I should add that one advantage of them being based in the U.S. is that the FBI might actually be able to arrest them and shut them down. If you receive calls from them, report them to the FBI's Internet crime complaint center (IC3).

The more people that report them, the more likely the FBI will arrest these guys. It's an interstate crime, so the FBI does have jurisdiction, and because of the publicity the payday loan scams have received lately, the FBI is serious about making some arrests, so please, file a report if they try to extort money out of you.

They are just a variant on the India/Pakistan payday loan scam where they threaten to arrest you or file a "criminal case against you" for a payday loan or bad check. The reason this sometimes works is because they get your personal information from either:

1. Hacking (or insider data breaches) legitimate payday loan companies or
2. Pretending to be a legitimate payday loan company and getting your info when you apply for a payday loan via a comparison site (most payday loan sites that appear in search results are actually comparison sites which pass your information to real and fraudulent lenders to gain a commission).

Thus, most people they call have actually had (or applied for) a payday loan at some point, and it's easy to second guess yourself when they threaten you.

These current people are a little more effective because they can actually speak English (though perhaps at an elementary school level, but accentless English anyway). With the India payday loan scam, it's easier to ignore because the guy calling says he's "John Smith" or something from "Law Investigations" in Texas but has the heavies accent you ever heard, so part of you already thinks "scam".

However, don't be fooled...these people are scammers! It's the same scam, but with native English speakers.

Do not send money, do not call back!

Remember that before any judgement can be obtained, you have to be physically served paperwork (if you aren't you can have the judgement thrown out). Also, they cannot arrest you for a civil judgement.

Despite what the payday loan industry would like you to think, defaulting on a payday loan is NOT the same as passing a bad check. A post dated check is an agreement to extend credit, NOT the same as a promise of funds (as would be the case for a current dated check that you would use to pay in the supermarket, for example).

Appears to be a debt collector, she asked for a woman (Sandra) who doesnt work here any more, then said her name was Erica Benton and Sandra should call her at 877-588-9108, that it was in reference to Sandra's relative John.
