I have being called from that  phone a lot of times; they also called my son cellphone number trying to collect a defaulted loan. They are very naughty a nd harass us all the time.  They never gave us the company name nor their address.  That was a private loan.  I talked to the lender but they know nothing about them´cause the loan had been already paid by the guarantor.  What should we do?

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) (Pub.L. 109-8, 119 Stat. 23, enacted April 20, 2005), was a law enacting several significant changes to the U.S. Bankruptcy Code.

BAPCPA amended § 523(a)(8) to broaden the types of educational ("student") loans that cannot be discharged in bankruptcy absent proof of ?undue hardship.? The nature of the lender is no longer relevant. Thus, even loans from ?for-profit? or ?non-governmental? entities are not dischargeable..

I'm dealing with the same thing.  He calls as Jim Ryan sometimes and Bill Schlise (spelling?) at other times.  I want to request something in writing verifying the validity of the debt, but I don't want to give this guy my address.  Any ideas?  I could have something sent to my email address.  Thanks!

Craig - VERY good information.  I got a call that sounds a lot like what everyone here says they get.  But he does identify as calling from Evan Bronson's office and that it's not a sales call and that it's urgent I call back.  If I don't - what can be done?  He doesn't say HE is Evan Bronson, or that he's trying to collect a debt.   How long will the calls last?  Why do several different numbers show up on my phone?  Did you actually have a defaulted loan that you just didn't pay to him?  Thanks for any response, Craig (or others)

Credit is considered a privilege. It is based on the borrower's or debtor's reputation and their promise to repay any debt incurred. When the debtor's fails to honor that commitment, they leave the creditor carrying the expenses of the debt. In cases of high bad debt, drastic action may be required by the creditor. They may need to offset the cost of lending by raising interest rates. Some businesses may implement a finance charge. Federal law dictates how high rates can be. In rare cases, a company may need to increase prices. This means that all debtors are paying for the costs of unpaid debt.

Thank you for all of the info. I have received many calls from this number and they have the wrong number. Each time I attempt to have them remove my number, they keep calling. Also, they "do not feel comfortable" giving me their address. They never give a company name, voice mail just leave a person's name. They leave "Jim Ryan" as the contact name, but the name used most recently is "Doug Hearn." The voices are the same. I appreciate the address listed.

Yes.  First off, request proof in writing of the debt he is trying to collect.  Second, ask for his mailing address.  Third, draft a cease and desist letter and mail it to him.  Written cease and desist orders must be followed per FDCPA and if he does not follow it you have a harassment case against him.

However, with regards to wage garnishment...if someone (this guy/any one) takes you to court over a civil matter and wins your wages can be garnished as a means of executing the judgment in all but a handfull of states.  Wage garnishment is the preferred method of involuntary debt collection, along side filing liens against assets.

OH Evan.. he keeps calling me to when I told him not to.  At first I was scared because I though everything he was saying was true.  He even threatened me with a tax attorney.  He also said my wages would be garnished even though this a private loan.  Which leagally they can not do anything to you.  He is unbelievable and I honestly do not wish good things upon him.  Anyways, he still calls me everyday.  He calls at all hours from 8am-8pm.  Does this guy have a life? I don't know how to make him stop calling me.  Any suggestions?

READ THIS THIS GUY NAILS IT!   800-886-5904  also another number with a 216 area code...  Let'um die...

"This is the 800# for Evan Bronson's office.  This guy's a real hard@$$ and doesn't follow any rules regarding the fair debt collection practices act.  He's a pro and buying defaulted private student loans from Key Bank (not their federal loans - loans that Key Bank backs...for example those through Great Lakes Servicing).  He'll buy the defaulted loans at pennies on the dollar and anything you pay him is gravy because Key Bank has already written the loan off as a bad debt.

If you call him he'll start in trying to be nice and tell you he's going to help you re-build your credit by establishing a replayment plan.  He really wants you to initiate a EFT - that way he'll continue to debt monies even if you don't initiate a regular monthly repayment plan with this guy.  If you balk on the EFT he'll do a complete 180 and turn nasty - he'll threaten you with all sorts of legal proceedings - none of which he'll follow through on.

But if you're smart - you can get him in small claims.  As I said, he never follows the fair debt collection practices act - he doesn't identify himself a a debt collector, he'll continue to call you even after you tell him not to, he'll threaten you with wage garnishments and so on.  All of that is in breach of the fair debt collection practices act - and is a $1000 fine.  Record any/all conversations with him, maintain records of anything you send him and send it certified mail - then after he's called you enough times after you've told him not to and you have the good on him take him to small claims court.  He won't show and you'll generally get a default judgment.  I should know - that's exactly what I did.  He's still not paid the court after two years - and the court is getting rather upset with him so I can only imagine the guy's got a load of cash to not care when a state court mandates payment on a default judgment against.

And...he's still calling me periodically".

Approx. 3-5 calls a day.  Like the majority of other folks' comments, when my machine picks up, the recording is already in progress. They do not identify themselves, their agency/company, etc.

We get phone calls from this number on a rather irregular basis but nonetheless they are annoying. The never identify who they are. what they want, or who they are trying to reach. I suspect this may be another identity theft scam. Most collection outfits if the debt is legitimate with give the number, name of the person they are trying to reach, and state if it is in regards to a debt. There are so many phone and internet scams out there now it's difficult to know who to trust anymore. I would also think if they are a collection outfit the caller ID should show their name. I get other calls that simply say unidentified or anavailable. I would have thought that was illegal.

Calls repeatedly. The cowards do not identify themselves, or state what they are fishing for. They should be banned from contact. I assume this is from some shady collection agency, but since they have no courage, nobody should ever respond to their cowardly attempts to force a payment for a falsely claimed debt.
