These people are sleezy they called my house like 7 years ago and tols my husband that if he didn't start paying on a debt that was almost 6 years old at that time they were ing to start garnishing him. So he started paying them 100.00 a month for the last 7 years and when we called called them about 2 or 3 years ago thinging the debt should be payed the debt went from 6000 to 12000 how can they pull that crap so we decided to close are checking account so they would stop getting anymore money from us and not even 2 weeks after they did get any money from us they started calling my husbands work because we have a different house number now. So i called them back and was so mad at the nerve of these people have to try to continue to collect on a debt that is 13 years old. the guy that answered the phone ended up hanging up on me because he said the person I wanted to talk to was on the phone and then I tryed to tell him why i was callin and I was upset that these people are so low that they are going to try to get you for every cent you have.

By law, they can only garnish no more than 25% of your pay check.  You must make a whole lot of money if they are garnishing your paycheck $600 each time

These guys are calling me and I have never had dept problems.  They are trying to get in contact with my parents.  I asked the guy to stop calling my work phone and he said he would be calling every day, and has.  The name he leaves is Mark.  Is there anything we can do to have them stop calling my work cell phone?

There are things to consider - such as how old is the debt - if passed the statute of limitations for your state - they legally cannot sue - but it does not stop some of them from trying.

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

An employee of Ascension has just begun hassling us over an old charged-off, disputed debt.  Ascension is a Junk Debt Buyer.  They've been brought up on charges by various states' Attornies General and have settled.  Nasty, nasty stuff....Do what we've just begun doing:  join Debtorboards.com and they'll show  you how to legitimately fight these criminals.  Also try CNN.com/ClarkHoward.  Most, most helpful.  Good luck to you and to all victims of Ascension!  PS:  Ascension's location info (address, phone number) can be found on the Web via a Google search.

These people have been harassing my mother over an old dental bill that was already handled.  tehy are seeking over $5,000!  I have already spoken with a lawyer and what they probably don't expect is that I have all my related paper work and the info regarding the failed court case where this all ended years ago.  There going to end up paying for em to take them to court if they don't stop and I'm not tipping my hand to them.

Same thing, company is calling my MOM's house everyday and was SO rude to her when she finally answered one day.  Today they just called my CELL PHONE, and told me or my attorney to call him back and gave me a file number.  Name was Mark Pena.  My one and only issue was settled three years or so ago with a bad dentist issue.  I am really ticked off about this.  Very rude people to deal with.

Mr. Long calls my house, my parents house, and my cell phone atleast twice a day.  I have not called them back.  He says he is from ASI and that this is an important business matter.  He gives me a file # and that this is not a collection call and that it would be in my best interest to call him back.  The number he gives to call me back is 1-800-822-1311 ext. 233

I have rec'd numerous phone calls from 800-822-1311, all hangups with no message left. I finally called them today to ask who they are and -wow!- I cannot believe how rude, sinister and abusive they are. They did give their name when asked but would give absolutely no other information about who they were or what they wanted. As I had my cell number blocked, I was told they would only provide that information if I provided my name and telephone. Uhh, no. Called back another (6) times on their 800# nickel asking the same questions; each ended with the Ascension Services, Inc. representative SCREAMING into the phone at me and hanging up. Lol, I guess a little taste of their own medicine left a big sour ball in their mouth. BTW, these jerks must be real rocket scientists because I am now (and have always been) current on all loans and revolving debt. My one and only experience with a collection agency resulted in my suing them and winning. I see Ascension has been named on several Dockets as Defendant and paid fines for either being unlicensed or not following fair collection law practice.

Ashley Hoover left a message on my phone yesterday, 3/23, stating that she had something to tell me and that if I didn't return her phone call, she was calling my employer on Wednesday.  I was told by my attorney that calling someone's employer is illegal in Texas whether you owe a debt or not.

My aunt is in her eighties with Alzheimer's disease. These people have been calling her non stop and upsetting her immensely. They are telling her that they are looking for me and that if I don't call them that they will send me a summons. I have heard about this company before. I have had debts and do have them now which I am working out with reputable companies. This is not a reputable company and I do not need to pay them a penny. It seems to me that they somehow get numbers from real collection agencies and find people that don't know any better and take their money. My aunt's doctors will be more than happy to help with this situation and the distraught that it has caused my aunt, and I will be more than happy to have the authorities notified.

I or my wife got a call from some super rude person named Donvon Winters who left this number as a call back number for my Son that i have not talked to in over a year now.  They said they would keep calling my number because this is the only number they have for him.  Well thats tough i will not be victimized by this piece of work or my wife put up with rude callers when i have no direct dealings with them and can't wait to go to the states attorney general with a complaint against them.  They have no right to call me at all, so burning them will be so much fun for me i can hardly wait. The best part is i am on both do not call lists, i think i can get that against them too.  If they were smart they would put me on there do not call list but i dought they are that smart...... or they would not have called in the first place in Minnesota laws are tough for collection companys and lots can boom a rang on them.

I have recieved phone calls from this company for the last 3-4 months, I am not the person they are looking for.  I have asked for them to remove my phone number from their file, they will not do it.  Yesterday I recieved calls from Ms. Miller at 1:14, 1:16, 1:18, and 1:20 asking me to call her back.  I spoke with a Ms. Davis yesterday stressed to her that if I continue to get phone calls I will sue them for harrassment.  So, what in the hell happened today, Ms. Miller called me again today at 2:52, but denied it when I returned her call.  I spoke with an Ashley Hoover, she was completly rude, even asked me if I ever heard of the delete key on my answering machine and that I should not be concerned over something that has nothing to do with me.  I told here that since they continue to call me I am involved, and asked if she ever heard of identity theft.  Thanks to this site I was able to contact the so called "owener" Jay.  He said he is the not the owner but the manager and has not seen or heard from the owner in 6 years, sound legitimate to me!!!!  He was a complete jerk and said he was aware of what was going on with me and said there was no way they could have called me today, my number has been blocked from their system, they cannot call my number, sounds fishy to me!!!!

I do owe a bill to them,I am 61 years old and have nothing for them to garnish from, i don't own anything for them to get,Because of the economy i lost my business. I get at least to 2 calls a day and do not answer them anymore, When and if it does go to court , i will be their with bells on. The base bill was approx, $7,500, it's now 14000.00 They don't realize the judge will negotiate it for 50 percent and then set up payments for me. I am not ducking a bill i owe but when they were the only fish with teeth in the tank that took it this far. The rest of the companies i worked with one on one and eventually paid them off without the Collection wolves. I know the bought the debt for 25 cents on the dollar. I want them do something stupid so i can look the beedy eyed rep. in court and ask why all of this. Will pay but not their way

Carol Davis continues to call every week and leave a message on my cell phone asking for William Wheeler, concerning file number 71243. There is no one with that name at my address. They may be looking for my ex-husband, William Weiler, (pronounced Wyler) whom I divorced 20 years ago and have had no contact with since. If so, they have no right to be harrassing me and I would like to know how they got my cell number. Due to the above comments, I have not called the number back and I screen my calls.
