this guy chad keeps calling and demand i pay a debt that isnt mine. after he recited the social security number and address i told him it wasnt me. he wont let up. he wants me to give him my social security number or show proof that its not me. i dont think hes following the guidelines of the law.

I received a letter from them stating that I was in debt over $10,000.00.  I made numerous phone calls never get a live person only a recording.   This is crazy I never heard of these people until today.

No, he isn't.

The burden of proof as to whether or not someone legitimately owes a debt rests with the collection agency and NOT the consumer.

Send them this letter demanding validation of the debt they are calling about VIA certified mail with return receipt attached. If they refuse (or can't) provide proof that you owe it, they get NOTHING. It's that simple.

This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

I respectfully request that you provide me with the following information:

(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state).

Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

Because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
you cannot add interest or fees except those allowed by the original contract or state law.

I too have been receiving about 2 - 3 calls on my ex-boyfriends cell phone every day. Needless to say he isn't happy. I tried emailing them from their website but only received an error message.

It is a collection agency(why are they so rude even when you're not?). I had returned a product to a company (I'll call SW) with the appropriate RA number. SW mistakenly sent my account to collections. When I called the collection agency back with the RA number and informed them SW said it was a mistake they asked for the RA number which I did provide. The agent for the collection agency seemed upset, I'm not sure why.

Fortunately I kept all my paper work and sent the product via certified mail. When I called SW and confirmed it was a mistake I requested they put it in writing. You have to CYA!
