Called me at 8am & hung up. I called # back. Call is from ERC Debt Collections. Lady I spoke to was named Elizabeth Rush. Very rude & aggressive!!

I will have to disagree with you. Yes, the link you provided it is a real website. But, as you stated that if you go to their website you will be able to call them and have them remove your number. BUT, if you look into their "contact us" tab at the top of the screen you will see that the number that called you is in NO way associated with this company. Their website gives 2 numbers and neither of them match the number calling. And, when you try to call back no one will ever answer and you wait on hold for I don't know how long. Also, I do not have any debt and I have had my phone number for many years and I have never received these types of calls until just recently. But, when I looked up the number ERC collections did pop-up but when you look up the number itself it shows something wayyyy different.

I called the number back and it tells me that there is a 100$ rebate for a small fee (scam obviously) then it says to wait on hold to talk to a rep. The automated voice comes back and tells you that you are not suited for this gift and if you would like director assistance to call a different number. :-/ ugh.

The phone companies are in on it when it comes to giving your private info away. If they really gave a dam, they would allow us to block all numbers and give us the option to create a list of the numbers we choose to allow. Then problem solved. That should be a choice and I can imagine for a guy like myself it would be very effective. Never press 1 or whatever number they tell you to push if you wish to decline whatever they're offering. If you didn't sign up, register, etc then you shouldn't have to go out of your way to decline something you never asked for in the first place.

After you input your number, you'll verify that they got it right (the automated system will ask) and then they will let you know they will remove you from their system and calls will stop.

I am continually getting calls on my cell phone form this organiazation. I have no debts to be paid, I have never heard of them before. I do not answer when they call me. I am going to report them to my states consumer protection of at the Attorney Generals office in my state.

I actually work for that company, and give that number out. We actually DON'T want to call a wrong number! We are trying to reach the right party and resolve a legitimate issue... and have no desire to violate the law in so doing. I cannot speak for every employee, (there are many, and of course some have made mistakes and/or crossed the line), but this company really strives to do it the "legal, moral and ethical" way. (They spend much time and money in training, and that motto is drilled...also collectors are quickly fired for violating such policy.) I had never done anything like collections before...didn't think it was something I COULD do, but I find that I actually HELP a lot of people and even save them a lot of money (when I'm able to offer settlements, etc). I treat people with respect and do what I can to help them dig out of their debt. I'm sure many people will have horror stories to tell and I know of plenty. There are some really awful agencies out there, but ERC is one of the better ones.
If you are receiving collections calls and it is NOT you, the best thing to do is try to catch the reference # left on the msg and calll in and ask to have the number removed.

This call is from ERC (whomever that is). I called the number and was on hold for quite some time by an automatic answering machine. When someone finally answered I asked who they are and why they called. They are a skip tracer and looking for people on record with your phone number. No surprise, we got a new number over a year ago and have receive tons of calls for the previous owner. She must have a lot of people wanting to find her.
Lesson to be learned - If possible, before you accept a new phone number, check out who had it before you. Use the Internet for best results.

got a call from this company today. was a similar experience as someone else had...
she asks for my uncle so im like yeah this is him who is this ? she said something like sora im like who do you work for and she starts reading off addresses and asking if i live there ( like 3 times none of them were us. ) im like who do you work for ? and she says something gargled then she asks if the last 4 of the social security # are ... i dont know any more because i hung up. these ppl are fishing and probably some kind of scammers. they says debt collector but its more like information collector and for what purpose ? sale ?

Just another pathetic example of this out-of control industry which is featured in the National Consumer Law Commision's article: "Debt Machine":

It also identifies the financial links between debt companies and some of the nation's leading banks, documents the buying and selling of billions of dollars of debts and describes the critical role of hundreds of specialized law firms".

Anyway, to address your questions: No, they are NOT allowed to call your cell phone, unless you have given them consent to do so. For example, if you have an ESTABLISHED business relationship with a creditor and give them your cell phone number as your primary contact, that is one thing. But, since you do NOT have an ESTABLISHED business relationship with this junk debt buyer, they are violating not only TCPA but FDCPA laws as well and can be sued under both the FCC and FTC. NCO Financial found this out the hard way after they were recently sued for relentlessly harassing a non-debtor. And, if ERC can't prove you own this debt and keep harassing you, they are setting themselves up for a lawsuit as well.
The main thing is--ERC is just trying to badger you into admitting that you "own" this debt, so they can reage it and put it back onto your credit report. Whether or not you paid this alleged debt is a moot point. Either way, you don't owe them ANYTHING. Period. They know when they call the chances of you having any documentation proving you paid it twenty years ago are zilch. Even if you didn't, the statute of limitations ran out on it years ago and they couldn't take you to court over it. They might even try and get away with sending a 1099-C on it to the IRS as a "forgiven" debt. You would then turn right around and dispute the 1099-C with the IRS and ERS would have to furnish documentation to support the charge-off. If they can't (or won't), they default...and you win.
But in the meantime, what you need to do NOW is stay OFF the phone and demand validation of this alleged debt IN writing with return receipt requested. Per the FDCPA they have five days to respond. If they continue harassing you or try to take you to court without first proving that you legitimately owe it, you can sue the pants off them. Keep copies of everything and every call they make. Stay off the phone. You do not have to talk to them, but don't ignore their calls, either. And don't keep calling them back. You could be setting yourself up for a harassment lawsuit, as well. MAKE them validate!

They call me EVERY day at just after 8 a.m. They are trying to collect a debt that I don't owe on a product that I purchased over 20 years ago!!! I paid the debt over 20 years ago and haven't heard from anyone about it until now. I don't even own the product anymore! How can they legally call a person on their MOBILE phone using minutes paid for to collect an invalid debt that is from something that was purchased over 20 years ago? Is it legal for them to contact a mobile phone? Is it legal for them to harass me for something that I purchased and paid for over 20 years ago? How do I get rid of them? I don't keep receipts for 20 years!! I don't have the same checking account from 20 years ago! I don't know how to get rid of them. The only recourse I have had recently is to harass them back. When they called today, after they hung up I kept calling them back over and over so I could take up some of their time and show them what it feels like to have someone call you for no good reason. But I don't know what else to do. I already told them I can't help them, but they won't leave me alone!

I just signed up for a J2 Communications fax/voice mail service, and I am getting messages from this collection company. The prior holder must have had the dedt. Each time they call it sends an email advising me of a voice message. If it continues , i will pursue harrassment.

I have been getting calls from this number for about 2 weeks every day and each time that I've had a chance to answer they ask for the same person (they've never stated where there calling from). I have told them several times that they have the wrong number. Today I got saw the same number appear so I answered. This lady asked for the same person...I told her that she had the wrong number and told her that I've told them that several times and asked if they would remove my number. She was very nasty with me and said and I quote, "we never called you before" I told her that I've been receiving calls for the last 2 weeks; she said, "no you havent cuz this is the first time we called" I told her once again that it's the same # and that I would like to be taken off the call list. She said, "we aint got no call list" I called her a name at this point and she said something back to me and we got into a an "excuse me" debate. I told her I was going to report her for being so rude and that I hoped she lost her job. She replied "have a great day" and hung up.
