Next time they call, demand that they send a debt validation letter, showing original creditor, amount owed, date of loan/debt, date of last payment, and also if they are legally authorized to claim and collect said debt in YOUR STATE (debt collection agencies must have a license to collect in each state).  They must send this DV letter via mail (not email or fax).  

If they refuse to send this information, or say they've already sent it and don't have to send it again, tell them you're reporting them to the FTC and your state's Attorney General for violations of the FDCPA (read about it and learn your rights - and DO report them).  They CANNOT garnish your husband's wages for a debt that belongs to you (unless your husband is a co-signer of that debt).

Bottom line - no proof that you owe this debt = no money owed to them!  If you are really worried, make an appointment with a consumer lawyer - most lawyers do not charge for the initial consultation.

I recd a msg from these people.  I don't live in CA, can they sue me?  I don't know what the "alleged debt" is.  I'm unemployed, but worried after reading all these posts that they may garnish my husbands wages.  Can they do that?

No this company will hi-jack your home and lie lie lie. They are sneaky and devious. Even if you don't owe it they go after you. They brought a judgement against something I don't owe. Well just to let everyone know this number has been calling all of my family members at odd hours of the day and only saying that they are "association of lawyers of san diego" i have a credit card debt, but this number has not called my number that the credit card company has on file for me, so i called my c.c company and told me if any debt collector assign from them should only be calling my # on file and not any other number.( family &relatives) i will like to know if this falls under the tcpa law. Just by reading some of these post seems like they go above and beyond to harass evryone else around them, i will call these people and ask not to call anyone else but me . I dont think this is a law firm, they only use that as a front, to scare people.Sounds like they are only debt collectors with legal capabilities?

mommiex2:  Same thing happened to me with these people. Apparently there was a court date for me that I did not know about. I guess they had serve papers to something. I was shocked to find out that they have subpoena my bank docs. This was when i found out about all of this. When i looked up my case, it showed that it was in default. I am not even sure what to do as I don't even live in Ca. The papers and court where all done in Ca and I haven't lived there in over a year.

I am getting obnoxious phone calls from (559) 265-5328 who say I Am Angela Mitchelle (which I am not) and I owe $7,000! From Chase Bank Visa and that I need to give them my SSN to varify! I DO NOT owe any Chase Bank Visa Bills! The phone number was redialed by me and the number was traced to Fresno, Ca and disconnected.  If your in California, you can go to this site too. Could not agree with you more! They are rude, insensative and demanding. I was NEVER properly served, NEVER knew about a court date to appeal it and then a letter that was served by the sherriffs to my employer stating that my wages were going to be garnished. When I called the attorneys office, they stated to me that since the court put an order in place there was nothing more they could do. Well there is more that they could do but do not want to do. Research on the internet has opened up a lot of routes I can take!! They would not tell me where the process server served the papers, which by law they have to provide that information when asked. Next, I was told if I wanted to spend a day at the court house fighting this with a "Claim of Exemption" then go ahead. My papers are ready and off to the courthouse I go.......

I am getting calles from this number at work and they are not even for me! Its a guy Glenn, he started out very nice and was asking for someone that works with me but not out of the office (works in the field).  This Glenn guy went off when I told him that I would not take a message and tranfered him to the person he was asking voice mail. Glenn was very very rude and threatening, told me he would not stop calling. I sent all his information to our sucurity department.

A pre-recorded British female voice was asking if I knew a particular person, whose name I couldn't understand. Since I didn't recognize the phone # and name AND that the call was automated, I figured that this was most likely a fraudulent incoming call.

You must be employed by this firm.  This firm demands ungodly monthly payments.  They try to force you to agree to send them an amount of money THEY know you don't have.  They want you to fail at the payment terms so they can file suit and garnish your wages. This firm is a joke and has absolutley no interest in helping the debtor out.

I received two calls from 818-265-5328. (Please see my post under that number. I was  the first to report it.)

A message was left after the second call as follows:

This is an important call for (my name). If you are not (my name), please disconnect now. (No pause.) This is Legal Recovery Law Offices. We are attempting to collect a debt and any information obtained will be used for that purpose. Please call 800-785-4001.  

No correspondence from them prior to calls. Also, one credit card company charged off the debt and sent it to collections. Then, after that was not successful, they acquired the debt again, and it shows as a charge off again, illegally re-aging a debt that is uncollectable.

These clowns use intimidation tactics, which are fraudulent and illegal.

For those of you who are continuing to receive phone calls, send them a Cease and Desist Letter pursuant to the FDCPA and they must stop. If they don't, they can be fined $1,000 per violation (i.e., per call or message or missed call), which can be paid to you if you through an attorney such as Lemberg and Associates.

When I send such letters, I always congratulate them because they have been awarded the coveted Glittering Jewels of Colossal Ignorance Award for violating the FDCPA and will be fined $1,000 per violation. I give them an estimated total they owe me in fines and thank them for making my day.  I also report them to the Attorneys General of CA and the state from which the call was made, along with  a complaint to the BBB as well.

Based on the company's street address, this may really be ACC aka Absolute Resolution Corp., another notorious debt collector.

I have found it is best to ignore such calls.

Tell them the next time they call they are violating TCPA (Do Not Call) laws by harassing a non-debtor and you intend to take them to court if the calls don't stop.

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

TCPA: What Is It & How Does It Affect You?

The Telephone Consumer Protection Act of 1991 (TCPA) does many things - including prohibiting debt collectors from calling your cell phone without your permission. Each unauthorized call could result in the debt collector paying you up to $1,500. Here's some helpful information on the Act and how it might affect you.
What is the TCPA?

The TCPA, which was signed into law in 1991 under the first Bush Administration and codified under 47 U.S.C. 227, prohibits calls using any automatic telephone dialing system or artificial or prerecorded voices to:

?Emergency telephone lines
?Telephone lines of any guest room or patient room at a hospital, health care facility, elderly home or similar establishment
?Telephone numbers assigned to paging services, cellular telephone services, specialized mobile radio services, other radio common carrier services or any service for which the called party is charged for the call
?Any telephone call to a residential telephone line
?Send unauthorized faxes
The only way that a caller won't violate the statute is if express consent has been given - and violations of the TCPA are steep. An unintentional call carries a damage amount of $500; an intentional call carries a damage amount of $1,500. That's per call and regardless of the purpose of the call. In other words, if they call you using an automated dialing system without your consent, they've violated the Act and you are entitled to damages.

How does it affect you?

Most debt collectors use automatic telephone dialing systems to contact debtors. You'll recognize this when you go to pick up the phone and there is a slight hesitation on the other end. In fact, most debt collectors are calling nearly 100 people at a time just waiting for someone to answer. Although many have stopped calling landlines, cell phones are another story. Since more and more people are using cell phones either instead of, or in addition to, traditional landlines, debt collectors are finding their cell phone numbers using skip tracers, calling them and hoping that they don't realize that the TCPA has been violated.

These people keep calling me asking for a Marylin Richardson. I don't know who that is.Yet the
contiue to call day and night. I had just gotten off from working a long shift,trying to get some
sleep and they keep calling me asking for that same person whom i don't even know and never
heard of.What can I do to get them to stop? I'm sick of them calling me and waking me up everyday.

If you have already filed bankruptsy, all you have to do is simply pick up the phone and tell them that you filed and provide your attny's info or even the name of the Firm, and once that info in provided, they cannot call you back !!

Received a call from them saying I owed money to Cittibank and when I told them I don't have anything with Citibank they said oops we meant Capitol One Credit.  We must pay them to settle this debt.  I heard they were companys out there like this trying to make a buck by scaming people in these hard times.  They tell you that you owe some ridiculous amount then say they will settle for a fraction if you pay now.  who falls for this????  Be wary people.  They are under investigation by the state bar and attorney general.

This phone # 800-785-4001 just called my brother, said that his name is Matt Laney, and that he
is a police man looking for me.  This calling # apparently belongs to Legal Recovery Law company,
a collection agency; from what I read on this website.  Obviously this collection agency is breaking
laws falsifying as police officers to threat involved parties, as well as all other debt collection laws,
and it seems all you guys here are bullied, harassed and lied here.  Can someone with authority, expertise and decency to stop those law breakers!!!!!!!!!!!!!!!!
