First off--had hard time understanding this person.  Wanted verification of my email address.  Hung up on him and then I decided to call him back to tell him to get me off his list--of course he tried to say I was not on any list.  At that point I told him to never call my number again or he would be charged with harassment.  My daughter is an attorney and my son-in-law is a district attorney-that must have got his attention.  Such a scammer!!  When will these type of calls end.  I am on the do not call  list but continue to get these calls.

I too received the below email. O did a google search for the phone number below after not finding anything about this company and came across this page. I must admit they almost scared me in thinking my system or mailserver somehow got infected so glad to find this site verifying my suspicion that it in fact is a scammer.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Colleen, Sorry to hear that you have fallen victim to this type of illegal practice.  The moment they told you there was a ?warrant? they violated the law and any chance of recovering a legal debt was lost to them.  This is why any legitimate collection agency will never tell you they are going to ?have you arrested? or ?have a warrant? or ?have the police come to your work/home.?  It?s simply not worth it; a legitimate collection agency WILL NOT endanger their last chance to collect by actually suing you to get a judgment.  So when someone starts by doing this you know it?s a fraud.

Now make sure to call your local police and find out about if a ?process server? is an officer of the court.  In almost all locations they are and in almost all locations it?s illegal to impersonate one.  The easiest way to deal with these frauds is to get them brought up on criminal charges.  Sadly the illegal collection part is civil not criminal and harassment is typically a misdemeanor.  However in most cases impersonating an officer of the court is a felony and that has some real weight behind it.  So if they committed that crime go after them for it.

First of all, John thank you so much for all of that information - I wouldn't even know where to begin.  Second, these people are crazy!  They told me that a warrant had been issued for my arrest and that I would even be arrested at my place of work - I was scared to death!  The first person I spoke with, Rosa Martinez, gave me a call back number of 209-262-3489 and the second person who called me, Rodney, called from 855-202-7128 extension 105.  When I did reverse calling I got either a cell phone number or was forwarded to a website, such as this, that had lists and lists of complaints about these calls and this so-called company.  Beware of calls like this and ALWAYS demand more information then they are willing to give you.

AJ your right up there with the people who say the girl deserved to be raped because she wore a short skirt.

We are a nation of laws.  Most of the Pay Day Lenders are violating state laws that make the loans invalid to begin with.  But even if the loan is completely valid the collection practices that you can use to collect on them are regulated.  Saying that it?s okay to illegally abuse a person because they lost their job or were unable to make a payment on a loan is just silly.

This is why I advise everyone to call the police on these types of frauds.  If they are violating the law in trying to collect a debt then they should be held to account for that violation.  In my case a collector similar to LPS out of California violated the FDCPA so I hung up on them.  They called back and violated the criminal code by impersonating an officer of the court so I finally got them arrested charged and convicted of a felony.   6 month probation, basically a slap on the hand, but at least I got the conviction.  Armed with the evidence of the conviction and the harassing calls I then sued the b*****d for 19 violations of the FDCPA, the 1996 Telecommunication act and simple harassment.  I was awarded $27k in Orange County.  The b*****d skipped out so in the end I got to wait in line behind dozens of creditors all attempting to get paid off what little scraps this scum bag left behind.

But you know what?  I feel great about it.  I?m out a little money, but it?s not that much, my attorney worked for a percent of the verdict so we both got screwed.  The attorney has chased the guy over 5 states pursing him with a vengeance, but reality is the dirt back can?t support himself let alone pay us so I think I will never get anything. I?m out a little time but it was worth it.  Now 5 or 6 scum bags popped up to take his place but I don?t care,  if 10% of the people illegally targeted by this scum fraught back they would all be bankrupt felons working at a minimum wage jobs taking orders form the people they terrorized and being pursued by creditors trying to get paid.   There is justice in the irony!

It is ILLEGAL per Federal law(s) for collection agencies to threaten a debtor.  You should be able to find the information via Google as to what the statute number is.  All collection agency personnel know it is illegal but there are still some out there that do so.  Most that threaten are SCAMS and they think they are above the law to begin with so you're at a loss on that scenario. They are a fraudulent collections company attempting to defraud you.  First thing you need to do is send them a ?cease and desist? letter at the address below.  Then send a complaint letter with all the information they gave you, name of the company (They uses multiple names), who you spoke with, account number, and the amount they say you owe to your State Attorney General the NY State Attorney General and the Federal Trade commission.  Address for all but your state are below.  

Next call your local police and file a complaint about the harassing phone calls.  Ask if your state licenses ?Process Servers? and if a Process Server is considered a ?officer of the court? in your state.  If they are, and the person from LPS said they were going to ?serve/arrest you? tell the officer you wish to press charges for ?Impersonating an "Officer of the Court?.  I wish I could say the police are going to happily do this but they are not, you will most likely have to insist.  As a citizen you have a right to have your charges investigated and be provided with the reports of that investigation.  But you will have to insist and you will have to follow up.  I do it twice a day,  ?Hello detective X it?s John Doe, can you tell me the status of my complaint??  You will be surprised how quickly they will open the investigation and turn it over to the Grand Island Police/Erie County NY Sherriff?s office.  At that point stop calling your local police and start calling the Erie County DA?s office at (716) 858-2424 and request the status.  Now Erie is basically Buffalo so big city types will try and blow you off.  Insist they send you the documentation on the case and provide you with the names of the investigating officer.  Again you have a right to have your complaint investigated.  After they investigate they can close it but they have to actually do the investigation first.  If they close the case without prosecution start going to the NY Attorney General?s office.  Just don't take no for an answer.  

As for the collector, after you have sent your cease and desist letter refuses to talk to them.  They have no right to collect from you after they A) violated the FDCPA B) Committed a crime by impersonating an officer of the court and C) violated the law by insinuating you committed a crime by having an ACH (Automated Withdrawal) canceled or declined.  (In no state is that a crime, it is not check fraud, bank fraud, or passing a bad check)

Don?t be a victim!  Stand up for your rights and help get these frauds shut down.

Someone "named" Rosa Martinez just called me saying that a warrant is being issued for my arrest because I owe over 1,000 in bounces check fees.  She had my name, bank and DOB which is scary.  I do not have any such charges and have spoken to my bank, and the FBI.   She said she was calling from Legal Processing Service and gave a call back number of 716 402 1409 or 281 305 0030 but the number that came up on the caller ID was 855 202 7128.  She called my job so this matter will be addressed.  This is a complete scam but is scary because they have information on you.  But this will be looked into. There are so many of these people out there. And I am sure they are reading these blogs.

Received a call from this number from Alan Hunt. First call came as Unknown. I answered but there was no one on the line. I hung up and they called back immediately. They asked to speak to me but I said I wasn't there. I questioned what it was in reference to. He said there was a warrant for my arrest. I repeated what he said but then he changed his statemen to there could be a warrant. Being very suspicious because he seemed to be stuttering and looking for answers to my questioning. I told him the person he wasn't here but overseas. He said he would note it. I asked if it was something I should notify the police over. He then hung up.
