I just received a call today. I never answer calls I don't know. A girl left a voicemail and she said I needed to get back to her or they would file charges against me. What do I do? I always just let it go to voicemail. I've been scammed before. I'm worried

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I received a call from this same number, but the name of the law firm was Longuard & Olson stating that I owed $770 from a payday loan with Quickest Cash Advance from 2009.  I informed her that I had paid off this loan through a consolidation loan and she told me that I was being charged with bank fraud and wire fraud.  I told her that according to FCRPA that I was entitled to written verification of the debt.  She transferred me to her supervisor, Ava Longuard, who told me that most consolidation companies were frauds.  I told her that was not the case because I had the proof that the debt was paid off and that according to FCRPA I was requesting written verification of the debt.  She told me "how about I just throw your a** in jail."  At that time I hung up.  I reported the incident to www.ic3.gov

It is scary to know these people have my SSN, my address, my phone number, and my employer name. Can you post the address you have so I can include it in the complaints I am going to file with the FTC and my local AG office?  I can't find an address any where and they wouldn't provide me with one when I asked them for it.  These people have to be stopped.

If you paid them through your bank account, call your bank immediately and file a dispute - you should NEVER pay money to anyone, unless they have MAILED you a debt validation letter proving that you do owe the debt and that they are legally entitled to collect said debt in your state.

Even if the alleged debt is yours, do NOT pay any more money!  The statute of limitations for collection of a bad check is usually 2 to 3 years.  So that's why this alleged collector threatened you - because he knows he can't sue you for recovery of the money.  I've attached a link that might help you - http://www.fair-debt-collection.com/searches/bad-checks.html  - and please, don't be afraid to even ask for a consultation with a consumer lawyer - in most cases, the initial consultation is free, and might give you some peace of mind.

I received a call and was told that I was going to have a warrant and the read me my name and ss # and old addresses. It was very intimidating and They called my sister and threatened her as well. She paid them $400 and I have paid them $100 and have not received a bill stating what I have paid and now because I cant pay them any more at the moment they are back to threatening me. I am a single mom and my husband died and I just lost my job. I am not sure even what to do at this point and can not find any information on these people so do I keep paying or not? Who knows what to do when you are being threatened as badly as they are. and this check is over 6 years old. Inst there a statute?

these fools have called my wife and began threatening her with a prosecution for a payday loan that was alledged to have occurred in 2009. This fool Kris Williams got on the phone with me and was a babbling idiot and very argumentive. When We asked them for some documentation and proof of a debt, the man couldnt and wouldnt even provide us with a case number, didnt seem to really know who he represented. He told me to look up "Check Law 21" which he claimed gave them the authority to file criminal charges whenever he chose. Check Law 21 is only legislation that was enacted so that banks could turn paper documents, such as checks , into digital documents so that sharing would become easier.. We asked repetedly for documentation and he threatened my wife that he had begun to file the refusal to pay information and would be filing criminal charges. In the state of washington the staute of limitations for fraud or forgery is three (3) years. Not whenever u get around to it.. I cant seem to find a lot of information on this collection company, nor would this guy provide me with a valid web site to validate his claim to be from such a company.

Yeah I had a call last week from Rebecca Asher and then today Thomas Miller threatening me via voicemail with felony charges on a payday loan. I checked with my state laws and these people are breaking laws. I might get civil order but not a criminal charge. So lame!

This guy was rude, called me, my daughter, son, mother, sister, fiancee and BOTH of my jobs saying that I was in trouble for fraudalent and legal issues regarding an bad check.  I don't even have a check book!  Luckily, I was able to prove he was a fraud by sites like this or I would have lost my job.  I really wish there was something that could be done about people like this.

Caller claimed to be preparing legal action for a payday loan company. They had enough information to make me request they send me an email to verify information. The email was from a Hotmail account and the attached 'valuation letter' had no physical or mailing addresses for the law firm and had misspelled my last name numerous times.
