You realize that someone commenting almost three years ago may not respond, yes? You might have to read the rest of the thread for pointers. You most likely have a contract with your timeshare seller or manager which gives you the right to take action if it's been breached.

Hello!
We purchased time shares and not once did we have the chance to use the time shares. Payments still come out of our account and we still owe $9,000!!! We are paying all this money and not receiving anything! Did you pursue legal action regarding your timeshares? I would like to find out what we can do to put a stop to this robbery! Please help!!

I am interested in class action suit against VI - we are supposed lifetime members, who can hand down the timeshare to our kids - but the only thing to hand down is a yearly bill for points we cannot utilize. Availability is a joke. We are very frustrated.

Hi George, I would be interested in learning more about being involved with a class action, I also replied to the post from Henry. We bought in 2010 and feel that they most likely knew they were in trouble as we were signing and find out later that they were not even using their own money, so when we told them we don't really have the down payment they required they cut it in half and did what ever to get us signed up. Now this couple that owns the paper and trust me I feel for them and would encourage them to join a suit as all of us stand to loose here.
Gary Mora 2013-05-29 23:58:11 Unknown
Hi Henry, do you know if this has gone any further, my wife and I were very reluctant to buy into this in 2010 but decided since it was a Canadian based company it should be pretty safe, and by October 2011 they were filling for protection and we are convinced that even when they were selling us they knew they were in trouble. When we got the notice that there was trouble brewing we stop payments, when we got the info on the merge we right away decided no, but we did look at the BBB and they do not have a good rating from them. So we did not do anything until we received a call from a couple that says they own the paper on our time share and want to get paid. We tried to work something out with them but they want blood. So this is creating a lot of stress and if there is going to be a class action lawsuit we are in as much for the nightmare this is causing us and others.

YES, YOU WERE SCAMMED !! I MYSELF WOULD NEVER HAVE BOUGHT FRACTIONAL SHARES IN PARKSIDE, VICTORIA EXCEPT FOR THE REASON THAT AVIAWEST PROMISED ME $30,000 EACH FOR TWO TIME SHARES.....WHAT ARE THE CHANCES OF ME GETTING MY MONEY BACK ??? PROBABLY ZERO.....
Meg 2012-11-13 17:15:30 Unknown
Have you tried to sue the holders of the promissary note or send a collection agency after them?
howI've been scamed 2012-11-10 06:34:34 Unknown
I bought a fractional share of Parkside in Victoria. ( July 2011) Aviawest promised me $30,000 EACH for two time shares that I owned. I received $700.00 and then Aviawest went into receivership....I have 2 promissary notes that are now WORTHLESS. The only reason I bought the fractional share in Parkside was the promise of $30,000 for each of two timeshares. I FEEL THAT THE PEARSON FAMILY HAVE SCAMED ME.

As someone who still owes these guys I would like to get some advice or on board with a suit and split costs. Not sure the best approach other than maybe a FB page? Thoughts?
GK 2012-06-15 22:20:30 Unknown
I would love to talk to some owners who are choosing not to sign on with VI.
Did you know that Vacation Internationale has only 2 units available in its inventory from Pacific shores. Did you read the manual that was sent Page 7 and Page 9 confirm that your rights as a VI member can be suspended prematurely. I think we may have a case Its worth a try, depending on how many there were we may be able to split the legal costs. We need to come up with a way to get in contact with the members that are not signing. Any Ideas
Angry-customer 2012-06-01 21:50:49 Unknown
Well, I am glad to see AVIAWEST leaving. I received a package from Vacation Internationale and the only thing I have to say is that I will not signe with them because I don?t trust them. to me, AVIAWEST and Vacation Internationale are the same s***. I called Vacation Internationale and they did not give me clear and honest answers; therefore, I don?t trust them. I will never buy timeshare and suggest you to do the same. I would definitely support a class action against AVIAWEST. Good luck dealing with these asswholes.

I like the idea of class action against AVIAWEST. I became a member at the end of 2010, but after a few months of paying, I decided to stop paying because I realized that they were only a cheap scam. I hire a lawyer and we are in the process of suing them, but I have to wait for this bankruptcy deal. I recently got information from VACATION INTERNATIONALE and they told me that they already merged and to be part of them you need to sign a new contract and pay about 70.00 dollars to transfer. I decided not to pay and I love the idea of starting a class action against AVIAWEST, so count me in if you still interested. I will keep an eye for your reply.

yes a wonderful company who steals money from its patrons, cant account for it, is now liquidating and merging to save its sorry a***s and the people stuck with the bs piece of crap properties have to pay to clean up the awesome pearson management mess - oh yeah!!!! reaaaaally reputable!!!!
This company is not only a SCAM, its not worth anything. oh wait, if you sign on the dotted line... it will be worth what ever you give them.... to blow and mismanage....and then be nothing again!
Save your money for a real trip. This place is garbage.
henry 2012-04-24 02:15:43 Unknown
Is anyone trying to get out of the Avia contract now that they are liquidating some properties and merging with another company? We will be looking to see if we can file a class action lawsuit against Aviawest for mismanagement of owners cash.
Does anyone else have any info?
By the way your points will be worth less when they merge and your yearly fees are going to skyrocket!!! For those of you that are still paying for points, call an attorney, you can walk away from your points. This company has some pretty shady and self serving business practices.
You will be paying in the end.
Oliver 2011-10-21 02:24:18 Unknown
Hey Brianne, have you been laid off yet? Has your paycheck bounced? Aviawest IS a scam!
Brutal Company!!! 2011-10-08 00:11:43 Unknown
Myself and a few friends had been called to attend a seminar in Burnaby a few weeks back. The agent promised that we all would receive $400.00 worth of free gifts just for attending. I guess we all filled out the ballot at the same time.
When we got there, the office was closed, and there were other people waiting as well. After waiting about 30 mins, the security guard approached us and told us that this happens quite often.
We were extremely angry as like many others there, we traveled a distance and had to find babysitting.
The funny thing is that they even called us in the morning to confirm our appointment.
This company is definitely a scam...so please do yourself a favor and hung-up if they try to con you into something they are trying to sell.

LoL I just got a call from 1 (250) 716-2650
Was a female with a north american accent. She said she was calling from avos about a bmw draw that i had entered. I did drop in a ballot for a car, but i don't remember what car, as it was over 4 years ago, so that can't be valid anymore.
She said to call 1-800-728-1695 extension 8370 and told me my ballot number.
And guess what, her name was "Nicole". Tsk, Nicole's been a naughty girl.
I was suspicious so i googled the number and this website came up. Thanks guys. But I wonder if we are able to report this. This is obviously a scam and i don't know how they can get away with it. They definately have made a ton of money. They deserve to be rotting in jail.
Dave - Vancouver 2011-09-15 21:03:55 Unknown
I just got a call from them too. Where the hell did they get my unlisted/private phone number and my name? I have never entered any "draws" for a car. Anyone in for a class action lawsuit?
Put them in jail or die trying 2011-08-15 13:20:34 Unknown
We are pursuing legal action against Aviawest based on misrepresentation.
Chantal Granger 2011-08-11 03:18:40 Unknown
Got this call today about the phoney BMW draw. Glad I saw this page before I called back.

Just received a call from Aviawest 250.716.2650 nanaimo, they gave the same speech as everyone else got. I told them I wasn't interested but they still made an appointment for me, I told them that I wouldn't be showing up to it but they didn't seem to care the guy just kept pushing the date back and said that he would call to confirm the night before.. I think it's just a bunch of BS. He kept running off about all these prizes that I was going to receive that were worth $400.00 but I'm sorry an Ipad 2 is worth more then $400.00. It's a bunch of crap... BEWARE!!!!
TYL 2011-08-03 19:20:36 Telemarketer
I had calls from this number both last and this week to which I requested that I be placed on their "Do Not Call List". Also, I have some knowledge of the timeshare industry and know that it doesn't suit my lifestyle.
If calls like these continue and/or you are receiving calls from other organizations attempting to market their products to you, all you have to do is ask to be placed on their "Do Not Call List".
Check it out: http://www.crtc.gc.ca/eng/DNCL/brochure_consumer.htm.
Also, if you're considering a timeshare purchase you should compare Aviawest prices to that of resales. Have a look at Craigslist or UsedVictoria and see the difference in price between Aviawest and resellers. These products are not liquid! You can't even give them away. What happens then when you buy the product and a few years later you no longer believe that it suits your lifestyle? Good luck offloading it. Remember, if you don't use it, you still have to pay maintenance fees and membership dues.
