Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Called a family member and stated they had a court summons for me. Told the person that they had a civil suit filed against me and summons had been filed for my arrest with the court. The person gave me the 1800 number a "case number". I called and they said D&H first, D&C second, C&D third, was hung up three times. Finally a person spoke to me. Wanted me to provide my full ssn and date of birth to verify my identity. I refused and stated the issue i had with the info given to my family member. Their response "Well we use an outside calling agency and they do whatever they need to so that you will call us."

They called a family member asking for a different family member saying that someone had filed a complaint against them and they needed to call this number. Left case number but when you call, they send you to voice mail box in which you can not leave message. Does anyone know where we can file a complaint against these people?? This should not be allowed. They scare and worry elders when they get these calls.

Got a Call from a "location"  company who referenced this number to call as well as a case #.  She said the sheriff department was trying to serve a warrant.  She had a heavy Indian accent.  Called the number they gave me and the person who answered called the company D&H.  Figured out it was a scam,  and now they won't even answer their phones for me to tell them off.

We got a call from this number 18008291831 today and they said they were looking for someone. They said that she has an arrest warrant issued for this person but could not tell me anything about it because it could only be the person that they called about. What the f***, they said she needs to settle this but I don't talk to her will be calling the sheriffs office to follow up on this to see what they have to say. If you are scammers, suck it!

Debt is civil, not criminal, so you cannot be arrested, even if you did default on a loan.  Anyway, if you had committed a crime, you wouldn't get a heads up of your impending arrest - the cops would just show up!  Your caller is a scammer or junk debt buyer.  Per theFDCPA, you should not pay any caller who refuses to MAIL - do not accept email or fax - proof that you owe a debt and proof your caller has the legal right to collect said debt.  Refusal to mail this documentation is a violation of the FDCPA.  Please do report these jokers to the FTC - www.ftc.gov, the FBI - www.fbi.gov, and your state's Attorney General.  You can find your state AG at this site - www.naag.org.

I have a client that received a call regarding a Verizon Wireless bill. My client is deaf and so I went to call and tehre is a generic voicemail. She said the name of the company is ASPS and they told her that they were suing her and sending it to the judge... this would be called a judgement. As well... this is an FDCPA violation. An FDCPA violation is a contingent case for consumers from the attorney that pursues the "collection" company and you are awarded $1,000 per violation. Look up the FDCPA violations and ensure that there aren't more violations they are throwing out there.

The problem with a company like this is that if they are found, the likely result would be a judgment for the FDCPA violation and that helps no one. Request a cease and desist. You can only be contacted to let you know that they will not contact you again and to let you know if a debt escalates to suit. At which time I recommend calling a consumer attorney to review the information as it will likely be an FDCPA violation if the debt is not valid or has reached a statute of limitations.

My coworker got the same call today 3/25/14, caller said a summons was going to be delivered to him by a sheriff,  as a complaint had been filed, coworker had no knowledge of any issues. I've seen this number before, it's a collections agency trying to collect on old OLD dept or in some cases completely fictional. DO NOT CALL THESE PEOPLE.
