frankly the whole thing smelled fishy. I never offered any personal information or to confirm SS#, etc. She had my ex-husband's name on a list to call also trying to find this woman. Hasn't a clue as to how to pronounce Spanish surnames. Had a non-descript accent. I did some research in NY on Attorneys--there is one in Buffalo who is apparently being sued over his practices to do with debt collection. Don't know if this call is from the same firm."

Shortly after these commends we have received several comments of rather unusual type - a high praise the McKelvey office. It appears that someone connected to the firm is trying to improve their image with the public. What they don't know is that all the connections are monitored and logged - we have information such as what state, city, ISP they are coming from, what type of computer they use, their address and more. If suspicious comments continue to appear - we will disclose this information with public and real attorneys and will file an ethics claim with the board.

Here is a great page with quite a bit of interesting information about this "law" office. After reading it you will understand that McKelvy is not really a law firm, but a debt collectors front. In order to extort the money from old law cases, bankruptcies and simple scams, one actually needs a law license which in this case has been sub-rented to the collectors by McKelvey.

Furthermore this page (also appears to belong to Bud Hibbs) contains even more information about the shade practices originating from people claiming to be representing the McKelvey office. It seems partners involved in this operation are "junk debt buyers". They buy debt from the banks for very little money and then go after people legally or illegally trying to make them pay. It also appears that the previous front for this operation has been sued and lost the case that deals with inappropriate and potentially illegal debt collection practices. In fact here is what they say about the emplyed practices:

Fair Credit Reporting Act (FCRA), Fair and Accurate Credit Transactions Act (FACTA) and the Fair Debt Collections Practices Act (FDCPA) violations typically practiced by junk debt buyers.

1. Re-aging Accounts: Junk debt buyers attempt to force settlement on "time barred" or "Expired Statute of Limitations" accounts. The actual date that the debt becomes delinquent is supposed to be reported to credit reporting agencies under FCRA/FACTA within 90 days of the delinquency. Debt reporting re-aging is the practice of reporting a bad debt account as more recent than it really is. Re-aging causes the FICO score to drop dramatically since the scoring model interprets the re-age as a more recent default. Junk Debt Buyers press for payment of some amount to bring the debt back under the statute of limitations after which they can sue you and have a chance of winning. It is important to note that State statute of limitations (SoL) for collections are different from FCRA/FACTA statutes of limitations for reporting the alleged debt on your credit report.

Misreporting the legal status (e.g., an open chargeoff that was actually discharged in bankruptcy) and also misreporting the "open date" and "date of last activity" on an account are two favorite "illegal tactics"! Junk debt buyers purchase debts that are outside the statute of limitations for lawsuit (legal enforcement of the debt) but not outside the statute of limitations for reporting the alleged debt on your credit report. They like to report this debt as a revolving account, which is illegal.

3. Various Code Violations: (e.g. consumers not being notified that their calls are being monitored or recorded) are also likely violations in almost all fifty states.

4. Multiple Listings of the Same Debt: Junk debt buyers are often responsible for multiple reporting of the same debt as these change hands among buyers and sellers. Usually, these same debts are reported by the original creditor as well. Thus you could have the same debt reported multiple times! Increase your credit score by disputing your credit reports and cleaning them up.

5. Collectors Pretending to be Lawyers. It does not improve a credit score to settle an old debt unless the item is completely deleted (not just reported as "paid in full"). Settling a debt with a junk debt buyer makes your credit score worse because the delinquency or chargeoff will now be reported as more recent!

What to do if you are contacted by someone claiming to own one of your past debts:

* Never assume you are wrong - assume instead that your rights are being violated. Make the JDB prove the debt is yours and you are legally obligated to pay it.
* Retain and file all letters, account statements, and court records concerning any communication from JDBs (even from 15 years ago).
* Never provide the collection agency or junk debt buyer with updated personal or contact information. Never provide banking information (such as sending a check with your checking account number on it) to these JDBs as they will freely dip into your bank account in the future with garnishments, etc.
* Never acknowledge a debt with a collector or agree to any payment until the collection agency proves and validates the debt as belonging to you (past billing statements are not considered proof).
* Know the statute of limitations and date of last activity for the alleged debt. Never agree to pay on an out-of-statute debt as that will do more damage to your credit than good.
* Never accept credit card "offers" that come with an offer to settle a debt or that request payment in any other way. They will simply tack on an old out-of-statute debt onto a "new" credit card account and start the clock all over for the old debt. Beware of these "credit card" offers that promise to rebuild your credit by allowing you to pay off obsolete debt.
* These "Junk Debt Buyers," sometimes called "zombie debt collectors," are barely operating within the law in many cases and are the bottom-feeders of the entire credit and collection industry. Do not be intimidated by them and know your rights when contacted by them. Many people fight them in court and actually win. Do not give in to their intimidating threats without exercising all of your consumer rights.

If you receive a call from any of the numbers listed below - do not answer or call back! It seems that some shady company (possibly based in Las Vegas) has gotten a hold of a large number of phone numbers. Quite a few people have reported being called several times a day on their home, business, personal/cell phones. Often when they pick up a phone the call gets disconnected or they hear a pre-recorded message. It seems that the dialing is done by the computer which just goes through the list dialing numbers from a database. When the call get's answered a message is played and the phone number is added to the "valid number" list. Some people who have missed the call called back, but got either busy signal or another recorded message. Calling these guys back, seems to also "validate" your number. After the automated part is done, one is likely to receive a call from an actual person who will try really hard to get some personal info, so later they can charge you for magazines, credit card application or other bogus goods and services. They may say that one has been entered into sweepstakes and have won something, or that one will receive free items for answering the survey questions. In any case - DO NOT give them any personal information, or even better - don't answer their calls and file a complaint with FCC. Register on the National Do Not Call List at www.donotcall.gov or by calling 1-888-382-1222. You can also file a complaint with FTC on this page. If you do give them your checking account number, address and name - you will be billed for all kinds of things you don't need or want.

Also - please read this article on MSNBC about a case brought by a citizen against telemarketers! You will find information on where to go (on-line) and what to file to bring a claim against telemarketer. You are entitled to $500 for every unwated call and could make some money while punishing the annoying bunch.

McKelvey has a temper (at least when I talked with him), so expect him to have an attitude regarding complaints, he has no back-ground in FDCPA litigation which means he will likely lose most suits filed against him. I expect that consumer lawyers will be back to dealing with Jack Sortino to pay off the expected judgments. Many lawyers earned good fees in suing the Lenahans and those before them, which makes me wonder what Terrance McKelvey is going to tell wife Rubie when his turn comes to pay the expected claims.

You do NOT have to pay them anything, their claims can easily be defeated as they still use manufactured and bogus documents under the names of:  Account Management Services (AMS), Legal Servicing, LLC and First American Investment Company (FAIC). I received a message on my mother's phone which is not even in my name.  The person asked for me by my full name and wanted to talk to my son which I do not have a son by that name or the age she gave.  I did not know this was a possible scam so I called them back at ext.257.  The lady I talked to did not want to believe this was not me and even asked if my husband's name was "so-n-so".  I said yes but that is all the information I gave her.  She even included a case number. My number one question here is how did she get my name by calling my mother's number.  Our phone number is unlisted.

I received a message on voice mail from a "Ms. Weaver with McKelvey Law Firm" claiming to be looking for a close relative of mine which is really my husband's ex-wife. Everybody calls here trying to find her for bills. Although I am sure the bill is valid for the ex I am a legal assistant working for a collection attorney and know that any bill under my last name is long past statutes to collect since she hasn't used my husband's name in over 7 years!

Got one message on my cell phone voice mail a couple of days ago from the 800 number in question, THEN a follow-up call this morning--both identifying as The Grove Law Firm.

The caller seemed to have accurate information on an old account of mine that I did, unfortunately, have to "let go" due to the fact I almost died from a catastrophic illness and now have only disability income. When I explained what it meant to be "judgment proof/collection proof" based on disability, I got a confused response and a promise to proceed with litigation. I politely directed the caller the the Fair Debt Collection Practices Act web page for her clarification.

Just a while ago, while double-checking the information I had given her just to make sure no laws had changed, I decided on a whim to Google the phone number that this morning's call came from:  1-905-641-9622. This number traces back to a dormitory at Ridley College in Ontario, Canada!

As a former junior college educator myself, it scares me to think that it is likely this McKelvey fellow has students working for him who can do their work from home/dorm/cafe/wherever--worse, international students who probably don't know the US laws and could get themselves into some terrible trouble. I do hope that girl who called me this morning reads carefully the information on the web site I gave her . . . Poor kid. It's a shame students have to earn their keep that way.

Have recieved calls on 2 different occasions, 1st one was looking for Carol Palmer, and i answered the phone, the name happened to be of my ex-husbands 1st wife, when I told the woman that she said to never mind, as they did not want to get ex's involved.
Today, 08/19/07 I received a VM from a woman from Terrance McKelvey Law Firm, stating I was a contact for a Carmen (could not understand last name) who was born in 1935.  Left a phone number of 800-496-9019, court case # 248359.

Debt Collector
left two messages on my home phone, which I only use for faxes.  looking for my sister, using her maiden name from 15 yrs ago.  when I called and spoke with Miss Pender, she stated that this was my sister-n-law thru marriage.  I knew right then that this was a bogus call and told her so before hanging up.

She also stated that this was a legal matter. Never said anything about collections or debt.

Said she had used my social security number to connect with someone she says is my cousin. I didn't ask what SS number she thinks she has, and didn't confirm any information or give any specifics. Said her name was Cathy Jones and her extension is 307. McKelvey Law Firm (There doesn't appear to be such a firm). Said she is looking for Donna Call who sometimes uses an alias Ybarra. She had my ex-husband's name on her list here to call also. I alerted him to this. After a few minutes of not getting any coherent information from her I asked for her name and phone and said I'd let her know if I found anything in family notes regarding cousins I may not know.
