That's easy. If a stranger on the phone wants my money for some consumer debt claim, then it's "debt collection" as defined by the FTC. Failing to make required disclosures is then *illegal* debt collection. Pretending to be "process servers" or "pre-litigation" or someone who can rescue people from a lawsuit for a fee is also illegal debt collection. Insisting that "we're not collectors" when collecting is your end game is, say it with me, illegal debt collection. Sorry, kids, but that FDCPA netting is just too big for you to escape.

The "Mini Miranda" in a collections context is a disclosure required by the FDCPA when an alleged debtor is contacted. Most agencies use the boilerplate from the statute: "This is an attempt to collect a debt; any information obtained will be used for that purpose."

Why would you be confused? It's very apparent that a scammer has been caught trying to validate his scam by posting fake testimonials. We see it here all the time. The fraud is called a "Shill". The buffoon was "Busted" because he was so ignorant that he thought he could post under several aliases....all from the same IP.
Fraudulent & bogus debt collectors are never hired for their intelligence. They can't be! Intelligent people don't need to be frauds. Fraudulent/Bogus debt collectors are minimum-wage flunkies for better frauds than they are. They aren't able to work real jobs, so they scam to make a buck. Most of them think of themselves as crafty. Then they try to come here and post BS. They quickly find out that they're not nearly as crafty as they thought they were. Many of us here can spot them immediately. They end up being gutted like fish. The moron on this thread is a fine example of that! The fool will probably try some more. He'll be exposed as soon as he shows up, even if he tries from another IP. Some of the frauds think they can compete with us here. None have succeeded. The regulars here know all the tricks and, better yet, they know the state & federal regulations concerning debt collection far better than the scammers ever will.

I work in collections I have to give quality assurance and mini miranda for every single live person i talk to and that is the law. They didnt say any of those things so how can it possibly be collections?

anyone else actually get served with this number and a few others down the first page? How can I actually get sued for a credit card when other people I know charged way more and didn't pay it? I didn't get any calls or any mail about this just came to my house and me for a signature.

As has been stated, if you have not received a notice of validation by mail (NOT e-mail or fax.), pay them NOTHING!  EVER!
Process servers do NOT call ahead of time. EVER! Process servers do NOT deliver messages. EVER! Process servers are paid to deliver legal documents. That's it! They do NOT have numbers for people to call. EVER!
"Courier Service" is a favored term used by fraudulent & bogus debt collection outfits. Be careful.
Everyone needs to know their rights under the FDCPA. Just Google it. It's not hard to understand. You can also go to ftc.gov.

Someone called me and said they worked independently for a courier service, not a process server. Any difference? Called the 844 number he left and it was a 5/3 overdraft i had from last year. They said it was charged off for $761, which makes sense because I overdrafted $580 and if you look at the interest rates in GA it works out. I tried to pay them a settlement, I offered them 80% in full today, they put me on hold for at least 5 minutes and came back and told me I couldn't get approved. So now i'm going to wait a few days and see if an actual process server from cherokee county contacts me. doubt it but if they do its going to get dropped in court, 5/3 was doing some bs with fees that were illegal and thats why I didn't pay my overdraft

I don't know who called you but it wasn't a process server. They never call in advance (duh). If you hear from him again, tell him you're recording the call and demand that he send debt validation IN WRITING. Certified mail. If he tries to make excuses about why he can't do that it's a scam.

currently in court for a bank overdraft that was 726 dollars got a call from process server telling me he had 2 packets for me from 2 different places. 1 was from a old apartment i had that i got evicted from for my dog ruining the hard wood floor. i ignored that because i heard when servers call you its a rip off sceme but i am not recieving papers saying sorry we missed you and leaving a slip with a phone number. Is this slip for the over draft or from the pet thing? i am in court for the over draft but dont want to go to court from my last land lord any advice????

This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

* Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

* Debt collectors may NOT
- repeatedly use the phone to annoy someone.
- falsely claim that they are attorneys or government representatives
- falsely claim that you have committed a crime
- falsely represent that they operate or work for a credit reporting company
- say you will be arrested if you don?t pay your debt
- say they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
- communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
- say that legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action
- use a false company name
- take or threaten to take your property unless it can be done legally;

The debt collector may not garnish your wages unless there is a court order to do so.
+ Many Federal benefits (including Social Security Benefits) are exempt from garnishment

You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,

Report any problems you have with a debt collector to your state Attorney General?s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.

I got a call as well and they said they had two different addresses from me. I called and tried to set up payments as well but he said I had to immediately pay out $170.00 by this friday when I got paid. I told him that I would have to start next month and he said he was unable to help me and I would just have to wait for my documents. I took out the loan two years ago and it was for $800.00 and now it is $1784.94 and if we go to court the amount I would have to pay back could go up to $3000.00 or more. I tried to resolve it but he wasn't nasty with me but he said $60.00 every two weeks isn't going to cut it and that is a payment designed for someone who is on disability; not me because I work a full time job

Well, let's see here! If they wouldn't take payment, then they'll serve you. At which time you'll have all their information including their physical address, their legitimate name, the owner(s) names, their Attys. name(s), a summons number, a docket number, the name of the signing judge, etc.
When you get all that, post it here & we'll be glad to help you. Somehow, I doubt you'll be providing us with a verifiable thing. No one here will have to wonder why! You've tanked this number with only two posts! Good job!

Person called me 3 times on this number saying they were going to give me papers and come to my job for a signature, I called the phone number the guy left and he told me I had a payday loan and when I tried to pay them they would not take a payment. Help?! I don't want to go to court! I took it out for 800 and never paid on it, got charged off for $1435 and now they are telling me if I go to court I have to pay what could be almost 3 thousand dollars

# to a litigation department. got a call from process server that couldn't locate my house (i live off a back road outside lexington) I called the number he left on my voicemail (8447157289) and it sent me to a company that sounded like a scam for an old credit card i didn't pay on. I hung up on them and now I ended up getting more paperwork this time from my local court and got sued by chase. i learned the hard way this wasnt a scam
