I used to work for PCM as collector & manager years ago.I took great pride in my work & made sure my staff followed protocol & FDCPA daily. However, when ownership began exhibiting "shady" behavior,my position was consolidated shortly thereafter.Heads usually roll after a major shake down & the innocent suffer the repercussions. It was a great experience for the most part, the exceptions being greedy fellow managers & unenlightened upper management. They filed BK to save their behinds & changed their name so they could continue to conduct business, which is scandalous on so many different levels, but unfortunately, legal.I harbor no malice or ill will towards anyone, but I'd be lying if I said I it doesn't bother me at the way I was uncerimoniously ousted & treated. For what its worth,I felt compelled to chime in & give my two cents worth.

The number 800-757-7700 has appeared on our caller ID twice every day for the past several days. I googled it and found it's a business in California.  These ill-breed individuals did not leave a message on the machine. Since we are almost never home, and when we are we screen our calls, I guess they'll continue to call and waste their time.  I have no patience with fools who basically prank-call private homes.  This company and the callers themselves should be prosecuted for home invasion!

I have called this company asking why they are calling my number, they are looking for someone that is not me, or anyone living in this house.  Although they say (3x) they'll take our number off the list, they do not.

I get 4-5 phone calls per day.  They ask for someone named Matt, I tell them I am not Matt, I am a female.  I have excellent credit score of 730 and have never been late on ANY payments and they are not even calling to talk to me, they are looking for Matt.  When I confront them and tell them to quit calling me, take my number off the "Matt" call list, they say they will, AFTER being extremely RUDE, then they hang up on me, won't ever let me say anything else.  I have told three RUDE people to take me off the list, they say they will and I get called again the next day.  These phone calls have been going on for 6 weeks and they still call and ask for Matt.  If I don't answer, they don't leave a voicemail and it's ovbious I am not Matt, my voicemail states my name and my company.  This is infuriating and I am to the point of having my cell phone changed.  This is exactly why I don't have a land line, how do these morons get your cell phone.  I would talk to them IF I was the one they are looking for or owed money, but they have the wrong number and they are RUDE!!!!!!!!!!!!!!!!!!!!!  The only way I know that they are PCM is because I called the number, they never say who they are, they just ask for Matt and then the fight is on.

This number is calling me and harassing my phone, I want answers!  They don't leave messages, and they don't say anything when I pick up.  They call me all hours of the day and night, and I cannot find out who it is.

If anyone knows who this number belongs too, contact the authorities.  This is insane.

If i knew who it was I would have contacted the police by now.

THank you

My phone rings with this phone number 3 to 4 times a day.  I am at work, and then even call as late as 10:30pm.  They don't leave a message and when one is left it is someone breathing on the phone.  This is ridiculous!  I call back the number and it is an automated service and I was on hold for over 15 minutes.  My cell phone company cannot block this number due to the fact that it is a 1-800 toll free number.

I want more facts, and I am ready to press charges for harassment.

Getting calls from this number several times a week looking for someone I don't know.  No matter how many times I've explained that I'm not the person they're looking for they continue to call.  They claim my parents gave them the phone number to reach this girl but won't tell me which parent or how they reached them.

California Debt Collection Agency Settles FTC Charges Of Fair Credit Reporting Act Violations
The Federal Trade Commission today announced a proposed settlement with a California-based debt collection agency, Performance Capital Management, Inc. (PCM), under which the company would be fined $2 million and enjoined from what the FTC called "serious violations" of Section 623 of the Fair Credit Reporting Act (FCRA). According to the terms of the proposed settlement, payment of the fine would be waived due to the company's poor financial condition.

The FCRA regulates the collection and dissemination of sensitive information about consumers by credit bureaus and other types of consumer reporting agencies. Section 623 was added by Congress in the 1996 amendments to increase the accuracy of consumer reports by imposing specific duties upon any entity that furnishes information to a consumer reporting agency. The settlement announced today is the Commission's first enforcement action under Section 623.

PCM is a California corporation with headquarters in Irvine, California. It specializes in buying and collecting consumer debt that has been charged-off by the original creditor as uncollectible. PCM is currently in bankruptcy, and the Commission has waived the $2 million civil penalty based upon the financial condition of the company.

In its complaint against PCM, the Commission alleges that PCM violated a number of requirements imposed by Section 623. First, the complaint alleges that PCM provided credit bureaus with inaccurate "delinquency dates" for its accounts. Section 623 defines the delinquency date for an account as the month and year that an account first became delinquent. This date is important because it is used by credit bureaus to measure the seven-year period that negative credit information may be reported under the FCRA.

According to the Commission, PCM systematically reported accounts with delinquency dates that were more recent than the actual date of delinquency, resulting in negative information remaining on consumers' credit reports long beyond the seven-year period mandated by the FCRA. The Commission's complaint also alleges that PCM violated Section 623 by ignoring or failing to investigate consumer disputes referred by credit bureaus, and by failing to notify credit bureaus when consumers disputed collection accounts with PCM.

The proposed settlement would require PCM to provide correct delinquency dates when reporting collection accounts to credit bureaus. The agreement also mandates the proper investigation of disputes. Where PCM learns during an investigation that account records no longer exist for a disputed debt, the company must delete the information from credit bureau files within five days. Finally, the agreement would require PCM to report as "disputed" all accounts where consumers have disputed the information with PCM.

The Commission vote to file the complaint and proposed settlement was 5-0. The proposed settlement will be presented to the U.S. Bankruptcy Court for the Central District of California, which is overseeing PCM's bankruptcy. If approved, the agreement will be filed in the U.S. District Court for the Central District of California.

NOTE: The agreement referenced in this release is for settlement purposes only and does not constitute an admission of a law violation.

Copies of the complaint and proposed settlement are available from the FTC's Web site at http://www.ftc.gov and also from the FTC's Consumer Response Center, Room 130, 600 Pennsylvania Avenue, N.W., Washington, D.C. 20580; 877-FTC-HELP (877-382-4357); TDD for the hearing impaired 1-866-653-4261. A person named Kyle called for my daughter, asking for her personal cell number. I asked what this concerned and advised him that I, (as an attorney) was authorized to act on and for her behalf in matters, and he refused to tell me what the call concerned, but instead got extremely "smug" and said "I will continue to call you back until I get the information I want." I repeatedly said what does this concern, and he said, "I know as much about legal things as you and I'm not telling you anything". I specifically told him that my daughter doesn't live here and NOT to call me again with these harrassing phone calls.

I've received calls from this company also, as it turns out, they are a collection company called Performance Capital Management, (PCM) and were handling a delinquent account of mine.  They were actually really decent people and helped me resolve a collection issue I had on my credit report.  I wish some of the other collection companies I've had to deal with were as easy to work with.

Received call from this number looking for my daughter who lives in another state.  Caller stated the company was Performance Specialties out of Buena Park, CA.  When asked how they got our number the caller told us that their researchers found it.  When asked what this was about caller stated that it was confidential for our daughter only.  We believe this call was from a collection agency.
Looked the phone # up on-line and it showed PERFORMANCE CAPITAL MANAGEMENT LLC, 1-800-757-7700 out of Buena Park, CA.
