There is a positive defense in Georgia, and a number of other states.  In, GA it is illegal to use "robo calls", and the calls from FMS,Inc. command the person ansewering the call to "remain on the line regarding an important matter...".  Citizens are not required to OBEY THE ROBOT.  Debt collectors have a partial exemption from the FCPA and Federal Do Not Call statutes insofar as they don't have to have a previous business relationship with you - their "client" supposedly should meet that criteria.  In today's call they appeared to be using the "shotgun approach" calling everyone on the road the person they sought lived on as a child (20 years ago or more) and everyone with a similar last name in that area.  This is totally lawful, old fashioned, gumshoe collections/skip tracing if it is done by a HUMAN.  When you program a computer to do this, annoying dozens, or hundreds of people needlessly it's abuse; THIS IS WHY ROBO CALLS ARE ILLEGAL IN ALL CASES IN GEORGIA...

I answered to get a recording: "Please do not hang up. This is a very important call."
I waited 20-30 seconds, then a man says "Hello?"
I paused a second or two to see if he had more to say then answered: "Hello".
He hung up. If they think I have nothing better to do than for wait for them on the phone... Blocked!

Their policy is to harass customers with hang-up calls.  They feel that either you'll call back the number on your caller ID or at least you'll be motivated to talk with them and get the calls to stop when a "real person" finally gets on the phone.
Expect about 20 hang-up calls before the system transfers you to an agent.
It's possible to tell what they are doing, they even state the system they have, it's possible to give higher priority to incoming calls than outgoing calls, somebody who gets called 19 times has a higher priority than somebody being called the 2nd time.

They'll say that's just the way their system works and it's done to be efficient with their agent's time, their dull employees probably don't even know this, but it's done on purpose, they make extra calls knowing this.  It takes a large number of hang-up calls before it's probable an agent will answer when their auto-dialer calls you.
Who knows how they got your number, these people make tons of mistakes and get wrong numbers all the time.  In my case they could easily do a check on my listed and public number and see I was not the party they were looking for, but that would be more expensive than just throwing everything at the auto-dialer.

I do not know why FMS has been annoying us by constant phone calls and plan on reporting them to the BBB and my local police department if they continue.  I do not owe any outstanding money and consider these calls harassment.  If they do not stop I will be forced to take legal steps.

I received a call from this number requesting my daughter, would not tell me what it was concerning without her permission. Said they would block my number so I would not receive calls from them again, of course they gave me a different number that I was calling from when I called them back.  So no I m concerned.  I did not give her my daughters number I took the name of fms asset management co. name of person Scott Tierney.  does anyone know if this is a fraudulent company said they were located in Tulsa Oklahoma which is where I was born.

Debt Collector
I was unfortunately assigned a phone number by my provider six+ months back. I began getting calls from debt collectors calling for TWO different people who had this number prior to me. I easily got rid of most of these robo calls by instructing them that I WAS NOT who they were calling for. Therefore they assured me I would be removed & harassed no longer. My last chore was FMS based in Tulsa OK. The horror stories I read about them appeared next to impossible to STOP their daily robo calls. This may help those of you who are being called constantly by them. Here's what I did.......I Blocked my caller ID then called their local Tulsa # (918) 747-4884. When their automated voice mail gave me "Options" I pressed "0" for operator. When I spoke to a live person (a lady), I explained their constant calls to me & they were calling the wrong person. She quickly said she was transferring me to "The Department" that could remove me. I thought yea right.....while waiting for a real person Their "On Hold Message" stated my call was being recorded. Excellent, because I was recording as well. Soon a man answered my call & informed me my call was being recorded. I smiled & said in a friendly manner "Were on equal ground because I'm recording too". I explained the daily harassment of FMS calls for someone who had the number BEFORE me. He said that he would  remove my number but I needed to give him the # because I blocked it, remember. I felt at this point I had nothing to lose by giving it to him. He did not ask MY name, but assured me it will be removed. I told him about all the horror stories I had read about their verbal practices & I wanted my number NEVER to be returned to their robo system. Maybe he was so helpful & friendly because I was recording him, I don't know. Bottom line, these calls & others have been a major irritant to me for a long time. I had actually paid a phone provider $40- some time back to "Port" this number BEFORE these calls increased. I felt like a total victim of these Three collectors including FMS. My reason for posting this is to help anyone who gets these robo calls & they are NOT FOR YOU! It's beyond frustrating. Hopefully I have helped someone stop this madness. My best to you.

If the call is so legitimate, why don't they just leave a message?  I have no debts other than my mortgage and my car payment, and I am up to date on both of those.

Lately I've been plummeted with annoying sales calls despite the fact my phone number is on the Do Not Call List................like that will stop sales calls.  So this evening I actually "pressed one" and was able to leave a voice mail.  Not that I'm delusional, I just reached my limit for the week!  My message simply stated my phone number and a stern command to STOP CALLING ME!!  I realize no change will occur but feel a little better and that's what mattered most to me at the time.   My next move was to this site only to find 25+ pages of the same theme of annoyance and discouragement that nothing changes in FMS's practices despite the fact that reports to authorities have been filed.  I'm left with only hopes that this fraudulent enterprise will screw up big time and hit on the phone number of a person of power that can expedite the desist of their crap!  I see a class action suit waiting to happen.   :)

Just got a call from 800 580 7611.  The automated message said "This is F&S.  To speak to a representative push 1 now or hang up to get off the call list."  or something to that order. It also said that this was not a solicitation call.  (yeah, right!).  Anyway, I hung up cause, like one person said , if you push one, then they say that you called them and you could be charged a nasty charge.  So many scams these days, just hang up on anybody or anything that you haven't asked for. ( If ya accidentally hang up on your Mom, she'll understand!  Ha.)

Prank Call
These a***oles call constantly. The audio recording always starts off saying "This is FMS. This is not a sales call. To speak with a representative press 1." For months I would just ignore the call or hang up. However, lately I've pressed 1 so I can bi*** someone out and all it does is disconnect.

I've been in the same situation for about 2 weeks too.  We live in a house that had renters when we bought the house.  Ever since we moved in we've been gettting calls from debtors.  Here's the kicker; I've had my current number for over 9 years!!!  They are only called because of the address association.  I've tried calling FMS on both numbers and can never get a hold of anybody.  This is ridiculious, but I see it's been going on to people for over 4 years since this started.  I don't see an end soon!!  :(

"They left a half message, and all I heard was someone will be with you shortly,
some guy said, "Hello", then hung up."
----

They do this with purpose and much evil intent.  They are a collection agency.  They hope after enough harassing calls you will be anxious to speak with them on their terms.

When folks like this are encountered the best thing to do is to not reward them by giving them what they want.  Block the call, don't answer, answer and hang up right away; answer, hit the mute button and put the phone down.  Just don't reward this behavior.

If somebody does owe a real debt (often they are fishing or calling ex-neighbors) with something like a student loan they will eventually track them down and contact via mail.  But never respond to the phone guys and certainly don't help them find others.

"They must think I am really stupid."

Oh they do!

Best to block the number if somebody's phone allows that.  But they will keep calling and calling.  I have an older phone and don't leave the message machine on, I double hit the "answer" button to answer and hangup right away.  But a better trick is to answer and then hit the mute button, sometimes that really gets them.
