Numb Nuts.

What about all of us getting these calls who never had a student loan or who have been out of college for 30 years or never had children to co-sign for?

Get off your soapbox and have this company quit calling.

My elderly mother has been getting many phone calls from bogus numbers, after being put on the do not call list.  This last one said from Student Loan Corp. and she has never had a student loan, never signed for any of her children or grandchildren.

Yes, they call incessantly, even though they have been told that the person they are looking for no longer lives here. It is pure harassment.

This is for a student loan company.  They contacted me in regards to a friend of mine's student loan.  The lady says "can you let her know we are calling regarding her past due balance on her student loan."  When I pointed out to the woman that this was illegal to 1) tell me that is was a debt and 2) that this is in regards to a student loan, she got loud with me.  She told me that it was not illegal and that I needed to check the law.  She had a major attitude about it with me.  Very unprofessional and illegal.

You sound like the people owe you money personally. Thanks to the new smart phones, we can download an application that blocks all the calls that come in from them. Also we can set it where we never have to know they called in the first place, so call all you want, we won't get the call and you won't get any money, HA!

Debt Collector
I am the top collector in the collection industry, with over 20 yrs in both consumer & commercial collections. The key to being a successful collector is to treat people with respect and most importantly listen. I received a collection call from sac yesterday in regards to my stepson. I made it clear that he not only doesn't live here but is not welcome in my home. I gave them his contact info & "put them on notice" to remove my number.
I received another call again today from Terry  and again told him to remove my number. Terry rep# 870 and asked why I am getting a call when I have put them on notice. He responded the way most   bad collectors do. He didn't listen, he talked over me, he interrupted me and tried to debate the issue with me. I tried to explain the FDCPA rules to him but he was more interested in hearing himself talk. I asked for the manager to which he hung up. Very professional. I called back and filed a complaint with the manager who understood the ramifications and removed my number. She assured me of no further calls, but couldn't provide me with the president's name or number because she "honestly doesn't know who that would be." Really? That won't be hard to find, trust me.
A word of advice, if you owe a bill pay it, if you need help, ask for it, if you talk to an illiterate twit like Terry, ask for the manager and if you still can't get anywhere contact the owner/president. Nine out of ten they don't know how their accounts are being mishandled and will welcome the feed back.
Worst case scenario if you need someone who isn't intimidated and knows the ins and outs of the collection industry, contact me. I will negotiate your debts, help you get the payment terms you need, and or negotiate a settlement that will reduce your balance drastically.
Let an expert help you, the fee is minimal compared to the price you pay by having to endure the continuous harassment and aggravation.

Student Assistance Corporation, a subsidiary company of Sallie Mae that works on the behalf of the guarantor of student loans in default prevention.  These people are trying to help explore options to people who are delinquent on loans.  Honestly, if they are calling and you don't know why, just answer the phone and tell them the truth.  Either they want you or they don't just let them know.  Everyone that I have talked to is very nice and understanding.  They will work to help you!  Great company and great employees!  (Just be nice to them, and they will gladly go out of their way to help you.)

Aside from the posts from SAC being a shill for a collection agency, these folks are pushy, persistent and rude. They keep contacting me on a supposed guarantee I made for my nieces student loan. I have sent them several dispute letters they keep calling. I sent them an affidavit they keep calling. I demanded proof I guaranteed some loan, they provide nothing cause they have nothing, and gthey keep calling. I guess they think that since they are Sallie Mae that they are above FDCPA laws. They are wrong. Harassment is harassment.
The only 'HELP' they are is to help separate you from yuor money.

For starters, SAC doesn't do loan consolidations. They can provide numbers and advice on how to consolidate, but they definately do NOT. Number two, as the mother of your child SAC is required to reach you if your son's loan is delinquent and he cannot be reached because you are an AUTHORIZED 3rd party. What does this mean? This means that SAC can give you all the account specifics and tell you how your son can get him out of the mess he has found himself in, you just have to verify 2 pieces of info for federal security purposes. I used to work there, believe me it is just as much as a pain for us to go through the verification as it is for you, but keep this in mind also: IT IS FOR YOUR SAFETY! You wouldn't want us to give out your personal debt information to any John Doe that answers the phone and says hello. When you call your electric company, water company, credit card companies, and so on, don't you have to verify a heap of info before going further with your account???
Number three, despite what you may believe in your "perfect little world", if we are calling there is an issue. If you recently sent in paperwork for a deferment, forbearance, or IBR then it may be screwed up. If you were so sure that things are okay with the loan, then why are you so afraid to just answer the freaking call? He may have forgotten about the payments, his auto debit (if had one) may have expired, the deferment he was on may have run out and he was unaware. This isn't rocket science. Answer the call, shut up, and pay attention. That is the only way the calls are going to stop and your son's loan to be rectified. It only takes 5 minutes tops to take care of it, but maybe you are too perfect of a person for anything to happen to you or anyone you knows' account. Your son may know he is behind and not want to discuss it with you because maybe his is embarassed or thinks you will think less of him, happens all the time, a parent will take a call and ream you a new one because their precious son/daughter said they had called and were up to date and they would never lie! Then boom, not less then 5 minutes later we get an inbound call from the student to handle the account AND THEY KNEW THE WHOLE TIME!!!!
SAC calls to help, it is required that a payment is asked for first before moving on to other options, answer that question truthfully and respectfully and the rep would go out of their way to help you. Honestly taking a payment was a pain in the behind and I would have rather moved on to begin with. If you are rude, threatening, or refuse to cooperate you will not get anywhere, when you speak to someone you are talking to a human being. Human beings tend to manage things according to their current disposition, if you are nice you are treated with the respect and that rep will find everything they can to help you, if you are rude and disrespectful the call will be terminated and maybe you will have a better attitude the next time around. It isn't the rep's problem, it's not the rep's credit and wages that will be in jeopardy, and their is plenty of other students who won't waste our time and are in need of a helping hand to work the fine print of their prom note to their advantage.
Oh also, the prom note your son fills out includes your information as well, you know...when he listed his secondary contacts and references. Besides you are being skip traced with legal software to find your information too, again because you are an authorized 3rd pary. SAC can call 8 times a day per # on the account. Have ten #'s? You can get 80 calls/day. Don't like it? 2 options, pick up the phone or pay the bill in the first place. Reps are humans to who understand hardships and hard times. Reps have divorces, deaths, credit cards, etc just like any other person in the world, reps can relate. So what is to fear but another human being on the other end of the phone calling to help you out when times suck? Grow up, swallow your pride, drop the attitude and any preconceived notions of what you think it is and talk to them, it would make a difference, just takes 5 minutes.

Also, in regards to defauting. 1st you have the option to do a loan rehab with them for 9 months with the collection agency you will be sent to. That is 9 months of consecutive payments that the collection agency decides you will pay. If you don't miss a payment you can go back with your lender and get all of your deferment options back. If you don't they can garnish your wages up to 25%, yes even if it is Social Security or disability...that makes no difference with a federal debt. They can take your tax returns. Also upon defaulting they automatically tack on 30% of your loan account balance on top of what you owe, there is a loan transfer fee, default aversion fees, and several other fees that are involved with the default process. So if you had a $100,000 accnt you decided not to take care of, once it defaults you are looking at a $150,000 debt that won't be as negotiable on payments as your standard loan.

Also, 90% of loans are automatically enrolled in a graduated repayment plan that you sign for with your Master Prom Note (MPN). So don't be so surprised when after 2 years your payments jump up between $50-$100. You can opt of this, but keep in mind you did sign for it, so it isn't the lender "screwing you over".

And don't tell us you haven't made a payment because you haven't received a statement, your prom note states you are still responsible for payment if you receive a statement or not.If you don't pay your electric bill because you didn't get a bill they will still shut off your utility. If you don't get statements for your car note and you stop paying what happens? They repo it. Guess what the happens if you default? They repo your degree, but these people don't have to take it out of your driveway at night.

They have called many times but never left a message.  They finally left a message and and said to use their toll-free number to call back regarding student loans. Since I don't skip out on my debts I knew it wasn't about me. Unfortunately, my last name is very common. They are trying to find someone that I don't know. The lady said that she would take my number off the list. Hopefully that's true.

For those receiving harassing calls, see: http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre18.shtm
Of particular interest: "Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not: [...] repeatedly use the phone to annoy someone."

Also of particular interest: "You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. We are getting  a phone call every day from 800-635-3786, with caller id identifying the caller as "Student Assist". No message is left when we don't answer the phone. If we answer the phone, the caller always asks " do we know _____" (my son).  We don't answer the question, but request to be put on the "do not call list". I don't know what the next question might be if I answered the first one, but I don't feel that I should be required to answer any personal question from someone who I don't know on the phone. In response to our request, they said they wouldn't do that if we didn't answer their question. We said we would sue them, and the person simply said "we'll call you again tomorrow". And they did. And the next day. And the next day. In fact they've called us every day, twice on Saturday in the past week - except for Sunday.

We do not have any outstanding loans. We did not co-sign any loans. Our son is 29 years old, and while he does outstanding student loans, he has been independent for the last 11+ years. The method that this company is using, calling people who have no responsibility for the loans my son has made, is in effect not only harassing those that they are calling, but they are also discrediting my son to all those that they call and harass.

@annoyed: They use an automated dialing system (which is completely legal, btw) and that dialer ties up their 'Line 1'. They can't release that line without either moving on to the next account, or logging out of the dialer completely. Because of this, they probably put line 1 on hold when you hung up, so they could try manually calling an alternate number on the account. They can't control the fact that sometimes your phone doesn't release the line, either.
