This unsolicited number has made numerous calls to my home over the last 3 months or so. It is annoying as hell,and even though I am on the "Do Not Call" list they do it anyway. I wish they could be stopped.

Keep getting calls from this number. Do Not Call never really works. The only way to subdue telemarketing is not to do any telephone shopping at all.

Although very annoying, etc.  The real losers are any callers who are legit or have a true cause, because I no longer answer any calls that I do not recognize.  It doesn't matter who you are, I won't pick up.

Keep calling for a person who has never had my number and have no clue who it is.  They call and say they are collecting for a university and then the next time it is for something else.  I've told them and they continue to call.

What You Can Do

The FCC can issue warning citations and impose fines against companies violating or suspected of violating the do-not-call rules, but does not award individual damages. If you receive a telephone solicitation that you think violates any of these rules, you can file a complaint with the FCC. There is no charge for filing a complaint. You can file your complaint using an online complaint form. You can also file your complaint with the FCC?s Consumer Center by calling 1-888-CALL-FCC (1-888-225-5322) voice or 1-888-TELL-FCC (1-888-835-5322) TTY; faxing 1-866-418-0232; or writing to:

Federal Communications Commission
Consumer & Governmental Affairs Bureau
Consumer Inquiries & Complaints Division
445 12th Street, SW
Washington, DC 20554.

What to Include in Your Complaint

The best way to provide all the information the FCC needs to process your complaint is to complete fully the online complaint form. When you open the online complaint form, you will be asked a series of questions that will take you to the particular section of the form you need to complete. If you do not use the online complaint form, your complaint, at a minimum, should indicate:
?your name, address, email address and phone number where you can be reached;
?the phone number where you received the call, and whether this number is on the national Do-Not-Call list;
?the date and time of the call;
?whether the call advertised or sold any property, goods, or services;
?any information (including a caller ID number) to help identify the individual or company whose property, goods, or services were being advertised or sold, and whether any of this information was provided during the call;

Federal Law - report violations to FCC.gov

Caller Identification (ID)

If you have caller ID, a telemarketer is required to transmit or display its phone number and, if available, its name or the name and phone number of the company for which it is selling products. The display must include a phone number that you can call during regular business hours to ask that the company no longer call you. This rule applies even if you have an EBR with the company, and even if you have not registered your home phone number(s) on the national Do-Not-Call list. Before these rules took effect, the words ?private,? ?out of area? or ?unavailable? might have appeared on the Caller ID display.

Texas Consumer Protection Law Re: Telemarketers -
Under Texas law a telemarketer may not call consumers at home before 9 a.m. or after 9 p.m. on a weekday or Saturday, or before noon or after 9 p.m. on Sundays. The law also requires that a telemarketer provide the consumer with the name, street address, and phone number of the business for whom the telemarketer is calling, as well as the name of the person calling and the names and titles of those in charge of the business. A note of caution, however: fraudulent firms often will change names to avoid detection. Any contract made as a result of a telephone sales call is not valid and enforceable against a consumer unless the contract is put in writing; fully describes the same goods or services discussed on the telephone; contains the name, address, and business telephone number of the seller; and sets out in full the total price, and any terms and conditions affecting the sale. Texas law further provides that a telemarketer (except a public charity) must offer a full refund for all undamaged and/or unused goods returned by the consumer within seven days after the consumer received the goods or services. The seller must process the refund within 30 days after the consumer returns the merchandise or cancels an order for undelivered goods.

Consumers can protect themselves from disreputable telemarketers by requesting full information before completing any transactions. If the telemarketer refuses to comply with these requests, simply hang up.

Am being harrassed on a daily basis by these types of numbers - this is the third number to call - leaves no message, just like the other two.  Caller ID was "800 Service."  I'm sick and tired of the phone ringing several times/day with these numbers - 'nough said about the Do Not Call list.

Sometimes caller ID says Dial America, sometimes not.  They call about twice a week.  When you answer nobodys there.  Some calls are local, some are long distance.  I stopped answering numbers that do not reconize for this reason.

For those of you interested in history, DialAmerica was created by Time Magazine in the 1970's to market their magazines, and has been independent of Time-Life since the 80's.  Headquartered near Paramus, New Jersey.  Satellite operations all over the country.  To my knowledge, they are a legitimate, but annoying company.  Their founder and owner after Time, Art Conway, had the idea to sell magazine subscriptions on behalf charitable organizations on a commission basis.

Dial America is contracted through several different magazine publishers (ex: Southern Living, Readers Digest, Vogue, etc ) to help renew subscriptions. DialAmerica only calls those they have a previously existing business relationship with, which is the reason you may still be getting calls if you are on a state/national DNC list. If you do not answer they will record you as being not home and will return the call after 48 hours. As far as calling multiple times throughout the day, the dialer is now set so that they can not call more than one time within a 48 hour period. If theyre absolutely driving you mad, the easiest way to get rid of them is to simply ask to be taken off all their calling lists. this ensures youre taken off all their lists instead of just the one theyre calling on behalf of.

Hope this helps you all :)

So far, six calls from this number in May.  One each on  May 4,

After the first one, and thanks to  you on this site, my computer now
