Not sure what state you are talking about, but in a debt collection a civil suit can be filed not a criminal.
So if you do not show they simply pass judgement for the creditor and that person can come after you for the monies owed, NEVER can you be sent to jail for a personal debt.  Creditor Prisons were stopped in the 1800's.

I have unfortunately had some bad debt from credit cards and Portfolio Recovery has sued me every time.  I get served with a court order to appear in court.  They are calling me now and when (not if) I am served, I will get a lawyer to see if I can get out of paying the debt.  In the past I have called PR and have negotiated a settlement.

I was sued by a credit union and on the summons it only says failure to appear MAY cause a default judgment to be awarded to the plaintiff, not we are going to come and arrest you.

These guys are the bottom layers of the collection companies. They buy old or statute barred debt and try to collect 10 to 30 cents on the dollar by harassment and near illegal activities. The problem is most people actually fall for their tactics and try to settle. What most don?t know is that once any payment is made the statute date of the debt turns to day 1 again. Then these guys sell the debt again and other bottom feeders come after you using legal methods. So you can either ignore them or report them. If reporting, know this - these guys know most of the legal loopholes the feds have. So the best thing is to work with your state authorities.

Ugh,I usually would screen calls. But I picked up this time and I did not say anything, hoping to catch her saying where she's calling from. She didn't of course. I looked up this number immediately and found this forum.  I recognize the company name.  They call from 5 other phone numbers as well.

These guys are bottom feeding class of collection agencies. The buy old or statute barred debt and using harassment tactics try to collect 10 to 30 cents on the dollar. Of course once you pay anything the debt clock resets to day 1 and then their ambulance chasing lawyers will sue for the rest. The best you can do is contact your state authorities (don't waste time with the feds, they won't do anything but collect data and publish reports) to go after them.

Exactly.  They have to come up with the contract.  I am pretty sure they can't do that in my case.  Also, I just past 3 years on the original debt at the beginning of June.  They can't take me to court anyway... at least not in my state.

Why dont you all just pay your debts?even if its minimal. instead of looking for ways to beat the system? I understand some of you don't have the capacity or sometimes there are misunderstanding where the balance isnt due because its been paid. But if you really dont owe it why would you let it go as far as collections and ruining your credit?  Ive worked for a collections agency before and a good 70% of the people I used to speak to where well and able of resolving the matter, driving jaguars ,going on cruises or have good paying jobs. Weather or not you owe a collections agency or the orginal creditor the fact is YOU SPENT THE MONEY,YOU OWE IT.

They can not arrest you for not showing up you are an idiot. It was just in the news the NYS attorney general just sued this company and won their leeches who break the law and most lawyers will sue them for no money down and take a percentage of the winnings .

These a@@holes went to my Facebook ,and looked up my friends ,and started calling my 90 year old mother at five and six o'clock in the morning ,now what kind of people would ever do that ? Hopefully that will tell you want kind of pond scum you are dealing with .I have lots of debt from the last recession ,unfortunately i don't have a job so they can not garnish my wages .Do not answer calls from anybody you do not know ,they have been trying to get a hold of me for three years .They also like to send lots of threatening letters ,i rip them into small pieces ,and put them in my compost so the worms can eat them .Please send more my worms are hungry !! Also they have to take you to court ,so never ,ever ,ever talk to them ,and get rid of any paperwork they send you .They want to settle with me for a 80% discount ,yeah right .Good luck you SOB's.......

They have been calling me every day, but when I've answered, no one is there.  When I called back today, the first thing they asked for was my Social Security Number!  Yeah right!  After I gave him my name and phone number, he said that he couldn't locate anything and would try to remove my number.  Of course, not - I don't have any outstanding debts!

And that only happens if they do actually file with your local court which is highly unlikely...plus they have to serve you notice to appear, etc before court. And they could only possibly win by default if you don't show up or respond to the complaint. You can do it pro se yourself and demand proof of the debt owed and that they are legally the debt holder...CC companies don't sell that info to the collectors so they have nothing.
Get an online lawyer after them...they work for free and just get paid when you win the case.

Congrats! Me too! They're very simple minded and never learn.lol Suing them is a fun way to get $1,000 cash and make them suffer a little because let's face it, nobody runs from an alleged debt--you pay til they won't cooperate or take payments or sells your debt to dirtbags like these.
Just Google search lawyers who sue for violations of the Fair Debt Collections Act. It's fun and profitable.lol

Hi! How did you go about that?? These people call me ALL day for something that was owed to them by someone who rented a room at my house  like 5yrs ago.  They won't stop!! I have told them I don't know these people's whereabouts I have no contact what so ever.  They tell me they'll stop calling and it only goes for about 2 weeks maybe and then the calls start again!! I no longer answer my phone, it's so annoying!!

i have a "judgement" against me for a card that should have "died" YEARS ago....but it was sold to a couple of collection agencies so that card is "still alive and kicking me in the a$$!!! It states that if I have over X amount of money in the bank, they can take it, unfortunately for them, I don't have that either...be cautious of the "insurance" that is offered with cards. Had it on mine and "i didn't give them enough notice", it was a freakin' medical emergency and the dr had me off work for months, so guess who gets shafted!!!
