Last week this Jasmine lady called my step mother's cell and my sister in law's cell. Told them that someone was going to serve me papers for fraud. I told them to tell them to stop calling. "Jasmine" called my cell about a half hour ago from a restricted number. She stated I was going to be served and could I please hold. I told her there's no way I'm holding for anyone and asked who she was calling on behalf of. She said, "Empire Legal Services, BUT, I don't work for them, I just make calls". I told her to tell them to send me something in writing and that if ANYONE from her company calls me or any member of my family again I will file harassment charges, told her to have a nice day and hung up.

A person who gave the above number as the call back number called my brother in law's parents' house in regards to me.  How they got that number I will never understand, but told them that I needed to call back at this number.  I called it, no one picked up, but then someone with a restricted number called me back couple minutes later.  They told them the company is Empire, but no other information was received about it.  I haven't received any calls myself or had any messages left until this call today to someone way outside my circle of contacts I would put on any references about me.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I received a call from a woman supposedly by the name of Kim claiming to be a process server with threats of criminal and civil charges that would result in jail time if I ignored the matter. She gave me instructions to call the 844-879-3979 number and gave me a case number to reference to. I was told I had 5 charges against me for fraudulent activity in relation to a payday loan from 2009 that I know was paid off in 2009. I was told that I had 24 hours to fax proof this debt was paid or I would be served. That was 2 days ago. I was told I could pay $490 to resolve everything. These people have been calling not only myself but my fiance, my parents, and my ex husband and his parents. It is very frustrating!!!!

Just received a voicemail from a man who said his name is Steve Stone & he is a private investigator who had received a fax from a company related to fraudulent charges. He said that a summons would be served on a person by the name Eric (last name was the same as mine but Eric is my brother-in-law). Said a summons is set to be served at Eric's home & work. What the heck?? When I call back 844-879-3979, the call doesn't even go thru. Bunch of scammers!

You might see if you can get a call blocker installed at your workplace.  If they call you, demand a statement of the debt be send to you by US mail.  NOT E-MAIL.   If they don't send you this,  then,  just ignore them.   You are the target of an extortion attempt.  It is especially bad when they call someone's workplace.    Don't waste your time trying to get information about what company is involved; they are fly-by-night  scammers.

See:  http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors

Do NOT pay them anything.  You just keep this stuff going if you have record of giving into scammers.  DO NOT let them threaten you with arrest.  There is no arrest for ordinary civil debt in the US.

Ignore 'em.  Total scam.   Someone is trying to scare you into paying money for a non-existent or basically unenforceable debt.  Demand a written statement of the debt and demand that it be sent to you by US mail.

Go to local police.   Contact local attorney general

See:  http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors

See:  http://oag.ca.gov/contact/consumer-complaint-against-business-or-company

No body is going to arrest you for civil debt.  They are required to send you a statement of the debt by US mail.  If they don't do that, ignore them.   Do not answer any calls from numbers you don't feel good about .

Might invest in a call blocker.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I just recieved a call at work...I was on the phone so it went to voice mail.  When I listened to it I am told by a very rude sarcastic woman that she is serving me with notice that suit is being brought against me in the county (which she had correct) that I live in and also had the last 4 digets of my social correct.  She stated that I had 24 hour to get back to her at 844-879-3979 and refer to file # SAR5145 or a summons wound be served to me at my home and place of emplyement. "YOU HAVE BEEN NOTIFED" CLICK!  I tried to call back to find out who was calling because they did not state the company name and the number would not go through!  I anm so tired of these calls...in the past I fed into them and ended up paying 3 times for something that I paid off in the original agreement.  I have so much going on in my life that I have been put on medication and this kind of stuff just does me in for the whole day.  Please tell me how to get them to stop.

I too received a complaint from sherry Daniels stating she had a formal complaint and that they would send out a summons. But a few months ago I got a call and they wouldn't even give me the company that has filed the complaint. And they said I could contact them at 18448794979. And she was chewing gum when she left the message interesting.

I received a call from a caller ID blocked number last week.  A message was left stating that I was going to be served at my place of employment and home, blah, blah, blah.  I called the number they left back (844-879-3979) because I've dealt with this before and know that if I didn't respond they would start calling my office - I wanted to try to avoid the hassle.  I spoke with a nice, professional woman - explained to her that a month ago I got the same story from another company and they refused to provide me with any proof of the debt.  She said she would email me something as soon as we got off the phone.  I've been checking my inbox and spam for a week and have not received a thing.  Last night, I received a phone call from the same women saying that I had until today at 2pm to call her back or she'd be sending my file back to the "lawyers" office.  I haven't decided whether I want to call back and argue with her today.  I know this is a scam and under normal circumstances I wouldn't bother calling back - but when they call my office, these companies leaves these awful voicemails on general voicemail boxes and I have to explain myself time and time again to people that its a scam.  If I decide to call back, I'll be sure to update here.
