Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

Debt collectors get a "bad rap" because they have earned it. Your colleagues have a rather nasty habit of threatening people with criminal prosecution over unpaid payday loans which is illegal and not sanctioned by your industry's own trade association:

The facts *are* straight - NO ONE gets a heads up they'll be served.  EVER.  And if you are so "legitimate", then you can post the legal company name, physical address and website if any.  Per federal law - the FDCPA - debt collectors MUST mail proof of debt/proof they have the legal right to collect said debt within five days of their initial contact with an alleged debtor.  Per the FDCPA, refusal to do this means that an alleged debtor should NOT PAY.  You should also remember that shills from companies and scammers also post here - and are immediately called out.

First of all lets get the facts straight. We only call legitimate payday loan accounts. We do not scam or threaten anyone. All info that we have come over on the accounts from the original creditor.  Debt collectors always get a bad rap. How about the consumers who open up the payday loan and the FUNDS are deposited into there personal checking accounts within 24 hours. Yes they sign electronically via email , so they are responsible to pay back the original amount and the high interest that they agreed to pay back . Ending I would like to say anyone can post negative comments so remember  everything you read always has two sides to it.

Trying to collect on debts that are way past the SOL-I guess that would be considered a huge lie.  Offering a "notarized copy" of a debt might make you sound on the up and up, but most folks want the Validation of Debt, which you slime balls do not have, and will not/cannot provide.  Don't preach about ethics, brother, because you really need to take your own advice and work on yourself and those employed by you before you can point fingers.

No, the legal way to find out if you owe a debt is for the DEBT COLLECTOR  to mail the mandatory letter to the alleged debtor.  Per federal law, the debt collector bears the burden of proof to show that an alleged debtor owes them money, not the other way about!

Folks, if you receive a call from this "company", they MUST - by law - MAIL proof of debt/proof they can legally collect said debt within five days of their initial contact with you.  Refusal to mail this documentation within five days is a violation of federal law.  And per the FDCPA, no written, verifiable proof of debt mailed to you - do not pay!

Also i have no problem providing anyone with a notarized copy of the debt notarized means its 100% real and legitimate. You can chose to believe uneducated people and their slanderous statements but at the end of the day that's all they are is upset uneducated immature individuals who are upset that they have to deal with the consequences of their actions now. So the only way they think they can hurt us is by posting lies about us on a  forum. At the end of the day the truth always comes out believe what you want but do your own research make your own determination call your original creditor check your credit report and only deal with company's that will provide you with a notarized proof of debt because if they are legitimate they will have no problem doing so. The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Received 2 vm yesterday and today from an unknown number  girl said her name Diana Shapiro saying she would be going to my place of employment with papers?  And that I needed 2 pieces of valid ID and a witness to sign?  Told me to call the 855 number if I wanted to prevent her from showing up.
