Mrs. Dickenson called me too and I forgot her name till I looked up this impossible website. Same story with The Menu/Entertainment Extra Magazine lead me into false promising and refusing to give a copy of the contract which I requested. A Chiropractor in building placed a ad with them, so I went along with it and he has no copy of his contract either. The salesman "Brad" mislead both of us on the payments of $90 a month. They have billed us $259 for a 6 month installment payments "thanks Brad". And yes she stated "serving of papers and suing in court". Then she directly hung up on me. I called the 800 number back and got ahold of the company located:

This company called "The Menu" has a partnership with Entertainment Extra Mag. Two people own the rights to the website. And believe it was taxing trying to locate information. I live in San Diego and just opened my business. A Dr. in my complex placed a ad in menu so I decided that it was safe. We both have horrible stories about pursuit and completely misleading sales by this weird little man named Brad. He told us it was in their main menu (NOT) a to go. I found this out by going to the business that we were featured in. The girl actually had to search for them under the counter. My ad was 2 pages from the back with a business that does Cosmetic Permanent Make-up! That's a conflict of interest. The company told me that I needed to request ad placement "Brad did not tell me this either". I have only paid the $199 like everyone else. I refused to pay the rest because (Brad) told me my monthly payments would be $90 bucks. Totally reasonable for a start up business. I received my first a bill for $259! So I called them and asked for a copy of my contract (the Dr. does not have one either) which they never sent me. They told me that I had 6 installments coming to me, I was really pissed. I told them to cancel it and I'm shutting the doors. She stated I would be served papers and taken to court then hung up on me. I called back and she refused to talk to me. The Dr. is completely interested in going after the company too. He said he looked for 30 minutes and could not find ANYTHING on the company, like they don't exist. Same problem I had.
I'm willing to be involved and want to help othesr for falling into this COMPLETE SCAM.
I am filing a complaint with the San Diego Police Dept. Division and Consumer Protection Agency. Any information on progress with past problems and if they were resolved will be GREATLY appreciated.

We were promised magazine tv commercials and an exclusive spot for our company. They went around to every other similar company and scammed them too. We paid them what was supposed to be a one time fee of  $250 up front for 3 months. After that they got into our bank account and stole money two times. We had to close out our bank account. Now they're sending letters threatening to send us to collections. They haven't done a single thing they promised and are expecting to get more of our money. These people are nothing but scam artists.

The enitre company is a sham and Don Malatesta the attorney who is collecting for them is a sham as well in my opinion.  Why would anybody go to college take the bar exam and represent such a fraudulent company unless they are in on it???  Dont pay anything.  Write a complete history along with copies of all the complaints online and turn it over to the District Attorneys Office.

I got the same thing. Some rude lady calling tell me she was going to garnish my wages   and put a judgement on me. Today I got some guy calling basically threating me with court and telling me I dont have any money thats why i wont pay them. They keep asking for 500.00 what a joke such a scam. I never got any proff back or any response from this company. They do not comunicate with you after the have you sign there fraud contract. I am tired of being lied to and pushed around my fraud. Anyway just wanted to add in the same people calling me with the same stuff. If you to the rip off report they are all over that with about 40 people complaining. UGGGGGH!!!!!!!!!

I got a letter today from Don Malatesta too!  Stating that I had to pay him directly $1072 or an action suit will be filed!  I cancelled my contract after my business closed back in Sept. 2012!  Carl Winslow out of Columbus Ohio was my sales rep and he told me that all was taken care of!  Did anything ever happen with any lawsuits out there?

Hi!

I was scammed by this company by a few hundred dollars.  No result came from from advertising with them so I stopped paying and then they forged a check in my husband's name bc he made one payment on my behalf.  Well, hubby was never part if the fraudulent contract; he merely made one payment for his wife's business which means they had no business going after his $ by claiming on the forged check that it was authorized.  Baloney!  We filed a fraud report with B of A and they basically said OMG and refunded the stolen $.  We also filed a police report and the PD basically said OMG, fraud.  Later, a Don Malatesta wrote me letters demanding part of the balance of what I was supposed to pay.  Funny how he didn't ask for the entire amount of the fraudulent contract.  Wonder why.  To make it easier for me to fork up the $?  Living Well used to take their duped clients to court although the contract stipulated arbitration ONLY which means they broke their own contracts in a court if law (illegal).  Later someone called them out so they could no longer pursue claims in court which is how I rec'd the collections letter ( their last resort).  I'm reading the exact same story on this site.  Please don't buy into the intimidation and pay these frauds a dime.  My attorney is handling my case in Pasadena CA.  If anyone wants to join some sort of class action, contact Alan Romero at Romero Law 626 396 9900.  My attorney says he plans to sue these MF's by end of 2012.

I'm in this company is a joke! No return calls, billing issues, no tv ads as promised? WTH Mrs. Dickerson is rude, unprofessional, wanted me to give credit card number to her, she wouldnt tell me her company name, address, etc, or even phone number?
   Told her I have had billing issues, no return calls, mislead advertising promises, ads not updated, art department is a joke, salesperson doesn't return calls. Told her I would pay my invoice once they return calls and fix invoices, and run tv ads like promised. I was double billed, called no answer?
   Offered have the money owed$340.00 will pay other have once ads are done liked omitted. Told she wants 1325.00 and we are done doing business? I told her you ran one correct ad and never fixed my ads, ran commercials,etc. I am not paying do to breach of contract.
   I am waiting for my court case and day in court! She had my case number so she says? I said what court so my lawyer can show up and then she stated we have to serve me? I asked doesn't that happen prior to court case number issued? I said what court did she file so my lawyer can check the doc schedule she
filed in and I will show up with my lawyer? No answer from her she got upset and said see you in court I told her make sure she brings  her salesperson Steve love to see them!

I am in a nightmare situation with them too!  I stopped payment of a debit charge with my bank - they sent my living green contract to the bank and now the bank is going to pay them and the bank doesn't care that they are a total scam!

Same thing just happened to me.  It's been going on for years now, all across the country.  I say we finally stand up to these people and shut them down.

I am going to start a FB page titled *Occupy Living Well Today Magazine*.  (perfect, huh??).  Join it, and spread the word.  Let's all work together and stop these guys from continuing this scam.

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

Have also been scammed by Living Well Today...and just recently received a letter from Don Malatesta demanding the remaining $536.00...Living Well Today also debited from my account without my authorization and wrote fake checks against my account...I had to close both personnal and business accounts.  They are horrible people who did not live up to the contract...and they will never get another penny from me!!!!!!  BRING IT ON DON MALATESTA!!!!!!!!!!!!!!

Same thing happened to me.  I refused to pay the bills and they wouldn't return my phone calls.  I finally got an e-mail from them and I told them I needed a call back as I had contacted my attorney - they started charging my card.  I had the charges reversed by my bank and closed my debit card.  I have asked my step-father who is an attorney to write a letter.  Why can nothing be done about this?

I just called the "Los Angeles District Attorney" they said that there's not much they can do about this, that I have to take this company to "Small Claims Court" which I intent to do. But it would be nice if I could get a few of you, to do it as-well so that all of us could show up in court the same day. Let me know...

Received a letter from Don Malatesta: Attorney at Law. He is demanding money from us for Living Well Magazine.Letter was not certified! The shoddy advertising we got for our business was unbelievable. We were told that our Ad would be out 2 weeks before Valentines day at a very busy Restaraunt. The magazine was not placed there at all. We were told it would be placed in another busy supermarket. The magazine was not place at the supermarket until the beginning of March! And it was placed in an area where no one could see it! What B.S. and a waste of several hundred dollars for an ad that no one saw for Valentines Day. What to do about this attorney. Any Ideas from anyone else who was scammed?

I'm new business. With very limited funds so the service this salesman was selling seemed like a good deal.
Unfortunately it was all lies just to get me to sign up.

Living Green today Magazine is not something I was not familiar  with. I was lead to believe it was new.
Something Kroger grocery store was going to be handing out. I could advertise my small business for 200$ down and every 3 months 280$.

The lies are listed here... The magazine would be put in every Kroger's customer bag.(that's why I thought it was new.. I shop Krogers) It would be in ALL local Krogers ( I was ask what Kroger I shopped at.. I now know this was to mislead me and this would be the one and only Kroger the magazine would be at.)

It would be out August 1st ( August 13 still not there I have a video and photos to support) I would not be billed until after first month of publication (billed right away) It would reach thousands of customers (actual statement "going in every customers bag in every local Kroger Store.")

Would in crease my business 50% Salesman quoted last statement again. Kroger is the main advertiser and has a interest in this magazine. My ad would be under Bankston Chevrolet  next to NRH20 (absolutely thing that sold me) NRH2O is a local family water park which I knew would get my ad attention!

I would have 20, 8 second commercials. Someone would come to my store to help with those.(no one has) I would be sent a list of times and channels commercials would be on. (never received) Salesman guaranteed the commercials would NOT be late late night or pre dawn hours. Primetime hours only. The truth is only a very few maybe 10 magazine printed and put in one store on a rack in a corner of the store blocked by carts. ( as of August 13 "NO" living green today Magazines)

I have witness to everything this salesman sold me. Please feel free to contact me if you too have been scam by this salesman and magazine. I will be contacting the Texas Attorney General.

their Saleman totally lied to me about everything... I am so mad... I can't believe we can't do something about this!!!! They need to be held accountable for what their salemen are out there saying to sell this advertising.... I am in on any class action law suit if you all get one going... these people need to be stopped... I am a start up company and I did not have the money to spare... but, I thought what he was telling me was so awesome that it was worth it... ugh... what an expensive lesson to learn!!!!

I am very interested in a class action suit. Has anyone looked at how long they have been doing this and apparently getting away with it! They ripped us off. No advertising as promised, they went into our bank account and drafted 2 paper checks 2 days apart without our permission. The bank (Bank of America) investigated and said it was check fraud and got us our money back. Go on Rip Off Report and BBB - you should see the reports! All of them sound like ours! It looks like they just keep changing the name of the company to keep on going.

Same story here guys, scam , scam, scam. The company seems to prey on new businesses. I thought something was fishy and after a few month and terrible customer service I decided to google "living well today scam" and "national advertising center scam". Immediately I changed bank accounts. Now I am being sent a letter by the law offices of Glibert Moret for collections. I am in Long Beach, CA. They claim they will sue. Bring it on I say. Has anyone taken it this far?
