I didn't receive a call, I noticed a charge on my credit card that looked odd.

I see their is a guy that claims to be a lawyer above and by the basis works for PARAMOUNT ACCEPTA HOLLADAY ut. I do work in a legal department and after being billed, I suspected a fraudulent charge. It did turn out that it was the Gold's Gym membership fees that are processed by PARAMOUNT ACCEPTA HOLLADAY ut, on the contract it only states that they would be processed by Paramount Acceptance. The added Holladay ut at the end is minor legal negligence that would not void a contract--similar to getting a traffic ticket and the police officer misspells your name, there in traffic court they correct your name and you still get charged for that ticket, aka minor. You want to focus for major changes or inconsistencies within the policy/agreement--if you did accept services like physical fitness trainer, you will most likely be liable for those used services.

I will focus on my basic contract--gym use only and point you to weaknesses that might aid you in yours!

However, I can assure you that at least the contract made by Gold's Gym, near Fort Jackson, SC is not bullet proof as would be suggested by GrmRpr. For one, the sales guy is also a binding verbal agreement, look up your statutes of frauds with the problem being your word against theirs, meaning the writ document has more weight but a court could weight the verbal agreement with less weight and that it would need more proof to offset the balance. Most of these contracts would be under 5K, and for most States that is Small Claims Courts.

Second you can scroll down to a section that states "You understand that you have signed an installment promissory note..." Goes to a line that says "You understand that, except as herein provided, your membership is absolutely non-cancelable by you." --subtract the legal moron, has no idea how to logically structure a sentence, that wrote except as herein provided, the contract on the reverse side which goes to "herein" Additional Terms 9. Member's right to cancel. You have 3 options that allow for cancellation of the agreement--members death, physical disability which is permanent and certified by a physician, or relocate to an area outside of 50 miles from there Gym if they can't allow for access to another gym in that area.

Focus on number 3, First I'm never going to drive 50 miles to work out, the idea of driving 100 mile round trip to a gym would be highly unreasonable--and I would fight that in court. I would guess 10 miles would be the limit of most of the populous to drive.  Just what does it take to be established as a residence--6 months to a year in most states before you become a resident, a P.O.Box just requires you to say you want one and where, and physically pickup your key at that Post Office, along with the other Patriot Act things...Meaning I'm from say NY, in the Military I'm stationed at Camp Pendleton, CA, I want a mailing address in Montana.. even though I have no physical address in that state I can get a P.O. Box showing my ids from NY, and the other Patriot Act documents. I can then forward that mail back to Camp Pendleton. I have now moved to Montana to a location and as I state in that document it is a permanent move--sent from that location, out of range of 50 Miles to a Gold's Gym or an equivalent gym in which they could arrange access for me to use. So while you are at that location picking up your key, go ahead and pay to mail the certified letter to cancel the contract with that new address--add new little things like a Goggle Voice number with an area code from that location and have it ring forward and ring your current cellphone. Google voice will tell you it is forwarded from the Google Voice line so you know they contacted that number...and I think that would be reasonable proof that you have permanently changed location--enough that Gold's Gym and Paramount Acceptance Holladay ut won't waste resources to try to get another 30 bucks a month out of you...

Technically, you don't have to go to the extremes as hopping states, there are places within your own state that no gym of equal quality are within those 50 miles, you simple drive to that Post Office and can change it from there. It is important for you to take the time to research and I would suggest a country location that the only thing they have within 50 miles is a WalMart...You can find those all over-- a camp ground location. http://www.ehow.com/how_8458043_po-box-another-state.html could help.

Personally, I specifically told the Gold's Gym representative I would only be in the area for 6 months, then moving to another base, they rep said it was no issue, simply give him a copy of my orders and that would void the contract...unfortunately I did know how to read and pointed out several errors on the contract, then stopped realizing that the contract I was signing would not be worth the paper it was writ on. I will simply use the Gym for 6 months then terminate the service. But after looking at the numbers, which no calculator was there for me to verify the number, the contract billed out for two years and interest on that two year upfront payment. Most in the engineering field will recognize it as a sinking fund that takes the entire payment from the beginning and compound interest is accrued throughout the entire term, So now I come in with the Major flaws in the contract that a judge or arbitrator might lean more weight towards an invalid contract. Straight like has Amount paid in Full 499.00--does not indicate but is for two years not six months, enrollment fee 1.00, processing fee 24.00, total 743.80. As any third grade student could add those three numbers and would get 524.00. So the contract is invalidly fill out by the rep and is misstating the actual cost. Financed cost is represented in a different subsection of the contract. When I go to the next section about explaining the annual interest rate and the amount of credit are lined thru. So technically on my document I am not being charged any interest rate and no finance fee for paying it on the monthly basis. Now it jumps to the amount financed, well it is not 524.00 but is 688.85 for both the amount financed and total of payments,  then an additional 54.95 immediate payment is added to come to 743.80. So to finance 524.00 I am being charged 164.81. Now there is no indication of a discount given by paying now as opposed to paying the full amount and I am not being charged a interest rate or a finance charge...so where is the 164.81 coming in that amounts to an interest rate of about 31.5% in two years--or F=P(i+1)^n ~ i = 14.7% per year ,not represented on my contract. The way my contract should have read was for 6 months 179.40 + initial payment of 54.95 and the total contract should have been  234.65. So this brings me to a more Legal backing point next!!!

Truth in Lending Act, Subpart A--General, Subpart C,  Closed End Credit--as my example above is a fixed 2 yr payment. Because Gold's Gym did not properly disclose finance charges or clearly state the interest rate as required by this Federal Law and is a major error in greater that 0.5% of interest rate,  I find the contract void.

For those whom are receiving credit collection calls I would also reference FDCPA, Fair Debt Collection Practices Act.

Hope you had the 8 hours to read this and can apply it more within your case.

I work for paramount acceptance... all of you signed a contract.. it is NOT a collections company. It is a finance company. We handle all of golds gyms accts as well as many other gyms across the nation which means you then owe money to us and not to golds anymore (which is printed in your contract). the problem that most of you don't understand is that you sign a contract and are pissed you didn't read it so therefore you think we are a scam. We are allowed to call twice a day legally to collect unresolved debt . So for you f****n idiots that sign a contract and think your better than it... grow up and take responsibility for obligations YOU agreed to...

This number is Paramount Acceptance in Holladay. They handle collections from Gold's gym. Don't be surprised if you're not expecting a bill or call from them because I was never told about paying an additional $30/yr. when I signed my Gold's Gym contract. It's all about the hidden fees!

I signed up for Golds Gym about 5 years ago, they recruited me where i worked for gold gym doing sales and prospecting as well as front desk. The manager at the time, Tammy said not to worry about the monthly payments, that she would delete my account, so I didnt worry. Until they sent me to collections, by then I was just frustrated at the thought I left it alone. NOW i recieved one call just recently from paramount who I had no idea who it was. BUT REALIZED THESE PEOPLE ARE TRYING TO TAKE OUT MONEY FROM MY BANK ACCOUNT AT 14 dollar and some change increments!!!!!!!LIKE 3 times and declined my card that is new that I never gave them!!!!!!Beware of these people and if you work for paramount trust me you will hear from me today and I am taking every action I can against what your doing. this is so illegal

The person behind the desk is a sales person and they lie!!!!!!!!!!!!!! Alway read the contract you sign and if they will not let you bring it home and read it in your time tell the to shuv it. things to look for, Cancel policy is to be held to the letter in more cares than not you must submitt written cancelation    (send it certified mail) this wat if it ever comes back to bite you, you will have proof of your own, also get a letter from the contract holder stating the cantract has been satified and there are no funds owed.

bottom line, Gym sales people are EVIL

Wow, Gym contract are tricky some will continue to run till the end of time, unless the contract is satified to the terms of that doc. the contract holder can continue to add every month and year.

People, get a clue. If a company is billing you and they are doing so by way of an mistake on their part and you are not really liable for the bill, just call your CC company and tell them you lost your card. They will issue you a new one, with a new account number. At least the future errant billing will stop. Then you can spend your time trying to recover the money that was stolen from your acct while not worrying about more money being siphoned out of the acct you closed.

My accounts are paid in full and I don't have any month auto deductions.  So, I am wasn't sure about a one-off charge of $15.99.  My request was simple, I just wanted to know what it was for. I have no problem paying it if I knwo what it is for.  I really just want to ask a live person a question. No big deal.  No complaint, just wanted to know what the $15.99 was for.

Every call is just perpetual voice response unit. Then perma hold, then forced into a voice mail box.  Then tried calling back several other times and, although the receptionist has a pleasant voice, she is nothing more than a mere robot herself.  She clearly has caller ID, because she would just pick up and then auto transfer to the voice repsponse unit.  So, I used a different phone, she answered, I asked to speak to someonw so I didn't have to put in a formal dispute on my credit card and she pressed the transfer button again.  This went on for over an hour.  I make more than $16 hour, so now they are costing me money.  I will let my credit card company get the answer from them and file a formal dispute.  Easier than waiting on perma hold.

Paramount Acceptance. They are the billing company for my local gym. Fitness Nation. I signed up with a friend and paid for her initial membership fee with my cc. They then began to bill me for both accounts so I contacted them and said my friend was going to pay herself please stop billing me for that account. After making me write an email and getting her to write and email saying we wanted to stop auto-withdraw and use the coupons for manual payment we started paying each month manually. Then a few months later she made a late payment and they took money from my cc. When I confronted them they claimed she told them to. What p.o'd me the most was:
A: She would never have done that I have known her and she has been my closest friend for many years.
and
B: It's my cc nobody else can give you access to my cc but ME! They actually argued with me saying I gave them authorization when I paid for her membership fee. It does not state that on anything I signed. I even showed the contract to 3 of my law professors and they agree. I asked the moron who argued with me to have his supervisor call me. In the meantime I canceled my cc and when the supervisor called back I explained that by billing my cc without MY authorization it was in fact fraud and I have nothing else to say if they pursue me on this I will gladly skip into the courtroom smiling. I also had to cancel my membership with the gym which stinks but it's collateral damage I guess.

Read full article, explains the inner workings of how this all works.  You are not the brightest light bulb.  I have many different kinds of legal cases come to my desk everyday and every here and then I get one concerning Paramount Acceptance. I have done some digging, as I do not handle these types of cases, and have been given copies of contracts (which I found that the gym writes up not Paramount Acceptance). The following is the correct information on these matters.  For updating information such as billing, address, and phone numbers it is the customer's explicit responsibility to update their information and not the job of Paramount Acceptance to babysit each member making sure they are paying the bills that THEY signed up for. On the subject of auto-renewal of the contract, there is a space for a signature that is required for this before signing the bottom, so those who say they are not notified are mistaken as it is right in front of them as they are signing what they don't read.  As far as fees go it is simple, missed payments = fees, and it is your fault for missing a payment, again this company is not here to babysit you.  For canceling anytime, there is no such thing with these types of contracts, don't listen to the gym rep. who signs you up, they just want their commission, so read the contract thoroughly.  If you want an attorney that is great because then they can look over your contract and explain how wrong you are and what a contract means in the legal system. If you would like to contact the B.B.B. (Better Business Bureau) please do so as Paramount Acceptance has a B+ rating and after your report Paramount your complaint willed be followed by a response explaining how Paramount is within the law on all they do.  Also the F.C.C. and the F.T.C. both are very strict but have stated that Paramount has the legal right to collect, call, file suit, send mail/email, so complaining to them is a waste because Paramount is an official company with all of the above.  Nothing shady about any of this, no lies, it is all in the contract and it would be completely irresponsible not to read it through.  You may argue all you like but if you refuse to abide by the contract the account won't stop at Paramount, it will go to a separate collections agency that doesn't just use the phone to contact you, and eventually it will go to an Attorney and one day you will be at your house, work, or even out shopping and be served a subpoena containing court date.  Also it will be sent to the Credit Bureau and they may not even need to notify you of this.  Further refusal to pay can result in garnishing of wages and tax returns or a court ordered penalty.  It may not happen quickly but a year or two down the line when it happens after you thought it was over and forgotten it will cause more trouble than if you had just paid in the first place.  The legal system may take years but it is effective and never misses a note (or you).  Good examples of those having no clue whatsoever are below and have left comments to this entry.

yes, thats what it says, but things happen like people lose their jobs, or die. and im soory but eating, and having a place to lay my head at night is more important that working out, so it is very unfair to those individuals who go through this for you to tell them that they cannot cancel their contract.....what a load of crap. your company deserves to be sued! I have not found any good reviews on this company and I have been looking since sunday of last week!

This is Paramount Acceptance in Holladay, UT. If you signed a contract with Golds Gym there is a clause on YOUR contract that says you agree all payment arrangements etc. will be processed and/or collected by Paramount Acceptance.

Hey, Hi, i have the same situation with ya.  I never finished my couple months left of training due to injury. Now they are constantly calling asking to be paid for the remaining 2 months that I didn't pay them for because I never went.  They just keep calling and I just ignore their phone calls.  They do leave a message but I never call them back.  Don't know what going to happen from here.  It's been about 6 months of this repeated phone calls.
